APPROVAL of 401 Water Quality Certification

Dear Sirs:
You have our approval, in accordance with the attached conditions, to place fill material in 0.04 acres of
wetlands or waters for the purpose of developing a commercial - residential facility on Lake Hickory at
Riverbend Properties Subdivision, as you described in your application dated December 4, 1997. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 3099. This Certification allows you to use Regional General Permit Number 030 when it is issued by
the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non - Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed
in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear John,
The proposed use of the +- 360 acres of the property is for a commercial- residential facility consisting of 67 boat
slips, one loading dock, a concrete marine ramp, and a shoreline stabilization (rip -rap wall)of approx. 600 ft. of
property fronting Lake Hickory. The total shoreline area of the project property is 9,574.96 ft. The total
environmental area shoreline is 2,865.79ft. The total sum of buildable shoreline therefore is 6,709.17ft. The
rights for this facility will be conveyed to:

Directions: Take highway 321 N from Hickory. Cross the bridge over the Catawba River, go approx. 3/4 mi. take
a right on New Farm Rd., follow road into subdivision.
The location of the proposed facility is shown on the attached map.
The attached Registered Land Survey shows the proposed leased area, structure, and additional minimum clear
distances surrounding the structures of twice the slip length on the side of boat ingress and egress, and 15 ft. from
all other sides (distances are shown on corresponding drawings to each individual facility 1 -7).
This facility will be used to serve the residents of Riverbend Properties Subdivision
The marine facilities consist of seven (7) seperate boat docks to accommodate sixty seven (67) boats. The
facilities are 118' long and 44' wide. One loading dock which consists of a pier 10 ft. long by 4 ft. wide, a ramp
12 ft long by 4 ft. wide, and a floating dock 14 ft. long by 12 ft. wide. Adjacent to the dock is a concrete marine
ramp 45 ft. long by 16 ft. wide. The facilities will be constructed of galvanized steel framing, high quality treated
materials, with encapsulated styrofoam used for flotation. See physical survey map, section thru drawings, and
detailed layout drawings for facility dimensions. These facilities will be used for access to the lake for recreational
use by the residents of the Riverbend Properties subdivision.
The proposed construction is planned so as not to conflict with the natural, historic, and scenic values of the
project. Concentratrion of the boat slips in a small area reduces the number of individual pier and boathouses.
Proper waste disposal will be provided by a device that pumps sewage from the boats to an approved septic system
on shore. No historic sites will be disturbed. The applicable sedimentation requirements will be enforced during
construction.
There will be no change in project operations due to the proposed construction of the facility.

There will be no adverse environmental effects should this proposal be implemented.
The public interest will be served by providing ample access for residents of Riverbend Properties to Lake
Hickory.
A lease is being prepared by Duke Power between Duke Power Company and Gunpowder LLC.
