Main Street Havelock, NC 28532 Dear Sirs: You have our approval, in accordance with the attached conditions, to place fill material in 1,300 square feet of wetlands for the purpose of improving an access road, boat ramp and walkway for a community dock at Tucker Creek, as you described in your application dated 7 July 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. The site is accessible by way of Highway 70 to Sermon's Boulevard between Havelock and New Bern, in the #6 Township of Craven County. There is an existing single family residential development under construction on the property, typified by 120 1h acre lots. There are individual well and septic systems being installed to service these residences. According to the applicant, these have received Health Department approval. The tract averages 20' above normal water level in elevation, and supports Tulip Poplar, Sassafras, maples, oaks, pines, Dogwood, Black Cherry, and Sweet Gum, with an understory of Wax Myrtle and blueberry. There are delineated Section 404 Wetlands on the site (survey approved by the US Army Corps of Engineers on 6/19/96 on file). On the north side, adjacent to Tucker's Creek where the development addressed by this application is proposed, these wetlands are predominantly swamp forest in nature. Species present include with Sweet Gum, Black Gum, Sweet Bay, Wax Myrtle, Royal Fern, Red Maple, Swamp Rose, and Water Arum. At the creek edge, there is a narrow fringe of coastal wetlands consisting of Typha angustifolia and Scirns �= The opposite creek bank is characterized by a wide fringe of Juncus roemerianus. The open water of Tucker's Creek is approximately 75' to 80' across at the project site. There is an existing tin shed with attached dilapidated dock over the water in Tucker's Creek that is scheduled for removal. An 8' wide access road extends from high ground through the ± 120' border of wooded swamp to this shed and an adjacent area used for small boat launching. On either side of this road there is an immediate drop to the wooded swamp system and surface water. The Craven County Land Use Plan classifies the area as Urban Transitional, with those areas lying within CAMA Areas of Environmental Concern (AEC) classified as Conservation. In this case, the waters of Tucker's Creek are inland waters, and consequently the CAMA AEC's consist of the coastal wetland fringe and the Public Trust Area. Tucker's Creek is designated Inland Primary Nursery Area by the N. C. Wildlife Resource Commission. The Division of Water Quality has classified the waters of Tucker's Creek SC swamp, with the additional protection afforded by the Nutrient Sensitive Waters designation. According to the Division of Marine Fisheries, there is no shellfish resource at this location. There is no indication of any submerged aquatic vegetation within the immediate vicinity of the project. There is no documentation of any archeologically significant site on the south side of Tucker's Creek. A Sedimentation /Erosion Control Plan and a Stormwater Plan have been submitted to the appropriate `J agencies. The proposal is for the construction of a parking area, expanded roadway, improved boat ramp, and dock for use by the community under development. The parking area is proposed at 60' x 60' on the high ground area at the origination of the existing 8' wide roadway. The applicant is proposing to lay marl for this area, and grade it away from the surface waters. The roadway will then be widened to 16' and paved across t 25' of high ground, and f 125' of the above described wooded swamp system. At the terminus of the roadway, there is a 15' x 20' concrete boat ramp proposed, terminating in -3' of water. This feature overlaps onto the area the applicant has called roadway by 10'; hence the additional impacts to be incurred are 10' x 15'. The area within which the ramp is proposed is mostly non - vegetated, but has the same characteristics and elevation of the adjacent shoreline vegetated with a coastal wetland fringe. It appears this area has not lent itself to support the marsh because of the stress to the system by vehicular t � use. There is an area that has begun to support Scilpus Vg. that has grown to approximately 6' x 8' within the footprint of the proposed ramp. One to two cubic yards of concrete will be needed for this feature. There is a 4' x 20' courtesy dock proposed on the east side of the ramp to aid in launching, and a 4' x 12' walkway across the wooded swamp to access the ramp on the west side. Extending west from the ramp there is a 120' x 4' dock proposed. This is proposed for the temporary mooring of the resident's boats as they are launched. There is no permanent dockage proposed. The dock as proposed would lie along the creek edge, immediately waterward of the wetlands. There is approximately -3.2' to -4.2' of available water. All emergent structures are located >50 from the adjacent riparian corridors; all proposed development is located within the common area for the development. I ; a M 1 WN M D1 ka 101' As proposed, the parking area and maintenance portion of the roadway for this project would cause to be graded and filled approximately 5000 square feet of high ground. Approximately 50 square feet of coastal wetlands are proposed to be filled with the ramp, as well as ±250 square feet of non - vegetated coastal wetland area. The road expansion will remove from jurisdiction ±1000 square feet of wooded swamp. Approximately 88 square feet of wooded swamp will be incorporated with an elevated walkway and courtesy dock. The dock and waterward portion of the courtesy dock will incorporate approximately 560 square feet of open water. The project will allow for an increase in boating activity in the upper portion of Tucker's Creek. Minimal turbidity impacts can be expected during construction. SUBMITTED BY: T.
