Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to dredge
and place fill in 0.25 acres of wetlands or waters for the purpose of upgrading an existing road at Blaire
Farm/Blaire Pointe, LLC as you described in your application dated December 3, 1997. After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification Number
3112. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge
and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except
as modified below. If you change your project, you must notify us and you may be required to send us a
new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions
listed below.
1. Deed notifications or similar mechanisms shall be placed in lots with remaining jurisdictional
wetlands and waters to restrict future wetland and/or impact. These mechanisms shall be put in
place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later).
2. Sediment and erosion control measures shall adhere to the design standards for sensitive
watershed (T 15A:04B .0024).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

That the project be done in such a manner so as to not cause turbidity outside the immediate
construction area to exceed 25 NTU.
If additional wetland fill is needed for development, the request for this fill should be made
concurrent with this application so that all impacts associated with this project can be reviewed
at the same time. It is also recommended that the 401 Certification contain a condition that a
conservation easement be placed on the remaining wetlands to prevent future fill.

9. NARRATIVE DESCRIPTION:
Project Setting
The applicants' property is a 267 -acre tract of land located north of Morehead City
between North 20th St. and the Newport River. The property borders Crab Point Bay
and Dill Creek with vehicular access currently via the end of SR 1177. An old marl
road is located on the site and connects SR 1176 and SR 1177. According to the
applicants, the road was built in the late 1970's to connect SR 1176 to the Haystacks
Condominiums. At that time, the road construction consisted of clearing, grading the
road bed and installing storm drainage pipe. The road essentially runs along the head of
the marsh system of Dills Creek. The roadside ditches that were excavated years ago for
drainage have now become vegetated with Smooth Cordgrass Spartina alterniflora, Black
Needlerush Juncus roemerianus, and Salt Meadow Grass S. aP tens. Jurisdictional 404
wetlands are also located on both sides of these Coastal Wetlands. The waters of Dill
Creek are SA and it is classified as a Primary Nursery Area by the NC Marine Fisheries.
The area is closed to shellfishing.
Earlier in the year, the applicants applied for and were granted CAMA Major
Permit #100 -97 to develop a 33 -lot subdivision at the site. This project included
roadway improvements (shoulder improvements) to the abandoned end of SR 1177, the
construction of a bulkhead, and the extension of sewer and water services to the site
from North 20th St. The current application is being submitted as a modification to that
existing permit. At that time, in order to compensate for the loss of approximately 1,415
ftz of Coastal Wetlands that were impacted by the project, the applicants were required to
develop a compensatory wetland mitigation plan for the project.
Project Description
The applicants' latest proposal is to "reconstruct" approximately 6,000 linear feet
of existing marl roadway known as the Blair Farm Parkway. This roadway serves as a
direct connection to the applicants' property from SR 1176. According to the
application, the reconstruction will consist of minor clearing along the back slopes of
existing ditches, cleaning out and regrading existing ditches, regrading and
supplementing the stone road bed and finally paving the roadway with asphalt. The
pavement would be 22' wide with two 20' right -of -ways. The roadside slopes would be
maintained at 3:1.
Nine areas of Coastal Wetlands within the ditches would be excavated as a result
of the roadway improvements. The dimensions of these nine areas are: Area "A" (5' X
70'), Area "B" (8' X 305'), Area "C" (8' X 100'), Area "D" (5' X 10'), Area "E" (7' X

20'), Area "F" (7' X 155'), Area "G" (7' X 38), Area "H" (5' X 30'), and Area "I" (9'
X 550'). Surface drainage from the roadway would continue to be diverted into existing
lateral ditches that empty into Dills Creek. Approximately 1100' of the roadway would
be raised to avoid being flooded during high tides. The minimum side slopes and
shoulder widths have been designed to meet NCDOT requirements.
Again according to the application, this application would satisfy a public need by
providing a vital traffic link between residents of Blair Pointe -Phase I, the Haystacks,
and lots along the east end of Country Club Road with SR 1176. There is a letter from
NCDOT included in the application package which states that the subject road is shown
on the 1995 Morehead City Thoroughfare Plan as a minor thoroughfare. The plan was
adopted on September 8, 1995 by the NCDOT and Morehead City. It goes on to say
that should the road meet housing requirements and minimum construction standards, it
may be eligible for addition to the state highway system. The town of Morehead City
has written a letter supporting the road indicating that the improvements to the roadway
will provide the necessary link between the eastern terminus of Country Club Road and
North 20th St. The letter from the Town Manager goes on to say that the link will
furnish a vital link between the residents of the area and the emergency services
departments such as fire, rescue, and police.
Anticipated Impacts
The reconstruction and paving of the roadway would remove approximately
10,231 ft2 of Coastal Wetlands currently located within the "roadside ditches ".
Approximately 28,600 ft2 of roadway would be raised to prevent overwash during high
tides. And according to the applicant, the flat grades along the road would keep
velocities less than 5 feet per second and a good vegetated stand of grass should occur
rather quickly. The installation of erosion control devices should prevent any
sedimentation problems. And although the ditches currently drain into Dills Creek, it
does seem logical that the paving of the roadway would increase the amount of
freshwater runoff into Dills Creek.

The purpose of this project is to reconstruct approximately 6,000 linear feet of existing
marl roadway. This road was built in the late 1970's to connect NCSR 1176 (North
20th Street) with Haystacks Condominiums. The road construction at that time
consisted of clearing, grading road bed, installing storm drainage pipe and 20 -24 feet
of marl for stabilization. This roadway has also been added to the Town of Morehead
City's thoroughfare plan as a minor collector. The owners of this tract of land wish to
reconstruct this road to NCDOT standards. This reconstruction will consist of minor
clearing along the back slopes of existing ditches, cleanout and regrading of existing
ditches, installing erosion control devices, regrading and supplementing stone road
bed, paving and seeding. The flat grades along this road would keep velocities less
than 5 feet per second and a good vegetated stand of grass should occur rather
quickly. This reconstruction, after completion will satisfy a public need by providing a
vital traffic link between residents of Blair Pointe, Phase 1, the Haystacks, and lots
along the east end of Country Club Road with NCSR 1176 (North 20th Street). This
roadway would also provide easy access for emergency vehicles which have been
called to serve the above referenced residences.
The areas of impact to Coastal wetlands is shown on sheet 12 of 20 and consists of
approximately 10,231 square feet. This existing marl road has been in existence since
the late 1970's. The road location cannot be feasibly shifted in direction due to the fact
that there are 404 wetlands on each side of the road (along the majority of the impacted
area) as well as water and sewer lines just off the north and south side of the gravel
road. Due to the 404 wetlands on each side of the road, this plan of cleaning of
existing ditches would impact the Coastal Marshes the least. There are nine small
areas of existing Coastal Wetlands that will be affected and there sizes are as follows:

The impact from construction in the AEC zones would consist of minor ditch cleanout
shown on sheet 12 of 20. The ditch cleanout is essential to provide functional drainage
through existing roadside ditches. The minimum side slopes and shoulder widths
shown on sheet 13 must be constructed to acquire acceptance by NCDOT. All
required cross pipes have been installed in previous construction activities. There will
be approximately 12" of select fill added in the easterly 800 feet of roadway, however,
this fill will be placed in the middle of the road and will not require filling in AEC zones.
This fill is essential to bring the road elevation at or above 5.0' which would prevent
extremely high tides from topping the road. Failure to fill this low area in the road bed
would create a public safety hazard for motorists using this road. Surface drainage
from this roadway will still continue to be diverted into existing lateral ditches that empty
into Dills Creek.

9. NARRATIVE DESCRIPTION:
Project Setting
The applicants' property is a 267 -acre tract of land located north of Morehead City
between North 20th St. and the Newport River. The property borders Crab Point Bay
and Dill Creek with vehicular access currently via the end of SR 1177. An old marl
road is located on the site and connects SR 1176 and SR 1177. According to the
applicants, the road was built in the late 1970's to connect SR 1176 to the Haystacks
Condominiums. At that time, the road construction consisted of clearing, grading the
road bed and installing storm drainage pipe. The road essentially runs along the head of
the marsh system of Dills Creek. The roadside ditches that were excavated years ago for
drainage have now become vegetated with Smooth Cordgrass S artina alterniflora, Black
Needlerush Juncus roemerianus, and Salt Meadow Grass S. paten s. Jurisdictional 404
wetlands are also located on both sides of these Coastal Wetlands. The waters of Dill
Creek are SA and it is classified as a Primary Nursery Area by the NC Marine Fisheries.
The area is closed to shellfishing.
Earlier in the year, the applicants applied for and were granted CAMA Major
Permit #100 -97 to develop a 33 -lot subdivision at the site. This project included
roadway improvements (shoulder improvements) to the abandoned end of SR 1177, the
construction of a bulkhead, and the extension of sewer and water services to the site
from North 20th St. The current application is being submitted as a modification to that
existing permit. At that time, in order to compensate for the loss of approximately 1,415
ftz of Coastal Wetlands that were impacted by the project, the applicants were required to
develop a compensatory wetland mitigation plan for the project.
Project Description
The applicants' latest proposal is to "reconstruct" approximately 6,000 linear feet
of existing marl roadway known as the Blair Farm Parkway. This roadway serves as a
direct connection to the applicants' property from SR 1176. According to the
application, the reconstruction will consist of minor clearing along the back slopes of
existing ditches, cleaning out and regrading existing ditches, regrading and
supplementing the stone road bed and finally paving the roadway with asphalt. The
pavement would be 22' wide with two 20' right -of -ways. The roadside slopes would be
maintained at 3:1.
Nine areas of Coastal Wetlands within the ditches would be excavated as a result
of the roadway improvements. The dimensions of these nine areas are: Area "A" (5' X
70'), Area "B" (8' X 305'), Area "C" (8' X 100'), Area "D" (5' X 10'), Area "E" (7' X

20'), Area "F" (7'X 155'), Area "G" (TX 38'), Area "H" (5'X 30'), and Area "I" (9'
X 550'). Surface drainage from the roadway would continue to be diverted into existing
lateral ditches that empty into Dills Creek. Approximately 1100' of the roadway would
be raised to avoid being flooded during high tides. The minimum side slopes and
shoulder widths have been designed to meet NCDOT requirements.
Again according to the application, this application would satisfy a public need by
providing a vital traffic link between residents of Blair Pointe -Phase I, the Haystacks,
and lots along the east end of Country Club Road with SR 1176. There is a letter from
NCDOT included in the application package which states that the subject road is shown
on the 1995 Morehead City Thoroughfare Plan as a minor thoroughfare. The plan was
adopted on September 8, 1995 by the NCDOT and Morehead City. It goes on to say
that should the road meet housing requirements and minimum construction standards, it
may be eligible for addition to the state highway system. The town of Morehead City
has written a letter supporting the road indicating that the improvements to the roadway
will provide the necessary link between the eastern terminus of Country Club Road and
North 20th St. The letter from the Town Manager goes on to say that the link will
furnish a vital link between the residents of the area and the emergency services
departments such as fire, rescue, and police.
Anticipated Impacts
The reconstruction and paving of the roadway would remove approximately
10,231 fe of Coastal Wetlands currently located within the "roadside ditches ".
Approximately 28,600 ft2 of roadway would be raised to prevent overwash during high
tides. And according to the applicant, the flat grades along the road would keep
velocities less than 5 feet per second and a good vegetated stand of grass should occur
rather quickly. The installation of erosion control devices should prevent any
sedimentation problems. And although the ditches currently drain into Dills Creek, it

The purpose of this project is to reconstruct approximately 6,000 linear feet of existing
marl roadway. This road was built in the late 1970's to connect NCSR 1176 (North
20th Street) with Haystacks Condominiums. The road construction at that time
consisted of clearing, grading road bed, installing storm drainage pipe and 20 -24 feet
of marl for stabilization. This roadway has also been added to the Town of Morehead
City's thoroughfare plan as a minor collector. The owners of this tract of land wish to
reconstruct this road to NCDOT standards. This reconstruction will consist of minor
clearing along the back slopes of existing ditches, cleanout and regrading of existing
ditches, installing erosion control devices, regrading and supplementing stone road
bed, paving and seeding. The flat grades along this road would keep velocities less
than 5 feet per second and a good vegetated stand of grass should occur rather
quickly. This reconstruction, after completion will satisfy a public need by providing a
vital traffic link between residents of Blair Pointe, Phase 1, the Haystacks, and lots
along the east end of Country Club Road with NCSR 1176 (North 20th Street). This
roadway would also provide easy access for emergency vehicles which have been
called to serve the above referenced residences.
The areas of impact to Coastal wetlands is shown on sheet 12 of 20 and consists of
approximately 10,231 square feet. This existing marl road has been in existence since
the late 1970's. The road location cannot be feasibly shifted in direction due to the fact
that there are 404 wetlands on each side of the road (along the majority of the impacted
area) as well as water and sewer lines just off the north and south side of the gravel
road. Due to the 404 wetlands on each side of the road, this plan of cleaning of
existing ditches would impact the Coastal Marshes the least. There are nine small
areas of existing Coastal Wetlands that will be affected and there sizes are as follows:

The impact from construction in the AEC zones would consist of minor ditch cleanout
shown on sheet 12 of 20. The ditch cleanout is essential to provide functional drainage
through existing roadside ditches. The minimum side slopes and shoulder widths
shown on sheet 13 must be constructed to acquire acceptance by NCDOT. All
required cross pipes have been installed in previous construction activities. There will
be approximately 12" of select fill added in the easterly 800 feet of roadway, however,
this fill will be placed in the middle of the road and will not require filling in AEC zones.
This fill is essential to bring the road elevation at or above 5.0' which would prevent
extremely high tides from topping the road. Failure to fill this low area in the road bed
would create a public safety hazard for motorists using this road. Surface drainage
from this roadway will still continue to be diverted into existing lateral ditches that empty
into Dills Creek.

Enclosed is the application of Blair Point, LLC for Department of the
Army authorization and a State Water Quality Certification to pave
approximately 6,000 feet of an existing marl road known as Blair Farm Parkway,
.resulting in impacts to approximately 10,231 square feet (.24 acre) of
wetlands, for the purpose of linking SR 1176 and SR 1177 near Dills Creek.
This work is in addition to the US Army Corps of Engineers permit, Action ID
199706041 issued to Blair Pointe LLC, to place fill material into 1,415 square
feet (0.032) of wetlands for Phase I of the subdivision located at the end of
SR 1177 adjacent to the Newport River and Crab Bay Point in Morehead City,
Carteret County, North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by February 6, 1998, the District Engineer will deem that
waiver has occurred.
