PROJECT SUMMARY: The applicants propose to excavate an approximate 160' X 130' "basin" area around an existing dock, reconfigure the 25 existing slips, and add dockage for 8 personal water craft. FIELD INVESTIGATION REPORT: THE BLUFFS HOMEOWNERS ASSOCIATION, INC. /CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The Bluffs is a 44 -unit townhouse /condominium complex located off Highway 70 and South Shore Drive, in the Mansfield area, of Morehead City, in Carteret County. The specific project site is located at the waterward end of an existing pier on Bogue Sound, just west of Peletier Creek and east of the red daymarker #8 on the AIWW. The existing pier is approximately 573' long X 6' wide and includes a "T "- shaped platform that measures 65' long X 23' wide. A 16' X 16' gazebo is located on the east end of the platform. The entire pier structure was recently reconstructed following destruction by Hurricanes Bertha and Fran. Also authorized for reconstruction (but not rebuilt pending the outcome of this application) was an "L "- shaped finger dock on the east side of the main pier that measured about 110' in length and provided for sixteen boat slips. In addition, on the west side of the main pier a 65' dock was authorized for reconstruction (but was also not rebuilt pending the outcome of this application) and provided for another 5 slips. Finally two, smaller - finger docks located on the west side of the main pier were also authorized for reconstruction (but again not rebuilt pending the outcome of this application) and provided dockage for 4 additional boats. Overall, 25 slips have been authorized for reconstruction. The water depths in the area are very shallow and vary from -1.5' below MLW to -2.5' below MLW. According to the applicant's, workplat, controlling water depths waterward of the existing pier are -4.3' or greater. Again, according to the applicants' plats, the leading edge of the AIWW channel is approximately 155' from the location of the "existing" or authorized mooring pilings. The waters of Bogue Sound at the project site are "SA" and closed to shellfishing (the closure line appears to be in the immediate vicinity). Some SAVs were noted close to shore during my field visit, but the water was too turbid near the end of the dock to confirm/deny any presence in the proposed dredge area. The bottom is mostly sand with some mud. A copy of the pier 'rules and regulations enforced by the Homeowners Association is included as part of the application package. And rules #3 and #7 confirm why few boats are ever noticed at the existing pier at any one time. These two rules disallow overnight, live - aboard conditions at the marina, as well as long -term mooring of the boats when homeowners are not at the condominium. FIELD INVESTIGATION REPORT: THE BLUFFS HOMEOWNERS ASSOCIATION, INC. /CARTERET COUNTY PAGE #3 Project Description The applicants propose to use a clamshell on a barge and excavate an approximate 160' X 120' X -4' "basin" area adjacent their existing dock. Calculations taken from the plat indicate an area of impact around 20,200 ft. The applicants also propose to reconfigure the existing 25 slips. This would be accomplished by constructing a 4' X 125' finger dock off the west side of the main pier where ten 11' to 12' -wide slips would be located. Then at the end of the main pier platform, a 6' X 96' finger dock would be constructed where thirteen 12' to 14' -wide slips would be located. The final two slips would be located inside the west side of the existing platform. Consequently, the applicants will have create a marina "basin" area as defined by the two large finger docks. Also, the applicants propose to install 7 additional mooring pilings adjacent the east side of the existing pier to tie up personal water craft/jet skis, essentially creating eight small 8' slips. Anticipated Impacts Approximately 20,200 ft' of shallow water habitat would be altered as a result of the dredging of the "basin" area and approximately 1,500 yds3 of sandy material would be removed. Excavated material would .be placed off site on an approved high ground site. Short-term and localized increases in turbidity would also be expected to occur. The reconfiguration of the 25 slips would result in the increase in usurpation of Public Trust Areas (PTA) of approximately 5,320 ft. Essentially the "existing" or authorized docks /slips would usurp approximately 9,840 ft' of PTA and the new configuration would usurp 15,160 ft2 of PTA. The 8 new personal watercraft slips would usurp another 768 ft2 of PTA. A slight increase in the amount of shallow water bottom that would be shaded would also occur. The applicants in the past have demonstrated the ability to control and restrict unfavorable use of the docks. Their pier rules and regulations are thorough and very restrictive. M. The dock area is for the use and enjoyment of The Bluffs' resident boatownersl their families and guests. 2. The use of the dock is for pleasure and recreation onlyt and no commercial ventures of any kind shall be undertaken. 3. Boats may be docked at the pier only when the townhouse is occupied, and the owner can make a daily check of the boat. C. All boats must be moored within a designated boat slip. 5. Boatowners shall insure that their boat is safely moored with lines adequate for any weather condition, and they are solely responsible -for moving the boat to safe harbor when necessary. 6. All rowboats, canoesp small sailboats and dinghies should be stored ashore at night. 7. A boat berthed at the dock shall not be used as a residence, and the boat shall not be occupied for more than two nights in succession. 8. only ordinary, light maintenance shall be permitted on the boat at the dock. Boatowners shall keep the pier area clean and litter free, and nothing should be stored on the dock without prior permission from the Homeowners - Association. 10. Fishing from the dock is permitted, however, all bait should be cut on a cutting board and not on the pier. Be sure that all fishing residue is fully washed off from the pier before leaving the dock area. 11. No charcoaling or fires of any kind are permitted on the dock. 12.
