Dear Mr. Ganjghsani:
You have our approval, in accordance with the attached conditions, to temporarily impact 1.95 acres and
permanently fill in 0.48 acres of wetlands or waters for the purpose of sewer line at College Lakes Outfall, as
you described in your application dated November 3, 1997. After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Number 3101. This Certification allows you
to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. In addition, you should get
any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations.
Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed i-., the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written v
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The purpose of this letter is to request a Regional General Permit 0049 or Nationwide Permit 12, and a
Section 401 Water Quality Certification for the projects known as The College Lakes Outfall. The
project, owned by The City of Fayetteville, is located in Cumberland County, NC. The project site is
shown on the enclosed maps.
The proposed activity is intended to support existing residential development and does not necessarily
facilitate additional development.
It will be necessary to temporarily impact 1.95 acres (see maps) of jurisdictional wetlands above
headwaters for the placement of the proposed outfall line. Permanent impacts, those associated with
maintained right -of -way do not exceed 1.00 acres. Wetlands can be loosely classified as bottomland
forested, emergent marsh and disturbed (drained) pond bottom wetland types. See the enclosed plans for
locations and sizes of wetlands that are to be impacted Impacts are shown in detail on attached maps and
grade plans.
The proposed corridor was evaluated for the presence of protected species and none were encountered.
The project is in the vicinity of many colonies of the protected Red - Cockaded Woodpecker; no impact is
anticipated We have had informal consultation with the US Fish and Wildlife Service (See attached) and
concur with their request that new;sewer and development projects that rely on this line should have
independent evaluations for the RCW. We believe that the Corps can track these requests and condition
the issued permit appropriately.
The proposed sewer is located approximately at the intersection of high -ground and wetlands. Wetlands
temporarily impacted by the proposed activity will be allowed to re- vegetate with woody species and
impact areas will be seeded with a wetland seed mixture. The proposed action impacts hardwood
wetlands and avoids the adjacent upland pine community.

RE: Proposed Gravity Sewerline Serving Areas of Fayetteville, NC
near Colonies of Red - cockaded Woodpeckers.
Dear Kim:
The City of Fayetteville proposes to provide sanitary sewer service to areas identified on the
attached map. The sewer utility will be installed within the drainage as approximately shown on the
map. The proposed line will be installed through wetlands and will be covered under Nationwide
Permit 12. The line will conform to conditions of the Nationwide Permit and the Water Quality
Certification for this type of work.
Recent environmental work in the project vicinity has identified active woodpecker colonies. The
attached map illustrates the locations of these colonies. No colony is proposed to be directly
impacted by the sewer route. The proposed route lies in areas classifies as headwaters forests and
are dominated by deciduous shrubs and trees. We propose to survey the sewer corridor for the
presence. of abandoned and active cavity trees and other federally protected species known to occur
in Cumberland County.
The sewershed is almost entirely developed. Lands that are not developed are owned by King's
Grant Golf Course and other private groups. The King's Grant property currently has restrictive
covenants on its properties to protect the red - cockaded woodpecker; therefore no impact to the
woodpecker is anticipated. Other private lands will likely require a Nationwide Permit 12 to
connect to the sewerline; the action would then be reviewed by the Corps of Engineers. These
other lands would likely require additional wetland permits for their development.
We believe that no adverse impacts to the red - cockaded woodpecker will result from this project
and wish to get your concurrence. Please call or write If the Service requires more information to
make their determination.
