After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. PROJECT SUMMARY: The applicant is proposing to develop a 33 lot subdivision at a site located at the end of SR 1177 and adjacent to the Newport River and Crab Point Bay, in the Town of Morehead City. The project will involve roadway improvements, the construction of a bulkhead and the extension of sewer and water services to the site from North 20 St. C FIELD INVESTIGATION REPORT: BL AIl POINT, PHASE I PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property is a ± 267 acre tract of land located north of Morehead City between North 20th St. and the Newport River. The property also borders Crab Point Bay and Dill Creek and vehicular access to property is from the end of NCSR 1177. A significant portion of the property was formally the "Blair Farm" which had a large "farmhouse" and a concrete pier extending into the Newport River. This house was recently burned down by vandals. In the late 1960's and early 70's, this property and an adjacent tract of land was purchased in anticipation of a residential development. Extensive ditching was undertaken throughout the tract and a dirt roadway was installed between North 20th St. and SR 1177. A series of dead - end finger canals were excavated adjacent to the Newport River and landward of an earthen plug. The canals were never connection to the Newport River because federal authorization could not be obtained. In the early 1980's, the property was sold and a planned unit residential development was undertaken. The initial plans called for ± 600 residential units with several piers extending into the Newport River, however, only 7 condominium buildings and 1 dock with 13 slips were ever constructed. Wastewater from the condominium project (known as "The Haystacks ") is pumped and disposed at a spray irrigation site located ± 4,000 ft west of the units. A small portion of the tract of land (just south of the treatment plant) has also been used as a marsh mitigation site. Because of concerns about vandals, trespassing and liability, the previous land owners petitioned and received permission from the County and State to abandoned the end of SR 1177 at the entrance to the Haystacks. A locked gate prohibits vehicular traffic into the property. The southern portion of the abandoned road is bordered on both sides by a border of Coastal Wetlands. The roadway is still asphalted but the shoulders have not been properly maintained and areas of Coastal Wetlands have migrated onto portions of the roadway shoulder. The waters of the Newport River, Crab Point Bay and Dill Creek adjacent to the property are classified as SA waters and are closed to the harvesting of shellfish. The waters of Dill Creek are also classified as Primary Nursery Areas by the NC Marine Fisheries Commission. Wetland areas on the property have been delineated and an archeological site has been identified within the project area. The new property owners are proposing to continue to develop the property into a residential development. The first phase will be the subdivision of 43.8 acres of land adjacent to the Newport River and Crab Point Bay, just south of the Haystacks, into a 33 lot subdivision with a minimum lot size of .75 acres. Fifteen lots will front the Newport River and there will be 8 lots fronting Crab Point Bay. This property has been recently annexed by the Town of Morehead City and will be served with municipal water and sewer. In order to serve this site with water, a 12" water main will be extended from Apple Mobile Home Park along the right of way of NCSR 1177 (20 h Street) to the applicants property. From there, an 8" water line will be extended along the existing gravel drive to the proposed first phase development. Total length of the water line extension will be ± 11,500 feet. The sewer line will also be extended along the same route but the total length will be ± 11,300 of 10" line. A pump station will be located Z on the applicant's property adjacent to the Phase 1 site. Along the right of way of 20`t' Street, the water and sewer lines will cross underneath Dill Creek. The crossing will be performed by boring and jacking a steel casing pipe under the culverts in Dill Creek and installing the water line in the eastern casing pipe and the force main in the western casing pipe. The width of Dill Creek is ± 60' at the crossing site. The water and sewer infrastructure will be constructed by the applicant and turned over to the Town. Access to the property will be gained by using the abandoned section of SR 1177 and from an existing roadway in the Haystacks Development. The ± 1,970 feet of abandoned road and right of way at the end of NCSR 1177 will be improved and extended into the interior of the property. The applicant has met with the NC Department of Transportation to look at the adequacy of the existing roadway and the improvements needed to bring it to minimum state standards. Other than resurfacing, the width of the pavement will need to be increased to 18' and a minimum of 5' of road shoulder will have to be provided with a front slope of 3 to 1. As a result of this, two areas of Coastal Wetlands will be impacted. The first area is identified as Area B in the permit application. Here, portions of the roadway are to be shifted to the west in order to minimize wetland impacts but there will still be an approx. 90' long x 3.5' area of Coastal Wetlands filled for the roadway shoulder. The area is presently vegetated with spartina patens, juncus roemerianus, distichlis spicata and Bairiki frutescens. The second wetland area impacted by the road is identified in the project drawings as Area C. At this location the applicant is also proposing to increase the elevation of the road by ± 1' and replace an existing 24" culvert with a 36" one. A ± 150' long x 3.5' wide area of Coastal Wetlands would be filled on the north side of the existing road and on the south side, a ± 115' long x 5' wide area would be filled. The wetlands are vegetated primarily by spartina alterniflora with some spartina patens and Bairiki frutescens. Once the roadway extends beyond the wetland areas, the Blair Points Development will have a street system consisting of 30" curb and gutter and 26' of asphalt for a typical width of 31' from the back of curb to back of curb. The development will have ± 2000' of streets. The street drainage will be collected into a storm drainage system and discharged into the 10.6 acres of fresh water ponds. The applicant has indicated that the development will be under the low density requirements for stormwater with less than 30% built -upon. The applicant has calculated that the total impervious areas will be 9.55 acres which will represent approximately 22% of the project site. Finally, ± 218 linear feet of bulkhead is planned for a point on the Newport River between lots 5 and 6 in order to protect the earthen plug which separate the fresh water ponds from the River. The plug has been significantly eroded because of last years hurricanes. The bulkhead will be constructed landward of an extensive border of Coastal Wetlands. 10. ANTICIPATED IMPACTS: The project will result in ± 4 acres of land being disturbed within the subdivision with an additional ± 26 acres disturbed because of the infrastructure extensions into the project site. While the Town of Morehead City has annexed the property, it has not received authorization from the Division of Water Quality to extend Town sewer into the area. The extension of sewer and water to the project site will also provide utility accessability to the future phases of the applicant's property which has not yet been annexed by the Town. Town services will also be provided to the adjacent condominium project since it was also .annexed by Morehead City. In order to bring the existing roadway back to minimum Department of Transportation standards, the road improvements will result in the filling of ± 1,415 sq.ft. of Coastal Wetlands. A section of the road will also be increased in elevation to prevent its flooding during high tidal conditions. Additionally, a larger culvert will be replace a smaller one which should improve the exchange of tidal water into a pocket of wetlands which is separated from the waters of Crab Point Bay by the existing roadway. The applicant has indicated that the project will come under the NC Environmental Management's rules for low, density development. According to their calculations ± 22% of the project site will be impervious. The proposed shoreline stabilization will prevent the erosion of an earthen plug which would result in the land - locked canal systems being connected to the waters of the Newport River. This subdivision will also allow for the future construction of individual piers on 23 waterfront lots - 15 on the Newport River and 8 on Crab Point Bay. The applicant is currently in consultation with the NC Department of Cultural Resources concerning the archeological site. This project contains 43.8 acres of development on a portion of a tract of land known as Willis Point. The development provides 33 single family lots of approximately 0.75 acres in size. There are 15 lots that front the Newport River and there are 8 lots that front Dills Creek. The remaining lots are situated in order to provide a view of these bodies of water. There are some fresh water ponds that exist on the interior subdivision. The developers own the adjacent property from Willis Point along the northern shoreline of Dills Creek to a point east of NCSR 1176. The adjacent property contains 223 acres and there are no current plans for development of this property. It is expected that the lots will be sold out in five to seven years and the construction will be built out in approximately 10 years. Blair Pointe, Phase I has been annexed and will be served with sewer and water by the Town of Morehead City. The infrastructure for the water and sewer will be constructed by the developer and turned over to the Town for maintenance. In order to serve this site with water, a 12" water main will be extended from Apple Mobile Home Park near Mayberry Loop Road in the eastern right -of -way of NCSR 1176 (20th street) to the 223 acre tract of land. An 8" water line will be extended along an existing gravel road through this tract of land to NCSR 1177 and then extended along NCSR 1177, 5 feet off the shoulder, to the Blair Pointe, Phase I Development. The total length of water line extension will be approximately 11,500 feet. The sewer will be served by a regional pump station located between the 43.8 acre tract and the 223 acre tract. Blair Pointe, Phase I will be served with 1630 feet of 10" gravity sewer to the pump station. The force main for the pump station will be installed through the 223 acre tract of land paralleling the water line until it reaches NCSR 1176. It will then be installed in the western right -of way of NCSR 1176 and will be tied to an existing manhole along Mayberry Loop Road. The total length of force main is approximately 11,300 feet. The sewer infrastructure will be installed by the developer and upon its completion, turned over to the Town for maintenance. The waste water will be treated by the existing Town of Morehead City's wastewater treatment plant. Along NCSR 1176 the water main and force main will cross Dills Creek. This crossing will be performed by boring and jacking a steel casing pipe under the culverts in Dills Creek and installing the water line in the eastern casing pipe and the force main line in the western casing pipe. This crossing is designated as Area A. 101 -A East Victoria Court Greenville, North Carolina 27858 ® 919- 756 -1390 Blair Pointe Narrative Page 2 of 2 In order to develop Blair Pointe, the 1970 feet of existing abandoned road and right- of-way of NCSR 1177 must be reconstructed in order to meet minimum NCDOT standards. This road at one time was constructed to those standards and maintained by the NCDOT until previous property owners requested the road be removed from dedication. The road is currently paved and will be widened to 18 feet and overlaid. The shoulders will need to be a minimum of 5 feet in width and have a front slope to the ditch of 3 feet horizontal to 1 foot vertical. In order to reconstruct this road to again be accepted by the NCDOT, these minimum standards will have to be met. Existing ditches will be reshaped and reseeded. Approximately 900 feet of this roadway is within 75 feet of the AEC. There are two areas along Dills Creek where the reconstruction of the shoulders and the front slope will impact existing marsh area that is near the existing toe of fill slope along this road. These areas are marked as Area B and Area C. Bringing this existing road into compliance with North Carolina Department of Transportation standards is essential due to the fact that there are no other street construction provisions because the Town of Morehead City will not allow for private streets in new subdivisions. Without this retrofit to bring the road to current standards, the proposed subdivision would not be accessible to vehicular traffic. The existing road crosses a marsh area with an .24" culvert pipe that is submerged. High tide currently overflows the road. In order to prevent the high tide from overtopping the road, the existing 24" culvert will be replaced with a 36" culvert and one (1) foot of additional fill will be added to the road in order to increase the road elevation. This raising of the road elevation is imperative to provide safety for those persons traveling along this portion of road. The area is designated as Area C. The Blair Pointe Development will require a street section consisting of 30" curb and gutter and 26 feet of asphalt for a typical width of 31 feet from the back of the curb to the back of the curb. The development will have approximately 2000 feet of streets. The street drainage will be collected into a storm drainage system and discharged into the fresh water ponds. This development will be developed under the low density regulations for development less than 30% impervious. There are 33 lots that will be allowed the following: 6000 sf of building, 2300 sf of driveway, 1000 sf of patio. The total impervious area for the project will be 9.55 acres. The percent impervious for this project is 22 %. Discharge velocities will not be an issue for this development since the pipes will discharge into 10.6 acres of pond which will act as detention for any rainfall event. The fresh water ponds will discharge into the roadside ditches to NCSR 1177. A bulkhead of approximately 218 linear feet is planned for a point on the. Newport River between lots 5 and 6 in order to protect the ponds from being washed out during a storm. This area is designated as Area D.
