Preston Howard, Jr., P.E., Director APPROVAL of 401 Water Quality Certification Mr. Anthony Nelson Division of Marine Fisheries 3441 Arendell Street Morehead City, NC 28557 Dear Mr. Nelson: A674 �EHNR November 6, 1997 Carteret County WQC 401 Project #970925 You have our approval, in accordance with the attached conditions, to place fill material in 0.03 acres of wetlands or waters for the purpose of repairing a building and bulkhead, near the community of South River on SR 1319 near Big Creek, as you described in your application dated October 17, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. A Department of the Army permit will not be granted until the certification has been obtained or waived. According to our administrative regulations, 60 days is reasonable for State action. PROJECT SUMMARY: The applicant proposes to demolish an existing building, replace 130' of an old wooden bulkhead with steel sheetpile, construct a 130' -wide loading ramp, replace old existing pier with a 5' X 50' pier, replace a 50' deteriorating breakwater, and install 3 six -pile mooring dolphins. FIELD INVESTIGATION REPORT: NORTH CAROLINA DIVISION OF MARINE FISHERIES /CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The North Carolina Division of Marine Fisheries owns a 5.7 -acre tract of land off a gravel road, at the end of SR 1319, near the Community of South River, adjacent Big Creek on South River, in Carteret County. The project site is located at the mouth of Big Creek almost on the point that extends out into South River. A delapidated 50' X 100' concrete building with a severely damaged bulkhead, dock and breakwater currently exist on the site. A typical "rural" marl parking area is landward of the existing building. The majority of the tract is high ground but there are coastal wetlands that border the creek to the northeast and southwest. The high ground landward of the building is currently being used as a staging area for the reef program. A pine plantation exist just downstream of the property, while the tract immediately upstream is characterized by an intertidal marsh with an adjacent manmade channel and basin. Prevailing northeast winds have caused severe damage to the bulkhead, pier and breakwater. Water depths at the project site in front of the existing bulkhead average -10 feet below MSL. Although the upper reaches of Big Creek is a Primary Nursery Area, the area at the mouth is not. Big Creek is closed to shellfishing along this section of the creek. However, South River adjacent to the project site is open. Project Description * According to the applicant, the purpose of the project is to replace the damaged existing facilities which would allow the Division to use the site as a loading facility for the Fish Hatchery Program. Specifically, the applicant proposes to demolish the existing 50' X 100' building, disposing of the material at an offsite location. The applicant proposes to construct a 130' -wide stone loading ramp that extends waterward approximately 7' beyond the existing bulkhead. Limited excavation necessary to create a ramp at a 2.5 to 12 slope would be undertaken. The spoil, material would be stored on the high ground approximately 200' from the MHW. Class `B" erosion control stone would be used and a corrugated metal sheet pile coffer dam would hold the stone in place. The steel sheet pile would be driven down to the mud line. The high ground section of the loading ramp would be comprised of 6" ABC stone. The applicant also proposes to replace the damaged bulkhead. Approximately 175' of steel sheet pile bulkhead would be constructed. It appears that 85' of the bulkhead would serve as wing walls for the sides of the stone loading ramp. That section of the bulkhead fronting the creek would extend an average of 2' waterward of the old alignment. A 2' concrete cap would be installed on top of the sheet pile bulkhead. The applicant also proposes to reconstruct a pier at the north end of the site. FIELD INVESTIGATION REPORT: NORTH CAROLINA DIVISION OF MARINE FISHERIES /CARTERET COUNTY PAGE #3 It would measure 5' wide X 50' long. Along the downstream ;side of the pier pilings, a 50' -vinyl sheet pile breakwater would be attached. Finally, the applicant proposes to install three 6 -pile mooring dolphins. One each is proposed along the upstream and downstream ends of the loading ramp, about 75' from the end of the ramp. The third dolphin is proposed in the middle of the ramp at the waterward end. Anticipated Impacts The excavation and ultimately filling (i.e. stone) for the 130' -wide loading ramp, which extends an average of 7' beyond MHW, would remove approximately 980 fe of Public Trust and Estuarine Waters. During construction of the ramp, approximately 300 yds3 of material would be excavated below MHW and another 900 yds3 of high ground. Installation of the bulkhead, which extends beyond MHW an average of 2', would remove another 180 fe of Public Trust and Estuarine Waters. Disturbance within the Estuarine Shoreline during demolition of the building, for installation of the bulkhead tiebacks, and for the loading ramp would impact approximately 9,020 fe. Approximately 6,000 ftz of that amount would be impervious or a 1,000 fe increase in impervious coverage. According to the applicant, another 10,000 ft2 of high ground, would be temporarily impacted during spoil deposition. The construction of the 5' X 50' pier and 50' -long breakwater would shade and usurp approximately 300 fe of Public Trust Areas and Estuarine Waters. Assuming the created basin area is defined by the two outer dolphin clusters, another 13,400 ff of Public Trust Areas would be enveloped. Installation of the 50' breakwater should not negatively impact water quality, but should create a less turbulent basin area. Excavation associated with the loading ramp as well as installation of the bulkhead would probably create short-term, localized turbidity problems. However appropriate use of turbidity curtains should minimize any negative impacts to aquatic resources. M.
