The North Caiolma Department of Transportation is requesting a modification to the referenced
permits for the relocation of a commercial entrance to Rightmyet Machines Rentals Inc and the installation
of a watei line The existing entrance to the Rightmyer property is located on SR 1200 (Lebinon Church
Rd) neat the intersection of NC 46 This entire intersection is being realigned in conjunction with the
widening of NC 46 The entrance is being relocated to NC 46 in order to impiove safety at this intersection
and the exr,tmg entrance will be removed The proposed 1 n> 84 x 30 Corrugated Aluminum Pipe will be
installed in the roadway ditch on the east side of NC 46 resulting in 84 of stream impact This section of
the i oadway ditch contains a portion of the same stream that has preN iously been pennrtted for impacts trom
the lengthening of the existing pipe under NC 46
There will be a new 12 waterline installed on the west side of NC 46 at the intersection of SR
1200 The waterline will be installed by open cut method and will cross the stream Just beyond the outlet of
the pipe under NC 46 that is being extended The watei line installation will result in 4 sq ft of tempoiaiy
impact to the stream

reissued or revoked prior to March 18 2012 It is incumbent upon you to remain informed of changes to the NWPs We will issue a
public notice when the NWPs are reissued Furthermore if you commence or are under contract to commence this activity before the
date that the relevant nationwide permit is modified or revoked you will have twelve (12) months from the date of the modification or
revocation of the NWP to complete the activity under the present terms and conditions of this nationwide permit

The project shall be constructed in accordance with your application dated received May 18 2011 After reviewing
your application we have decided that these impacts are covered by General Water Quality Certification 3820 This
certification corresponds to the Nationwide Permit 14 issued by the Corps of Engineers In addition you should
acquire any other federal state or local permits before you proceed with your project including (but not limited to)
Sediment and Erosion Control Non Discharge and Water Supply Watershed regulations This approval will expire
with the accompanying 404 permit

Should your project change you must notify the DWQ and submit a new application It the property is sold the

The permittee and its authorized agents shall conduct its activities in a manner consistent with State water
quality standards (including any requirements resulting from compliance with §303(d) of the Clean Water Act)
and any other appropriate requirements of State and Federal law If DWQ determines that such standards or
laws are not being met (including the failure to sustain a designated or achieved use) or that State or federal law
is being violated or that further conditions are necessary to assure compliance DWQ may reevaluate and
modify this certification
