After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a writter petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. FIELD INVESTIGATION REPORT: 10/31/97 George W. Byrd PAGE #2 9. PROTECT DESCRIPTION The project site is located on the southeast side of Broad Creek, approximately 1050' south of the Highway 24 bridge over Broad Creek. The street address is 166 Pelican Drive, off of Broad Creek Loop in Carteret County. This is a very low density residential area. The project property has 1.14 acres, varying from 2' to 14' in elevation. There is an existing residence on the site, and a high ground basin, ±100' x 40', that was excavated prior to the enactment of the CAMA. Aerial photography indicates a channel of approximately 100' was excavated into Broad Creek from the basin. There are no records to indicate that the basin or channel have been maintained. The residence is serviced by a private septic tank and municipal water. There is also an individual well on the property. According to the applicant, the property has experienced a loss of approximately 1.5' of shoreline over the past year. The Carteret County Land Use Plan classifies this area as Limited Transition, with those areas within the CAMA Areas of Environmental Concern classified as Conservation. Broad Creek is not designated as a Primary Nursery Area downstream of the Highway 24 Bridge; the upstream portion of Broad Creek is designated PNA. Broad Creek is closed to the taking of shellfish for consumption by the Division of Shellfish Sanitation, and the Division of Water Quality classifies the waters of Broad Creek as SA. There is a ±36' x 20' area of Spartina alterniflora within the basin on the north side; the point of land on the southwest side of the basin is vegetated with ±120 square feet of the same, and an additional ±50 square feet of mixed Salicornia spy., Distichlis sspicata, and Borrichia frutescens. The northern shoreline along Broad Creek is bordered by a 2' to 4' fringe of S ap rtina ap tens, Borrichia frutescens, and Juncus roemerianus. Here, there is also a 2' x 10' fringe of SSpartina alterniflora. The Broad Creek border of the property is heavily underlain with relic concrete and brick rip rap. There are scattered bricks and debris within the basin as well. The bottom area of the basin is composed primarily of sandy silt, becoming sandier toward the mouth. There are a few scattered oysters within the basin, and no other indication of a shellfish resource. There are no beds of SAV this far north in the creek. Broad Creek is approximately 800' across at the project site. The applicant is proposing to perform maintenance excavation to the basin and the access channel by dragline to high ground. The area proposed for excavation within the basin is 129' x 28' to a depth of -4' mean low water. Current soundings in the basin approximate -1.13' mean low water. The area proposed,for excavation within the access channel to Broad Creek is 120' x 36' to a depth of -4' mean low water. Current soundings within this channel approximate -2.32' mean low water. There are ±650 cubic yards of bottom material to be removed from a ±7932 square foot area, requiring the removal of approximately 880 square feet of Spartina alterniflora and 50 square feet of mixed high marsh. The partially dewatered spoil material is to be temporarily stockpiled on the high ground portion f of the project site in a 65' x 35' designated area, and contained with siltfencing. This area can accommodate ±337 cubic yards of material. The spoil material will be used for the filling of a portion of the basin area, and the backfilling of the bulkhead, with any excess to be spread over the lot. The proposal includes the filling (with spoil material) of the landward end of the basin, approximately 28'x 39'. The basin and the north shoreline of Broad Creek will then be stabilized with a vinyl bulkhead structure. This structure will be situated 2' to 4' from the mean high water contour within the basin, and 3' to 8' from the mean high water contour in Broad Creek. The debris laden bottom along the shoreline of the creek dictates the distance waterward for installation of the bulkhead. There are to be docks constructed along the landward (or west) end and the south side of the basin. The dimensions on these are proposed at 28' x 6' and 70' x 6', respectively. There are three mooring pilings associated with this structure, which can accommodate 2 to 3 vessels, depending on size. The applicant wishes only to use the basin to store a boat during prolonged periods on unuse, and as a safe harbor during storm events. There is another pier and dock proposed into Broad Creek. The pier is proposed at 24' x 8', connecting to a dock, 24' x 8', terminating in -2' mean low water. The structure is situated greater than 15' from each adjacent riparian corridor. All of the above described development is intended for private, single family use. 10. ANTICIPATED IMPACTS The project as proposed would require the removal of 880 square feet of regularly flooded coastal marsh and 50 square feet of irregularly flooded coastal marsh. The dredging would remove approximately 650 cubic yards of shallow bottom habitat from an area of approximately 7052 square feet. Approximately one half of this area was created from high ground, and most has been excavated at least once before, probably in the late 1960's or early 1970's. Approximately 50 square feet of regularly flooded marsh and 150 square feet of irregularly flooded marsh will be filled and removed from jurisdiction with the installation of the bulkhead. The filling of the basin requires the loss of approximately 1131 square feet of shallow bottom originally created from high ground. The proposed high ground disturbance due to the installation of tie backs for the bulkhead, and the temporary spoil disposal, is 5535 square feet; in reality, this will probably be larger due to the need for more spoil disposal area. The constructiori of the docks will incorporate 972 square feet of Public Trust Area, 588 square feet of this being within the created basin. The pier into Broad Creek is larger than the standard 6' width, and while not shading coastal marsh, may create an unnecessary shading of shallow bottom habitat.
