In response to the revised plans (received by the Wetlands Group
5/9/97), ARO staff now recommend issuance of 401 Certification
for the project.
The revised plans show approximately 90 feet of stream to be
clulverted (versus 220 feet previously).
Less than 1/3 acre of wetlands will be disturbed. If one
calculates the entire area of the project, in the location of the
undelineated wetlands, approximately 1/4 acre will be disturbed.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Hipp:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 145 feet of streams for the purpose of constructing a ball field at the end of Lincloln Lane, as you
described in your application dated March 1997. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide
Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation
may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must
follow the conditions listed in the attached certification and any additional conditions listed below. Fill shall not
be placed in wetlands located on the site. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non - Discharge and Water Supply Watershed regulations. This approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition
which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

14, 1997 regarding the above project. Upon review of your letter, and meeting with staff from
the City of Lenoir, the decision has been made to scale back the project to require only 145 lineal
feet of stream culverting. This revised project will result in deletion of Parking Area "A" and the
lower portion of Parking Area `B ", resulting in a decrease in parking spaces from 120 to 75. We
are currently preparing a revised plan to reflect these changes, and expect to have this plan
completed by May 2, 1997, at which time we will transmit seven (7) copies to your office. We
trust that this decrease in stream culverting will permit the issuance of the 401 Water Quality
Certification, and compensatory mitigation and /or further documentation will not be required.

Dear Mr. Hipp:
The Division of Water Quality has reviewed your plans for the discharge of fill material into
0.03 acres of streams located at your park site at the end of Lincloln Lane in Caldwell County for
ballfield development. Based on this review, we have identified significant uses which would be
removed by this project. These uses are aquatic life support. Furthermore, insufficient evidence
is present in our files to conclude that your project must be built as planned in waters and/or
wetlands in accordance with 15A NCAC 2H.0506. Therefore, we are moving toward denial of
your 401 Certification as required by 15A NCAC 2H .0507(e). Until we receive additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers
and/or the N.C. Division of Coastal Management place your project on administrative hold.
Please provide us with information supporting your position that your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters
and/or wetlands. Specifically can you construct your ballfields without culverting the stream or by
reducing culverting to a total of 150 linear feet? Any documentation such as maps and narrative
that you can supply to address alternative designs for your project may be helpful in our review of
your 401 Certification. Also this project will require compensatory mitigation as presently
planned and described in 15A NCAC 2H .0506(h). Your mitigation proposal is insufficient
because none was provided for the stream loss. Finally it appears that wetlands may be located on
the site which may be impacted by this project. By copy of this letter we are requesting that Mr.
Steve Chapin of the Asheville field Office of the U.S. Army corps of Engineers determine whether
wetlands are present and (if so) whether this project would affect them. Please respond within
two weeks of the date of this letter by sending a copy of this information to me and one copy to
Mr. Jim Reid at the Asheville Regional Office at 59 Woodfin Place, Asheville, NC 28801. If we
do not hear from you in two weeks, we will assume that you no longer want to pursue this project
and we will consider the project as withdrawn. I can be reached at 919- 733 -1786 if you have any

Dear Mr. Hipp:
Reference your February 10, 1997 application for Department of the Army
(DA) authorization to culvert approximately 300 linear feet of an unnamed
tributary to Gunpowder Creek at a new athletic facility located at the end of
Lincoln Lane, in the southern part of Lenoir, Caldwell County, North Carolina.
The purpose for the culverting is to facilitate the construction of the new
athletic facility and associated parking. As a result of the project,
approximately 0.03 acre of stream channel will be impacted and no wetlands
will be impacted. This project has been coordinated with the North Carolina
Wildlife Resources Commission (WRC).
For the purposes of the Corps of Engineers' Regulatory Program, the
"December 13, 1996 Federal Register, Final Notice of Issuance, Reissuance, and
Modification of Nationwide Permits (61 CFR 65874)" listed nationwide permits.
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided that the activity meets all of the following criteria:
a. The discharge does not cause the loss of more than three (3) acres
of waters of the United States nor cause the loss of waters of the United
States for a distance greater than 500 linear feet of a stream bed;
b. For discharges causing the loss of greater than 1/3 acre of waters
of the United States, the permittee notifies the District Engineer in
accordance with the "Notification" general condition;
C. For discharges causing the loss of 1/3 acre or less of waters of the
United States, the permittee must submit a report within thirty (30) days of
completion of the work, containing the following information:

you receive a Section 401 water quality certification from the North Carolina
Division of Water Quality. You should contact Mr. John Dorney, telephone
(919) 733 -1786, regarding water quality certification. This nationwide permit
does not relieve you of the responsibility to obtain other required State or
local approval.
This verification will be valid until the nationwide permit expires,
which will occur on December 13, 1998. All activity under the terms and
conditions of this nationwide permit must be completed before the permit
expires. It is incumbent upon you to remain informed of changes to the
nationwide permits, which will be announced by public notice when they occur.
We have evaluated potential impacts of your activity, and we have
determined that your proposal will not likely have an adverse affect on any
endangered species.
When you have completed your work and any required mitigation, please
sign and return the enclosed certification form.

Please find enclosed one (1) copy of a completed and executed application entitled
"Joint Form for Nationwide Permits" for the above project. This project consists of
construction of three baseball fields and related parking areas on an eight acre tract of Town
owned property. Approximately 2/3 of this property was previously graded as a borrow area
during the construction of the nearby Southwestern Boulevard in Lenoir, during which 180
lineal feet of 48" culvert was installed in the small creek which runs through the site. The
proposed project will involve piping an additional 270 lineal feet of this same creek to allow
for the parking and ballfields. The construction of these ballfields is necessary due to the
elimination of existing fields at another location due to an industrial expansion. This submittal
includes a vicinity map and copies of the construction plans and details for the construction of
this project.
