Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The Applicant has avoided and minimized impacts to the greatest extent practicable given the project's purpose and need. The proposed stream impacts are the result of the necessary infrastructure and facility layout, without which, the project's goals would not be realized. The location of the proposed road crossings have minimized impacts to the maximum extent practicable by aligning the crossing as close to 90 degrees as possible. Roadway grades were set to minimize backslope and crossing impacts. In addition, crossing culverts were upsized to utilize larger Standard NCDOT Headwalls. A wet retention pond dam was intentionally located and set to minimize impacts. Also, redundant sidewalks have been removed to minimize shoulder widths and the Wendell Boulevard sidewalk offset from the roadway has been removed at Stream D to avoid stream impacts and minimize buffer impacts. In addition, utilities have been aligned adjacent and parallel to the proposed road crossing. Dissipator pads associated with the culvert will be installed flush with the existing grade of the stream bed to allow for aquatic life passage. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environmental and Natural Resources Erosion Control Planning and Design Manual and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer dams, tree protection, clearing only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken to prevent oil, tar, trash, debris and other pollutants from entering the adjacent jurisdictional streams. Any excess excavated materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional streams. Therefore, stockpiling of excavated material within jurisdictional streams will be strictly prohibited as part of the construction of this project. All project construction activities initiated within jurisdictional streams will be carried to completion in an expeditious manner to minimize the period of disturbance within the jurisdictional streams. 2. In addition, habitat surveys were completed for protected aquatic species listed. No habitat was observed in the unnamed tributaries to Buffalo Creek at the site. A biological conclusion of "No Effect" is recommended for all protected species listed. Findings of the aquatic survey are included as an attachment. Seven aquatic species in the Neuse River Basin are federally listed or are proposed for protection by the United States Fish and Wildlife Services for Wake County (Table 1). Two freshwater mussel species are listed as federally endangered, one as federally threatened, and two as “At Risk Species” (ARS). On January 7, 2021, a habitat assessment was completed by SEPI biologists Chris Sheats (NCWRC Endangered Species Permit # 21-ES00558) and Tori Fowler, in an unnamed tributary to Buffalo Creek where a road crossing is proposed (See Nationwide Permit Application). Habitat was assessed for freshwater mussels, the Carolina madtom, and the Neuse River waterdog. Although the stream exhibited perennial flow, the stream was relatively small with eroding banks and had a wetted width of approximately 3 feet with sand and silt as the dominant substrate. No freshwater mussels or associate species were observed in the channel. Based on these observations, it is in our best professional judgement the project will have “No Effect” on any protected aquatic species in Table 1. Samantha Daily, USACE Comments: • Ms. Daily may need to coordinate with US Fish and Wildlife regarding potential impacts to aquatic mussels for the northernmost crossing at the tributary to Buffalo Creek. She requests that documentation be included in the application, if available. • For the proposed Phase Ia, Ms. Daily requests that the application reflect as much of the site plan as possible and be conservative with estimated impacts. • Regarding mitigation for impacts to Waters of the US, Ms. Daily requests that wetland rating forms were requested to be included in the application to support a reduced mitigation ratio at the Wetland B impacts (downslope of pond). • Rip rap outlets/dissipator pads are considered permanent impacts. However, mitigation will not be required for these impacts. Ms. Daily requests that we separate these impacts in the application. 2 Rick Trone, NCDEQ Comments: • Mr. Trone discussed the new 401 procedures including a requirement for the NCDEQ to issue a public notice and include those any comments in their consideration of the application. He did not anticipate any impact to the review schedule for this project. • Due to the change in the State’s isolated wetland rules, we are asked to include detailed documentation in the application to support the isolated/exempt wetlands classifications that are present on the property. A site visit NCDEQ may be requested to confirm. Division of Environmental Quality (NCDEQ) on March 25, 2021, to review the proposed project and discuss the upcoming permit application submittal. Information was provided to the agency representatives regarding the overall project including completed environmental due-diligence, agency approvals received to-date, summary of natural resources, proposed master plan, current site plan, impacts and mitigation. Samantha Daily, USACE Comments: • Ms. Daily may need to coordinate with US Fish and Wildlife regarding potential impacts to aquatic mussels for the northernmost crossing at the tributary to Buffalo Creek. She requests that documentation be included in the application, if available. • For the proposed Phase Ia, Ms. Daily requests that the application reflect as much of the site plan as possible and be conservative with estimated impacts. • Regarding mitigation for impacts to Waters of the US, Ms. Daily requests that wetland rating forms were requested to be included in the application to support a reduced mitigation ratio at the Wetland B impacts (downslope of pond). • Rip rap outlets/dissipator pads are considered permanent impacts. However, mitigation will not be required for these impacts. Ms. Daily requests that we separate these impacts in the application. 2 Rick Trone, NCDEQ Comments: • Mr. Trone discussed the new 401 procedures including a requirement for the NCDEQ to issue a public notice and include those any comments in their consideration of the application. He did not anticipate any impact to the review schedule for this project. • Due to the change in the State’s isolated wetland rules, we are asked to include detailed documentation in the application to support the isolated/exempt wetlands classifications that are present on the property. A site visit NCDEQ may be requested to confirm. Recommended Next Steps: • SEPI will incorporate all requested information into the overall permit application, finalize the application and submit. • All mitigation has been sourced and will be provided by local, private mitigation banks (based on current inventory to-date). • Following submittal of the application, SEPI will continue to coordinate with the regulators to track the review process until approval is received.
