Henderson County, Replacement of Bridge Numbers 335 on SR 1238 over the Mud Creek. TIP No. B-3856, State Work Order No. 82982301, WBS Element No. 33303.1.1, Division 14. Dear Sir: On May 9, 2007, the NCDOT requested a Nationwide Permit 23, 33 and 401 General Certification numbers 3632 and 3634 for the subject project. The NCDOT is in receipt of a letter from your office dated June 25, 2007, copy attached for your convenience, placing the project on hold for the following reasons: 1. Please provide geomorphological data for the proposed stream mitigation areas as well as the reference reach data. 2. Please provide a Sediment Transport Analysis for the reference reach and proposed stream mitigation areas. 3. Please provide information on conservation easements or property access and/or ownership of the stream mitigation sites. 4. Please provide planting densities and techniques for the project. In response to item 1: As requested, NCDOT is providing the geomorphological tables in the enclosed attachment. In response to item 2: Per conversation between LeiLani Paugh (NCDOT) and Mike Parker (NCDWQ), Sediment Transport Analysis is not performed on stream relocation projects. The stream design is based on discharge information and the existing stream geomorphology (See Attached). Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: Onsite Stream Mitigation Plan 1. Please provide geomorphological data for the proposed stream rnitigation areas as well as the reference reach data. Data provided in the June 18, 2007 e-mail is not sufficient. Also, no reference reach data has been provided. 2. Please provide a Sediment Transport Analysis for the reference reach and proposed stream mitigation areas. 3. Please provide information on conservation easements or property access and/or ownership of the stream mitigation sites. 4. Even though species information has been provided the planting plan is not detailed enough for approval. Please provide planting densities and techniques for the project. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
