Myers, Executive Director October 8, 2012 Via E -Mail Mr. Hugh Barwick Duke Energy Carolinas Subject: Non - Capacity License Amendment —Rhodhiss and Oxford Developments Catawba - Wateree Hydroelectric Project, FERC Project No. 2232 Dear Mr. Barwick: The North Carolina Wildlife Resources Commission ( NCWRC) has reviewed your letter of October 1, 2012 requesting comments on Duke Energy's proposal to apply for a Non - Capacity Amendment for the Catawba - Wateree Project. The amendment would consist of a change to the authorized installed capacity due to the replacement of Rhodhiss Unit 3 and Oxford Unit 2. The turbine replacements are consistent with the 2006 Comprehensive Relicensing Agreement (CRA) and are designed to improve dissolved oxygen downstream of each development. The CRA calls for the turbine upgrades to occur within 36 months of a new license for the Oxford development and within 48 months for the Rhodhiss development. It was anticipated that a new license would have been issued prior to now. The proposed amendment is required because it appears that the turbine replacements will occur under the terms of the existing license. The NCWRC has been involved throughout the Catawba - Wateree relicensing process and is a party to the CRA. The NCWRC supports the proposed amendment, as it is consistent with the terms of CRA, including provisions for minimum and recreation flows, and water quality improvements, and will be implemented several years earlier than would otherwise be required.
