Box 280 Marshallberg, NC 28553 Dear Mr. Ramsey: You have our approval, in accordance with the attached conditions and those listed below, to dredge 4,200 square feet of water and 6115,355 square feet of water for the purpose of removing existing docks -and building new ones at Jarrett Bay Boatworks at Jarrett Bay Boatworks, as you described in your application dated 13 May 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your protect, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. A permanent seweage pumpout facility shall be installed and maintained throughout the life of the marina and signs shall be installed to indicate its location. The applicant shall contact the Carteret County Health Dept. concerning the existing septic tank's suitability for this site. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919 - 733 -1786. After careful consideration of your comments and our rules, DWQ issued a 401 Water Quality Certification for this project on 1 August 1997 (see attached). An important condition was added to the Certification to require a properly designed and maintained sewage pumpout facility at the site. Many of the comments we received related to public access in the Marshallberg Harbor. The Certification decision made by the Division of Water Quality relates to water quality and aquatic life issues. Issues related to public access of water are beyond the scope of the Water Quality certification and are more properly the regulatory interest of the N.C. Division of Coastal Management. I will send copies of all comments we have received to Mr. John Parker of the N.C. Division of Coastal Management for his review. Thank you for your interest in water quality. Box 27687 ', �•.,, Raleigh, N.C. 27611 -7687 Mr. Dorney: I am writing in regards to Mr. Randy Ramsey's / Jarrett Bay Boat Works application for a major permit in the Marshallberg harbor. As a life -time member of this community, I would like to state my complete and total support of this project. In my opinion, the clean up and organization of the harbor is long over due. I applaud Mr. Ramsey's efforts, dreams, and aspirations. He is trying to improve a business situation, but has tried very hard to accommodate the local community in this process. Many people in our community have long wished for someone to take the interest and have the resources to take such action. The community and environment can benefit greatly. Mr. Ramsey's proposal would be a drastic improvement for local commercial fishermen, community members, visitors, and any one coming into the area, in that the harbor would be meeting government regulations for safety, providing safe dockage facilities, including electricity, water, and maintenance to these facilities. All of these would be a great improvement and asset. Mr. Ramsey has endeavored to work with the local community and has met with much resistance from some individuals who have used and abused this facility for years. One can simply come and observe to understand the impact some of the local forces have had on this area. Change is often resisted when individuals think they will have to give up something they have been accustom to having at the expense of others. Many of us would love to see this area be cleaned up and be made a safe environment for all those concerned. I would like to thank Mr. Ramsey, as the landowner, for taking the initiative and wanting to improve the area. This area has been ignored and monopolized by a few for far too long. Thank you for the opportunity to address this matter. I hope Mr. Ramsey's proposal is considered carefully and all due haste is made in bringing it to fruition for the good of all those involved. Box 27687 Raleigh, N.C. 27611 -7687 Dear Mr. Dorney: FC scFti1 Fs I am writing this letter in regards to the application for a major permit project in the Marshallberg harbor by Mr. Randy Ramsey. I would like to state my complete and total support of this project. In my opinion, the proposals which Mr. Ramsey has applied for would be a great improvement to the harbor facilities at Marshallberg. The community would benefit greatly, from the stand point of the harbor being cleaned up, the shoreline being made stable, new slips being created, better organization of existing area, water quality being improved and monitored more closely, and overall appearance and functionality of the harbor. Mr. Ramsey's vision of the harbor area is one that, if taken to completion, would instill a sense of pride in the harbor. Visitors to the area would see a neat and well maintained harbor facility, instead of the area in its present condition, with years of accumulation of trash, including items abounding along the shore such as old appliances, discarded commercial fishing equipment, engines, tires, broken pilings, etc., etc. From appearance only, immediate results would be realized, and drastic improvement over its present state would make the harbor a place which one could take friends and visitors to with pride instead of embarrassment, which is now the case. It is well past due for the ram - shackle, run down, and unsafe docks which now exist in the harbor, most of which were illegally built over the years, be cleaned out and put back in proper fashion by the property owner of the land adjoining the harbor project, that owner in this case being Mr. Ramsey. Mr. Ramsey's proposal would have immediate benefits to the local fishermen and others now moored in the harbor, in that more and better organized slips would be created. The outcry of locals claiming being "run out" of the harbor is simply not founded, since Mr. Ramsey has stated privately and publicly that those who will be co- operative with his plans and vision for the harbor will be offered docks and slips at a very reasonable cost. This proposal would enable local mariners to remain in the facility very much like they are now, except with a clean, safe, well thought out and well maintained facility. Basically these folks have taken a "free ride" in the harbor for years, having absolutely no responsibility or accountability for the state of conditions around the harbor. Further, many of these folks have overstepped the bounds of common decency and courtesy, until they have reached a state of running amuck around the harbor, and turning the entire area into an eyesore for the community with their ever increasing levels of trash and pollution. It is well past time for control of this area to be put back in proper place, that being the property owner, in this case being Mr. Ramsey. It is fortunate that the property owner, who may utilize this property in any manner he sees fit, has such noble and good intentions for the use of his property. He is certainly going out of his way to make accommodations and a fine facility available to local community members, many of whom are completely unappreciative of his efforts, and in fact are operating continually to generate ill -will and uncooperative spirits among the community. It is a shame that such narrow - minded and ignorant attitudes are allowed to have such a negative impact on a part of our community which has the potential to be such a great and positive asset. Mr. Ramsey's business, Jarrett Bay Boat Works, employs approximately 40 to 50 people and is responsible for generating millions of dollars of income in the local area each year. This business needs the improvements to the harbor in order to perpetuate growth and success. Mr. Ramsey's proposal enables the needs of this vital business to be met, as well as the needs of the community. The pollution and trash problems will be resolved. The environment will be greatly improved, both in an environmental sense and in a social sense. It is well past time that a project of this nature be implemented in the harbor. I will close by again simply restating my complete and total support of the proposals made by Mr. Ramsey in his application, and say God -speed in making his proposals come to completion as soon as possible. In the past eight years I have had many business dealings with Randy Ramsey s. I find them to be very professional and honest in their practices. In a ten year period they have grown from half a dozen people in a fallen down shed to a premier custom boat builder on the east coast of the United States. Now employing sixty people directly, and numerous subcontractors in eastern Carteret County. This has taken a tremendous amount of foresight and fortitude to last through some hard times in the boating industry. What they now propose for the Marshallberg Harbor is a continuation of this foresight, and an undertaking of a project that the county has not had the courage to assume. The current arrangement in the harbor is squatter's rights with no long term or short term responsibility for property management or environmental responsibility. The U.S. Coast Guard has told Jarrett Bay this is their land and they are to be held accountable. Jarrett Bay and the other property owners seem to have no control over their deeded property in the current state of confusion. NARRATIVE DE ION: The applicant's property is a t 4.15 acre tract(s) of land located at the end of SR 1347 in the community of Marshallberg. The majority of the property is bordered on the south by the Straits and surrounds the head of the Marshallberg Harbor. The majority of the high ground property has been developed into a commercial boat yard and boat building facility known as Jarrett's Bay Boat Works. The applicant primarily builds large charter boats and yachts in the +50' range and was previously located in Williston before outgrowing that facility in 1991. The applicant has received both CAMA major and minor Permits over the past 6 years authorizing the development of this facility. One of the permits, LAMA Major Permit No. 150 -91, authorized the excavation of a boat basin and the construction of four boat slips in the Straits and the installation of a travel lift in the Marshallberg Harbor. Marshallberg Harbor was excavated in the 1950's by the Federal government and today remains a federally authorized project. The harbor connects to Sleepy Creek near its intersection with the Straits. Historically, the residents of Marshallberg and nearby communities have constructed and maintained docking facilities in the harbor. For the most part, the boats mooring in this area are commercial fishing boats ranging from skiffs to ± 40' vessels. It is estimated that ± 60 boats moor in the harbor. The shoreline of the harbor is partially stabilized with bulkheads, riprap and various amounts of trash and debris. There are some areas which are vegetated with varying amounts of coastal and 404 wetlands. While there is some signs of bank erosion, most has occurred gradually over the years. The harbor is fairly deep (6 to 8' mean low water) and, is classified as SA waters. The harbor is closed to the harvesting of shellfish. The applicant is proposing to develop the shoreline area of his property which is adjacent to the Marshallberg Harbor into a commercial docking /marina facility. The existing docks used by area watermen will first be removed and riprap will be placed along the shoreline bank. The total length of shoreline to be riprap is f 700` and the Riprap will extend 6' beyond the mean high water line expect in the location of an existing ±165 linear foot bulkhead at the head of the basin. Here, the riprap will extend +13' below the mean high water line. The shoreline area is proposed to be excavated and sloped in order to provide a proper angle for the riprap placement. The applicant has indicated that ±350 of silty material would be excavated below the mean high water line to facilitate the riprap placement. The marina development will include the placement of 12 finger piers and one larger dock (with adjacent mooring pilings) into the harbor in order to accommodate 24 boats. The finger piers will be 4' in width and will vary in length from t 12 to 40'. The waterward extensions of the finger piers and mooring into the harbor will range from ± 24 to 40' in length. Fourteen of the spaces will be 20' wide while the remaining 10 slips will be 15' wide. At the head of the basin and adjacent to SR 1347, a 70' long x 4' wide dock is also proposed. The applicant has indicated that parking for the marina facility will be located in an area adjacent to SR 1347 and on an existing rock parking area within the Boatworks' compound. Presently, an unimproved portion of the area along SR 1347 is presently used for parking while the remainder is vegetated with grass, vines and bushes. A portion of the area will have to be filled in order to make it usable for a parking. The 11 new spaces along the road are not proposed to be improved with rock or gravel. The new parking area will be located within the Estuarine Shoreline AEC and would occupy an area of ±2,200 sq.ft. It is anticipated that the total land disturbance (filling and grading) associated with the parking area would be ± 4,400 sq.ft. 10. ANTICIPATED IMPACTS: The project as proposed will result in the excavation of approx. 4,200 sq.ft. of intertidal and shallow water habitat area with t 350 cu.yds. of silty material being removed. The placement of the riprap will result in the filling of f 5,355 sq.ft. of shallow water bottom area with the placement of f 518 cu.yds of broken concrete material below the mean high water line. The removal of the existing boat docks will displace a number of individuals who have historically moored their boats in the harbor. A recent site inspection of the harbor revealed 32 boats /mooring areas within the project area which would be eliminated. The 24 slip marina will extend into a federally authorized harbor and the US Army Corps of Engineers will need to determine what impacts will occur to the federal project. The majority of the marina slips will be wide enough (20') to allow for large boats to use the facility. It can be anticipated that these boats will have "heads" but there is no pump -out facility proposed or available in the immediate area. New parking areas will be provided along the road right of way and will be unimproved. It is not known if stormwater approval will be required by the Division of Water Quality. Since receiving the permit application, a number of individuals in the Marshallberg community have expressed concerns and opinions over the project involving such things as the public ownership of the harbor, validity of easements and deeds and the prescriptive use rights of the area by the public. Further evaluations and investigations of these issues will need to be undertaken before a permit decision is made. Plans submitted with the application show the proposed removal of docks and pilings, displacing mariners who have historically moored vessels, and the placement of riprap material along approximately 700 linear feet of shoreline. The riprap material is to extend six (6) feet waterward of the mean high water (MHW) elevation contour except adjacent to an existing 165- foot -long bulkhead at the head of the harbor. The riprap is to extend thirteen (13) feet waterward of MHW in front of the bulkhead. Excavation of silt below MHW, approximately 350 cubic yards, is to be accomplished to slope the shoreline for placement of the rip rap. All excavated material is to be placed and retained on high ground. Proposed dockage includes twelve (12) finger piers and one large dock with adjacent pilings to provide commercial slips for twenty -four (24) vessels. The finger piers are to be four feet in width and between twelve (12) and forty (40) feet long. Fourteen (14) of the slips are to be twenty (20) feet wide and ten (10) of the slips are to be fifteen (15) feet wide. At the head of the harbor, a 70- foot -long, 4- foot -wide dock is proposed. The applicant states that the purpose of the work is to improve the harbor and provide commercial dockage for charter and commercial fishing boats. Plans showing the work are included with this public notice. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register is the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision, whether to issue a permit, will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts that the proposed activity may have on the public interest requires a careful weighing of all those factors that become relevant in each particular case. The benefits that may be expected to accrue from the proposal must be balanced against its foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore decided by the outcome of the general 2 I balancing process. That decision should reflect the national concern for both protection and use of important resources. All factors that may be relevant to the proposal must be considered including the cumulative effects of it. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (according to Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water.. quality ,_energy..needs,..safety, food-and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer decides that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to decide whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and /or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). PROJECT SUMMARY: The applicant is proposing to remove existing docks and build new ones in their place to accommodate 24 boats. FIELD INVESTIGATION REPORT: RANDALL RAMSEY PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property is a ± 4.15 acre tract(s) of land located at the end of SR 1347 in the community of Marshallberg. The majority of the property is bordered on the south by the Straits and surrounds the head of the Marshallberg Harbor. The majority of the high ground property has been developed into a commercial boat yard and boat building facility known as Jarrett's Bay Boat Works. The applicant primarily builds large charter boats and yachts in the +50' range and was previously located in Williston before outgrowing that facility in 1991. The applicant has received both CAMA major and minor Permits over the past 6 years authorizing the development of this facility. One of the permits, CAMA Major Permit No. 150 -91, authorized the excavation of a boat basin and the construction of four boat slips in the Straits and the installation of a travel lift in the Marshallberg Harbor. Marshallberg Harbor was excavated in the 1950's by the Federal government and today remains a federally authorized project. The harbor connects to Sleepy Creek near its intersection with the Straits. Historically, the residents of Marshallberg and nearby communities have constructed and maintained docking facilities in the harbor. For the most part, the boats mooring in this area are commercial fishing boats ranging from skiffs to + 40' vessels. It is estimated that ± 60 boats moor in the harbor. The shoreline of the harbor is partially stabilized with bulkheads, riprap and various amounts of trash and debris. There are some areas which are vegetated with varying amounts of coastal and 404 wetlands. While there is some signs of bank erosion, most has occurred gradually over the years. The harbor is fairly deep (6 to 8' mean low water) and is classified as SA waters. The harbor is closed to the harvesting of shellfish. The applicant is proposing to develop the shoreline area of his property which is adjacent to the Marshallberg Harbor into a commercial docking /marina facility. The existing docks used by area watermen will first be removed and riprap will be placed along the shoreline bank. The total length of shoreline to be riprap is ± 700` and the Riprap will extend 6' beyond the mean high water line expect in the location of an existing ±165 linear foot bulkhead at the head of the basin. Here, the riprap will extend ±13' below the mean high water line. The shoreline area is proposed to be excavated and sloped in order to provide a proper angle for the riprap placement. The applicant has indicated that ±350 of silty 'material would be excavated below the mean high water line to facilitate the riprap placement. The marina development will include the placement of 12 finger piers and one larger dock (with adjacent mooring pilings) into the harbor in order to accommodate 24 boats. The finger piers will be 4' in width and will vary in length from ± 12 to 40'. The waterward extensions of the finger piers and mooring into the harbor will range from ± 24 to 40' in length. Fourteen of the spaces will be 20' wide while the remaining 10 slips will be 15' wide. At the head of the basin and adjacent to SR 1347, a 70' long x 4' wide dock is also proposed. The applicant has indicated that parking for the marina facility will be located in an area adjacent to SR 1347 and on an existing rock parking area within the Boatworks' compound. Presently, an unimproved portion of the area along SR 1347 is presently used for parking while the remainder is vegetated with grass, vines and bushes. A portion of the area will have to be filled in order to make it usable for a parking. The 11 new spaces along the road are not proposed to be improved with rock or gravel. The new parking area will be located within the Estuarine Shoreline AEC and would occupy an area of ±2,200 sq.ft. It is anticipated that the total land disturbance (filling and grading) associated with the parking area would be ± 4,400 sq.ft. 10. ANTICIPATED IMPACTS: The project as proposed will result in the excavation of approx. 4,200 sq.ft. of intertidal and shallow water habitat area with ± 350 cu.yds. of silty material being removed. The placement of the riprap will result in the filling of ± 5,355 sq.ft. of shallow water bottom area with the placement of ± 518 cu.yds of broken concrete material below the mean high water line. The removal of the existing boat docks will displace a number of individuals who have historically moored their boats in the harbor. A recent site inspection of the harbor revealed 32 boats /mooring areas within the project area which would be eliminated. The 24 slip marina will extend into a federally authorized harbor and the US Army Corps of Engineers will need to determine what impacts will occur to the federal project. The majority of the marina slips will be wide enough (20') to allow for large boats to use the facility. It can be anticipated that these boats will have "heads" but there is no pump -out facility proposed or available in the immediate area. New parking areas will be provided along the road right of way and will, be unimproved. It is not known if stormwater approval will be required by the Division of Water Quality. Since receiving the permit application, a number of individuals in the Marshallberg community have expressed concerns and opinions over the project involving such things as the public ownership of the harbor, validity of easements and deeds and the prescriptive use rights of the area by the public.
