You have our approval, in accordance with the attached conditions, to place fill material and dredge 870
square feet of wetlands or waters for the purpose of enlarging an existing boat basin and constructing piers at
507 Bay View Drive, Harkers Island, as you described in your application dated 8 July 1997. After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification Number
3112. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and
Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification. Applicant is required to modify the
marina design to have rounded corners. DWQ shall be copied on the final basin design before construction
begins. This Certification replaces one issued on 18 August 1997.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

8. PROJECT SUMMARY: The applicant is proposing to enlarge an existing boat basin and construct and
2 piers.

9. NARRATIVE DESCRIPTION: The applicants property consists of an approximately 4
acre tract of land located at 507 Bayview Drive and adjacent to Eastmouth Bay, in the
community of Harkers Island, Carteret County. An existing "mosquito ditch" dissects
the property and provides navigation from an existing boat basin to the waters of
Eastmouth Bay. The property is jointly owned by Mr. Charles M. Brooks and his son
Charles B. Brooks. In 1987 Messrs. Brooks received Major Permit #237 -87 which
authorized the maintaince excavation of the existing man-made mosquito ditch and the
excavation of a new boat basin (± 50' wide x 100' long) located in high ground and in
"404" wetlands. The basin is located approximately 600' from the waters of Eastmouth
Bay. The south and east side of the basin have been bulkheaded with concrete sheet pile
material. The applicant recently removed the bulkhead on the south side of the inland
basin to allow for the maintenance excavation of the basin. A boat ramp is installed on
the west side of the basin. Waters of Eastmouth Bay and the basin are open to the
harvesting of shellfish.
The applicant is now proposing to expand the basin by a length of 64' x a width of 20' .
The shoreline of this new area would be bulkhead and 2 docks are proposed to be
constructed parallel to the north and south sides of the basin. The pier on the north side
of the basin would be located over Coastal Wetlands and "404" wetlands while the dock
on the south side would be located over high ground. Both docks would terminate at the
waters edge of the basin.
10. ANTICIPATED EMPACTS: The proposed project would result in the excavation of
approximately 1,200 sq.ft. of high ground area with ±280 cubic yards of sandy material
being excavated. The applicant is proposing to place a concrete sheet pile bulkhead in
high ground then excavate the basin to a depth of -2.5 at MLW. The applicant was
issued CAMA Permit ( #237 -87) which limited the depth of the basin to a - 2' at MLW.
The basin would be excavated by a dragline or excavator and the spoil material trucked
to a high ground disposal area. The applicant is proposing to round the corners of the
new basin in an effort to minimize stagnant areas as recommended by Mr. Jim Gregson
with the NC Division of Water Quality. A dock measuring 55' long x 5' wide would
be built on the north side of the basin. This would shade approx. 275 sq. ft of Coastal
Wetlands which is vegetated mainly by Spartina patens. A dock measuring 75' long x 5'
wide would be constructed over high ground on the south side of the basin. Short term
increases in turbidity would be expected during the excavation of the expansion of the
high ground basin and the installing of the pilings for the 2 docks. The docks would be
greater than 15' from both riparian property lines.

Per your fax of April 10, 1997 and our subsequent site visit, it is my understanding that
Mr. Charles Brooks proposes to expand his existing highground basin by removing approximately
75' X 20' X V of material from highground, reconstructing a bulkhead and constructing 75' of
dock on the expanded (south) side of the basin. The basin is located on the northeast side of
Harkers Island on East Mouth Bay.
After my initial review of Mr. Brooks' project I indicated that the Division of Water
Quality may recommend that Mr. Brooks demonstrate that the average summer basin dissolved
oxygen will meet Water Quality Standards (greater than or equal to 5mg /1 or background'levels).
This would need to be accomplished through computer modeling, ambient sampling or both. The
Division's concern in this case being the fact that the existing basin is not located near an inlet or
in an area with high tidal amplitude and the fact that it has other design features which tend to
restrict flushing. Probably the most restricting feature in this case is the basin's two segment
design, i.e., long narrow entrance channel with a wider basin. After further review and
conversations with our Technical Services Group in Raleigh, it was determined that if existing
water depths in the basin and entrance channel are not increased, running a computer model on
a 20' X 75' basin expansion would probably not indicate a significant drop in average summer
basin dissolved oxygen. Therefor, during the CAMA Permit review process, this Office would
not recommend computer modeling of basin dissolved oxygen. It is recommended, however, that
design features which will minimize stagnant areas, such as using rounded corners be considered
in the final project design.

prints or other larger plats are acceptable only if an

Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Enclosed is the application of Charles B. Brooks and Charles M. Brooks
for Department of the Army authorization and a State Water Quality
Certification to enlarge an existing basin by a length of 64 feet and a width
of 20 feet bulkheading the shoreline and constructing two private piers 5 feet
in width, one 60 feet long and the other 65 feet long terminating at the
waters edge of the basin in an existing channel off East Mouth Bay, Harkers
Island, Carteret County, North Carolina. Your receipt of this letter verifies
your acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by October 15, 1997, the District Engineer will deem that
waiver has occurred.

9. NARRATIVE D SCRTPTION: The applicants property consists of an approximately 4
acre tract of land located at 507 Bayview Drive and adjacent to Eastmouth Bay, in the
community of Harkers Island, Carteret County. An existing "mosquito ditch" dissects
the property and provides navigation from an existing boat basin to the waters of
Eastmouth Bay. The property is jointly owned by Mr. Charles M. Brooks and his son
Charles B. Brooks. In 1987 Messrs. Brooks received Major Permit #237 -87 which
authorized the maintaince excavation of the existing man-made mosquito ditch and the
excavation of a new boat basin (f 50' wide x 100' long) located in high ground and in
"404" wetlands. The basin is located approximately 600' from the waters of Eastmouth
Bay. The south and east side of the basin have been bulkheaded with concrete sheet pile
material. The applicant recently removed the bulkhead on the south side of the inland
basin to allow for the maintenance excavation of the basin. A boat ramp is installed on
the west side of the basin. Waters of Eastmouth Bay and the basin are open to the
harvesting of shellfish.
The applicant is now proposing to expand the basin by a length of 64' x a width of 20' .
The shoreline of this new area would be bulkhead and 2 docks are proposed to be
constructed parallel to the north and south sides of the basin. The pier on the north side
of the basin would be located over Coastal Wetlands and "404" wetlands while the dock
on the south side would be located over high ground. Both docks would terminate at the
waters edge of the basin.
10. ANTICIPATED EMPACTS: The proposed project would result in the excavation of
approximately 1,200 sq.ft. of high ground area with ±280 cubic yards of sandy material
being excavated. The applicant is proposing to place a concrete sheet pile bulkhead in
high ground then excavate the basin to a depth of -2.5 at MLW. The applicant was
issued CAMA Permit (#237 -87) which limited the depth of the basin to a - 2' at MLW.
The basin would be excavated by a dragline or excavator and the spoil material trucked
to a high ground disposal area. The applicant is proposing to round the corners of the
new basin in an effort to minimize stagnant areas as recommended by Mr. Jim Gregson
with the NC Division of Water Quality. A dock measuring 55' long x 5' wide would
be built on the north side of the basin. This would shade approx. 275 sq. ft of Coastal
Wetlands which is vegetated mainly by Spartina patens. A dock measuring 75' long x 5'
wide would be constructed over high ground on the south side of the basin. Short term
increases in turbidity would be expected during the excavation of the expansion of the
high ground basin and the installing of the pilings for the 2 docks. The docks would be
greater than 15' from both riparian property lines.

Per your fax of April 10, 1997 and our subsequent site visit, it is my understanding that
Mr. Charles Brooks proposes to expand his existvig highground basin by removing approximately
75' X 20' X 6' of material from highground, reconstructing a bulkhead and constructing 75' of
dock on the expanded (south) side of the basin. The basin is located on the northeast side of
Harkers Island on East Mouth Bay.
After my initial review of Mr. Brooks' project I indicated that the Division of Water
Quality may recommend that Mr. Brooks demonstrate that the average summer basin dissolved
oxygen will meet Water Quality Standards (greater than or equal to 5mg /1 or background levels).
This would need to be accomplished through computer modeling, ambient sampling or both. The
Division's concern in this case being the fact that the existing basin is not located near an inlet or
in an area with high tidal amplitude and the fact that it has other design features which tend to
restrict flushing. Probably the most restricting feature in this case is the basin's two segment
design, i.e., long narrow entrance channel with a wider basin. After further review and
conversations with our Technical Services Group in Raleigh, it was determined that if existing
water depths in the basin and entrance channel are not increased, running a computer model on
a 20' X 75' basin expansion would probably not indicate a significant drop in average summer
basin dissolved oxygen. Therefor, during the CAMA Permit review process, this Office would
not recommend computer modeling of basin dissolved oxygen. It is recommended, however, that
design features which will minimize stagnant areas, such as using rounded comers be considered
in the final project design.

To determine water quality in existing basin, modeling and testing
was requested by Coastal Management of Morehead City.
To accommodate the request by Coastal Management, the CHARLES
BROOKS PROJECT was placed on hold.
Mr. Jim Grayson with the Division of Water Quality of Wilmington
determined there was no further need of modeling or testing done.
He suggested the corners of the harbor be placed at 45 degree
angles to create better water circulation.
We propose to resubmit our drawings and application for the
CHARLES BROOKS PROJECT implementing suggestion by Mr. Jim Grayson
to place corners of harbor at 45 degree angles.

NOT WETLAND EXCAVATION. DUE TO THE ONSITE VISIT OF LAMA,
DIVISION OF WATER QUALITY, AND MARINE FISHERIES, THE FIELD
OFFICERS" SUGGESTIONS HAVE BEEN CONSIDERED AND ADOPTED IN
THIS PROPOSAL.
THE MODIFICATIONS INCLUDE A BASIN WITH ROUNDED CORNERS AND
THE ENTRANCE TO THE EXISTING CHANNEL HAVING AN OBTUSE ANGLE.
THESE MODIFICATIONS WILL EASE LOSS OF WETLANDS AND INCREASE
BETTER WATER CIRCULATION.
TO REDUCE ADVERSE IMPACTS, THE MATERIAL WILL BE EXCAVATED BY
HYDRAULIC CLAM SHELL METHOD AND THE SPOILS LOADED DIRECTLY
INTO TRUCKS ON HIGH GROUND AND THE SPOIL TRANSPORTED TO DISPOSAL
SITES. THIS METHOD PROVIDES NO EXCAVATION OR DISPOSAL OVER
WETLANDS.

On February 11, 1991, we renewed general permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of.North Carolina.
A review of your application received August 6, 1997, for Department of
the Army authorization to enlarge an existing basin by a length of 64 feet and
a width of 20 feet, bulkheading the shoreline and constructing' two private
piers 5 feet in width, one 60 feet long and the other 65 feet long terminating
at the waters edge of the basin, located in an existing channel off Eastmouth
Bay, Harkers Island, Carteret County, North Carolina, indicates it to be a
candidate for Federal authorization under this general permit. Accordingly,
the administrative processing of your application will be accomplished by the
North Carolina Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.

for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State - Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.

b. It is necessary for you to have taken all appropriate and practical
steps to reduce wetland losses. Please show all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to reduce adverse impacts.
C. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please show your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.
This information is essential to our expeditious processing of your
application and it should be forwarded to us by August 29, 1997. Also, a copy
of this information must be sent to the North ina ivisi.on of
Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the
Clean Water Act.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199708622.

RE: CAMA /Dredge & Fill Review Comments
The subject applicant is Charles B. & Charles M. Brooks. In order
to expand the existing boat basin, Jim Gregson recommended that
the expanded basin have rounded corners to deter water stagnation
and potential D.O. violations. This office concurs. In addition,
on the submitted site plan sketches it appears that the
furthermost canalward extension of the basin would constrict and
discourage water exchange with the canal. This portion of the
basin should form an obtuse angle (pink highlight) rather than
the acute one depicted. This would likely promote better water
circulation /exchange. Please see the attachment for
clarification.
