Preston Howard, Jr., P.E., Director LT.3?FA OL [DEHN1=?L March 27, 1997 Craven County DWQ Project # 970259 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Gerald Anderson, LLC 1306 Highway 17 North Bridgeton, NC 28519 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.09 acres of wetlands or waters for the purpose of constructing a road crossing at Hunter's Ridge subdivision, as you described in your application dated 17 March 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. A deed restriction or conservation easement shall be added to the remaining wetlands on this lot to prevent future fill. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. On March 27, 1997, Preston Howard issued a 401 Water Quality Certification that allowed Anderson to obtain a Nationwide Permit Number 14 to construct a road crossing at Hunter's Ridge subdivision near Brices Creek. On April 30, 1997, the U.S. Army Corps of Engineers issued Nationwide Permit Number 18 (Action Id. 199705505) for the project. A 401 Certification for a Nationwide Permit Number 18 was never obtained prior to issuance of this permit. Today, records at the Craven County Courthouse were checked to see if the deed restriction or conservation easement required by your Certification was on record. Local officials were unable to locate these property restrictions after an extensive search. They were aware that the property is currently owned by Marjorie E. Williams of Craven County. We request that you obtain the deed restriction or conservation easement required by your Certification and provide us with a copy. If no restrictions were developed, please let us know what actions you will take to enforce the conditions of your Certification. In addition, county planning officials report to local residents that these wooded ( adjacent) wetlands will be excavated in the near future. Wetland standards (15A NCAC 2B.0231) state that habitat for the propagation of resident wetland - dependent wildlife species, including mammals, birds, reptiles and amphibians shall be protected and restored. The water quality standards for all wetlands are designed to protect, preserve, restore and enhance the quality and uses of wetlands and other waters of the state influenced by wetlands. The following are wetland uses: (1) Storm and flood water storage and retention and the moderation of extreme water level fluctuations; (2) Hydrologic functions including groundwater discharge that contributes to maintain dry weather streamflow and, at other locations or times, groundwater recharge that replenishes the groundwater system; (3) Filtration or storage of sediments, nutrients, toxic substances, or other pollutants that would otherwise adversely impact the quality of other waters of the state; (4) Shoreline protection against erosion through the dissipation of wave energy and water velocity and stabilization of sediments; (5) Habitat for the propagation of resident wetland- dependent aquatic organisms including, but not limited to fish, crustaceans, mollusks, insects, annelids, planktonic organisms and the plants and animals upon which these aquatic organisms feed and depend upon for their needs in all life stages; and (6) Habitat for the propagation of resident wetland- dependent wildlife species, including mammals, birds, reptiles and amphibians for breeding, nesting, cover, travel corridors and food. (b) The following standards shall be used to assure the maintenance or enhancement of the existing uses of wetlands identified in Paragraph (a) of this Rule: (1) Liquids, fill or other solids or dissolved gases may not be present in amounts which may cause adverse impacts on existing wetland uses; (2) Floating or submerged debris, oil, deleterious substances, or other material may not be present in amounts which may cause adverse impacts on existing wetland uses; (3) Materials producing color, odor, taste or unsightliness may not be present in amounts which may cause adverse impacts on existing wetland uses; (4) Concentrations or combinations of substances which are toxic or harmful to human, animal or plant life may not be present in amounts which individually or cumulatively may cause adverse impacts on existing wetland uses; (5) Hydrological conditions necessary to support the biological and physical characteristics naturally present in wetlands shall be protected to prevent adverse impacts on: (A) Water currents, erosion or sedimentation patterns; (B) Natural water temperature variations; (C) The chemical, nutrient and dissolved oxygen regime of the wetland; (D) The movement of aquatic fauna; (E) The pH of the wetland; and (F) Water levels or elevations. I thought it would be useful to prepare a letter describing how our wetland rules could affect your proposed activity. As we discussed according to our rules (15A NCAC 2H .0506(c)), you could fill 1.0 acres of wetlands on this site without requiring minimization review or mitigation from DWQ since the wetlands are more than 50 feet from a stream or other surface waterbody. Indeed as you stated, creation of a pond would have water quality benefits at least as compared to another type of development. As we discussed, whether our rules would be triggered by impact beyond one acre is not clear. Recently (but not in response to this project), we asked the Attorney General's office for an interpretation of our rules in this regard. The letter states that our tentative opinion is that our rules would apply since 1) wetland fill requiring a 401 Certification occurred elsewhere on the property (the road crossing we approved on 27 March 1997), and 2) our rules require us to consider cumulative impacts to wetlands (15A NCAC 2H .0506(c)(4)). Until the Attorney General's offcie provides an official opinion, I suggest that you limit your total impact on this site to no more than one acre of wetlands. If the Attorney General's Office advises us that the completion of this activity is not subject to our rules, I will notify you immediately. From the viewpoint of water quality, I would suggest the following. As you are aware, Brice's Creek is classified as Nutrient Sensitive Waters (as is the entire Neuse River basin). Also the Neuse River has excessive levels of nurtients (phosphorus and nitrgen) which are associated with algal blooms and fish kills. Wetlands serve an essential nutrient removal function especially for soluble pollutants primarily due to the action of bacteria and soil. Lakes similar to those you propose to build also serve to remove nutrients but primarily those attached to particles of soil through a settling process. Lakes perform poorly in the removal of dissolved nutrients as compared to wetlands. Unfortunately, dissolved nutrients are likely to be the most common form of nutrients leaving the Hunter's Ridge subdivision, flowing through your lakes and then entering Brice's Creek. These dissolved pollutants will likely be coming from lawn fertilizers, dry atmospheric fallout washed from roofs and streets into the storm drains and excrement from ducks attracted to the lakes. Therefore we believe that an increase in nutrients is likely from the hunter's Ridge subdivision to Brice's Creek and the Neuse River despite your planned efforts to manage stormwater by directing it into a series of ponds. We believe that the best design would 1) provide a lake as planned for the use of the residents of Hunter's Ridge, ) would effectively manage nutrient input to Brice's Creek, and 3) would not require wetland mitigation is shown on the accompanying sketch. A pond dug in one acre of wetlands could be easily located adjacent to and downslope of the private entrance road. The remaining wetlands on the site with the remnant cypress trees could be left intact to receive drainage from the ponds and thereby removing soluble nutrients. The cleared portion of the wetland could be planted to beautify the area in conjunction with your proposed hiking trail. This design would not require wetland mitigation under our Water Quality Certification rules since total wetland impact would be less than one acre. Please call me at 919 - 733 -1786 to discuss these issues. Also as we discussed in the field, you will need to notify DWQ in writing about the changed development plans for this project even if a 404 Permit is not required for your proposed pond. As stated in the Certification issued to you on 27 March 1997 (depending on your submittal), you may be required to reapply. Finally our Certification required a deed restriction or conservation easement on the remaining wetlands (namely those you plan to excavate for the pond). Please address how this requirement will be met. Until these provisions are adequately handled, your project is not in compliance with the 401 Water Quality Certification we issued on 27 March 1997. Therefore we believe that an increase in nutrients is likely from the hunter's Ridge subdivision to Brice's Creek and the Neuse River despite your planned efforts to manage stormwater by directing it into a series of ponds. , We believe that the best design would 1) provide a lake as planned for the use of the residents of Hunter's Ridge, ) would effectively manage nutrient input to Brice's Creek, and 3) would not require wetland mitigation is shown on the accompanying sketch. A pond dug in one acre of wetlands could be easily located adjacent to and downslope of the private entrance road. Planner, called this office on June 3 and June 4 (1 was in Raleigh on 6/3) to discuss the Hunter's Ridge project. He was requesting information on the WQ 401 Cert. for the project. I found the project in the files as "401 Issued" which meant that it was triaged. The project was for a road crossing with .09 ac. of wetland impacts. You put a condition requiring "deed restrictions" against further fill in the wetlands. According to Mr. Bumgardner, Mr. Anderson has hired a contractor out of Wilmington who has special equipment which can excavate wetlands without fill (avoiding the Tulloch Rule). Mr. Bumgardner says that Mr. Anderson plans to dig up all of the wetland slough and connect it with the adjacent mining pit to make a big pond/lake. The pond/lake will have an overflow pipe which will drain into Brice's Creek. Last year (1996) this office had numerous telephone complaints from citizens as well as Rick Dove of the Neuse River Foundation complaining about severe turbidity in Brice's Creek. It was suspected that it was coming from the mining operation on this site. Staff members from this office as well as staff from the Land Quality office responded to the numerous complaints. LQ sited violations on the site for sedimentation violations into the Trent River but never could determine where all the turbidity was coming from in Brice's Creek. Weyerhaeuser was developing a residential site which drained into Brice's Creek also. DWQ staff comfirmed severe violation of the turbidity std. but could not determine a comfirmed violator only suspected ones. I have discussed this with Floyd Williams and Pat McClain of the LQ section. Both have said that Mr. Anderson will need to request a modification for this proposed excavation of the wetland area and the connection of the mining pit prior to the activity. Wheter it is a modification of the mining permit or the sedimentationa and erosion control it will need a modifiction and review. I can probably make comments for water quality concerns through them. According to LQ, one of the complaintants has written the DEHNR Secretary to relay her concerns for the environment (wetlands and streams). Please check into whether the excavation activity will violate the condition on the 401 Cert. It probably would have been better if the condition had included the wording "or significantly impact the wetland area" for this project (or possibly future projects). This project has plans to subdivide the site into over 250 residential sites. . Keep WaRO updated on this project and all related concerns. This is a sensitive area with a long history. It may be helpful to the program in the future to send a draft 401 Cert. which contains conditions of any triaged projects to the region for review and input.
