After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. The boat ramp and a portion of the access road would impact ± 350 sq.ft. of 404 Wetlands. The bulkhead would impact approx. 20 sq. ft. of existing Public Trust bottom area and 60 sq. ft.of bottom area within in the newly created access channel. The pier' would shade approx. 90 sq. ft of newly created Public Trust Area The Division of Marine Fisheries has reviewed the :proposed channel alignment and have indicated that it would not be within any designated Primary Nursery Area. Increased levels of .turbidly can be, expected during the construction phase of the project. Given the limited project depth, only small boats will be able to use the boat basin and in some incidences of low water, boats will not be able to use the facility at all. The Coastal Wetlands, in the area being proposed to be excavated, has been extremely stressed by fire, pedestrian traffic and /or vehicular traffic. Bogue Inlet is located approximately 2.5 miles, by water, south of the project. The project location is on a brackish water section of the river and is subject to lunar tides. By observation, the tides appear to fluctuate the water level 1.5 to 2.0 feet during each cycle. The project is located seven miles from the nearest public landing, which has inadequate capacity to meet public demand. There is only one private slough and boat ramp located within one mile of the project along the same shoreline. It receives very limited use by one family. SCOPE OF THE PROJECT The project scope is straightforward. It calls for the excavation of an approximately 20 ft. wide by 30 ft. long access channel through a natural opening in the marsh from the high water mark of the White Oak River to a proposed 30 ft. X 40 ft. excavated boat basin. The basin will be entirely located in upland area. The elevation of the access channel and basin floor will conform to the river bottom elevation at approximately 30 ft. beyond the channel entrance. This will allow a water level of approximately 1.5 feet inside the project at normal low tide; and will allow adequate flushing of the basin. The river bottom outside the channel entrance consists of mud/sand mix with no subsurface vegetation and no shell beds. Proposed structures inside the basin include a 10 ft x 15 ft cement boat ramp and a 3 ft x 30 ft wooden boat dock. The project drawings depict bulkheads at the access channel entrance. It is the desire of the project owners to establish only the minimal bulkheads required by the permitting process, which may or may not include those shown on the drawings The project is located on a 1.25 acre waterfront site that has been in the project owners, family for two generations. Site improvements include a a small vacation cabin and tool shed. Cabin occupancy averages 30 days per year. PROJECT SUMMARY: The applicant is proposing to excavate an access channel and boat basin in and adjacent to the White Oak River and construct a bulkhead, boat ramp, pier and access road. FIELD INVESTIGATION REPORT: WHITAKER /CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property is located on a 1.25 acre tract of land near the small community of Stella, in Carteret County. The property is bordered by the White Oak River on the south, Meadows Lane on the north and Starkey Creek to the east. To reach the property one would take SRl 108 (Breezy Point Road) to the end, turn left on Meadows Lane and the project is located at the last house on the right where the White Oak River, Pettiford Creek and Starkey Creek intersect. The property bordering the south side of the White Oak River has a sandy beach while the remainder of the shoreline (adjacent to Pettiford and Starkey Creeks) is bordered by an area of Coastal Wetlands ranging from 30 -100' wide with a + 50' wide area of 404 wetlands behind the marsh. The Coastal Wetlands consisting mainly of Black Needlerush (Juncus roemerianus), Salt Grass (Distichlis spicata), and Salt Meadow Grass (spartina patens) while the 404 wetlands are vegetated primarily by pine and myrtle bushes. Presently located on the property is a small fishing cabin which is used mostly in the summer. High ground elevations range from 3' -4' above Mean Sea Level. The upland areas are vegetated by native grasses, shrubs and trees. Waters of the White Oak River at the project site have been classified as SA and are open to the harvesting of shellfish for human consumption. Pettiford and Starkey Creeks have been classified as Primary Nursery Areas and are closed to the harvesting of shellfish for human consumption. It was the opinion of the Division of Marine Fisheries, after a site visit, that the proposed excavation project would be confined to the White Oak River and outside of the Primary Nursery Areas of Pettiford Creek. The applicant is proposing to excavate an access channel and boat basin and construct a pier, bulkhead, boat ramp and access road.. A 30' long x 20' wide area portion of the White Oak River would be excavated as an access channel which would then continue through a ± 30' wide border of Coastal and ± 15' wide area of 404 wetlands. The proposed 40' x 30' boat basin would be excavated entirely in 404 wetlands. The 10' wide boat ramp as well as a 25' x 10' wide section of an earthen access road would also fill an area of 404 wetlands. All excavation is proposed to be at a depth of -1.5' Mean Low Water. The marsh is very sparsely vegetated at the present time. A bulkhead would be constructed approx. 10' waterward of the Coastal Wetlands into the White Oak River and continue on either side of the entrance channel and terminate on the landward side of the Coastal Wetlands fringe. The applicant is also proposing a 30' long x 3' long pier within the boat basin. 10. ANTICIPATED IMPACTS: The proposed project would result in the excavation of ±600 sq.ft. of the White Oak River bottom with approx. 11 cu.yds. of silty substrate being removed from the bottom. Approx. 600 sq. ft. of coastal and 1500 sq. ft. of 404 wetlands would be excavated for the access channel and boat basin. It is estimated that ± 360 cu.yds. of dirt would be removed and disposed of in various places in the applicant's yard. The boat ramp construction would result in excavation and filling of 200 sq.ft. of estuarine bottom area with approx. 4 cu.yds of concrete material being placed below the MHW line and within the proposed boat basin. The boat ramp and a portion of the access road would impact ± 350 sq.ft. of "404" Wetlands. The bulkhead would impact approx. 20 sq. ft. of existing Public Trust bottom area and 60 sq. ft.of bottom area within in the newly created access channel. The pier would shade approx. 90 sq. ft of newly created Public Trust Area. The Division of Marine Fisheries has reviewed the proposed channel alignment and have indicated that it would not be within any designated Primary Nursery Area. Increased levels of turbidly can be expected during the construction phase of the project. Given the limited project depth, only small boats will be able to use the boat basin and in some incidences of low water, boats will not be able to use the facility at all. The Coastal Wetlands, in the area being proposed to be excavated, has been extremely stressed by fire, pedestrian traffic and /or vehicular traffic. Date NARRATIVE DESCRIPTION OF PROJECT MAJOR DEVELOPMENT PERMIT APPLICATION BREEZY POINT SLOUGH RIVERFRONT LOCATION OF PROJECT The proposed project is located on the east side of the White Oak River and one mile NNE across open water from the town of Swansboro in Carteret County, N.C. Bogue Inlet is located approximately 2.5 miles, by water, south of the project. The project location is on a brackish water section of the river and is subject to lunar tides. By observation, the tides appear to fluctuate the water level 1.5 to 2.0 feet during each cycle. The project is located seven miles from the nearest public landing, which has inadequate capacity to meet public demand. There is only one private slough and boat ramp located within one mile of the project along the same shoreline. It receives very limited use by one family. SCOPE OF THE PROJECT The project scope is straightforward. It calls for the excavation of an approximately 20 ft. wide by 30 ft. long access channel through a natural opening in the marsh from the high water mark of the White Oak River to a proposed 30 ft. X 40 ft. excavated boat basin. The basin will be entirely located in upland area. The elevation of the access channel and basin floor will conform to the river bottom elevation at approximately 30 ft. beyond the channel entrance. This will allow a water level of approximately 1.5 feet inside the project at normal low tide; and will allow adequate flushing of the basin. The river bottom outside the channel entrance consists of mud/sand mix with no subsurface vegetation and no shell beds. Proposed structures inside the basin include a 10 ft x 15 ft cement boat ramp and a 3 ft x 30 ft wooden boat dock. BULKHEADS The project drawings depict bulkheads at the access channel entrance. It is the desire of the project owners to establish only the minimal bulkheads required by the permitting process, which may or may not include those shown on the drawings USE OF THE PROJECT The project is located on a 1.25 acre waterfront site that has been in the project owners' family for two generations. Site improvements include a a small vacation cabin and tool shed. Cabin occupancy averages 30 days per year. _ ' The proposed project will be for private recreational use by the project owners, will accomodate one or two recreational boats up to 18 -20 feet in length, and will not see any commercial use. Access to the project will be entirely from the upland portion of the site. All work on the excavation will be completed by professional, licensed contractors. Any bulkheads will be completed by a licensed contractor. Construction of the dock will be a combination of owner and contractor effort with the contractor placing the support posts.
