General Cond�t�ons
4 Unless otherw�se approved m th�s certification placement of culverts and other structures m open waters
and streams shall be placed below the elevation of the streambed by one foot for all culverts with a
d�ameter greater than 48 mches and 20 percent of the culvert d�ameter for culverts hav�ng a diameter less
than 48 mches to aliow low flow passage of water and aquat�c I�fe Des�gn and placement of culverts and
other structui es mcludmg temporary erosion control measures sha11 not be conducted m a manner that may
result m d�s equ�libr�um of wetlands or streambeds or banks ad�acent to or upstream and down stream of
the above structures The appl�cant�s required to pi ovide ev�dence that the equil�brium�s bemg mamtamed
if requested in wr�t�ng by NCDWQ If this condrt�on is unable to be met due to bedrock or other limrtmg
features encountered durmg construction please contact NCDWQ for gu�dance on how to proceed and to
determ�ne whether or not a permit modrficat�on w�ll be requ�red
5 If concrete is used durmg construct�on a dry work area shall be mamta�ned to prevent direct contact
between curmg concrete and stream water Water that madvertently contacts uncured concrete shall not be
discharged to surface waters due to the potent�al for elevated pH and possible aquatic life and fish kills
6 During the construct�on of the pro�ect no staging of equ�pment of any kmd is permitted�n waters of the
U S or protected riparian buffers
7 The dimens�on pattern and profile of the stream above and below the crossing shall not be mod�fied
D�sturbed floodplams and streams shall be restored to natural geomorph�c condrtions
8 The use of rip rap above the Normal High Water Mark shall be mm�m�zed Any rip rap placed for stream
stabil�zation shall be placed in stream channels m such a manner that rt does not �mpede aquatic life
passage
9 The Perm�ttee shall ensure that the final des�gn drawmgs adhere to the perm�t and to the permrt drawmgs
subm�tted for approval
10 All work m or ad�acent to stream waters shall be conducted m a dry work area Approved BMP measures
from the most current vers�on of NCDOT Construct�on and Mamtenance Activ�ties manual such as
sandbags rock berms cofferdams and othei dtvers�on structuies shall be used to prevent excavat�on m
flowing water
11 Heavy equ�pment shall be operated from the banks rather than in the stream channel m order to mm�mize
sedimentation and reduce the mtroduct�on of other pollutants mto the stream
12 All mechanized equipment operated near surface waters must be regularly mspected and mamtamed to
prevent contammation of stream waters from fuels lubr�cants hydraul�c fluids or other toxic materials
13 No rock sand or other materials shall be dredged from the stream channel except where authorized by th�s
cert�ficat�on
14 Dischargmg hydroseed m�xtures and wash�ng out hydroseeders and other equipment m or ad�acent to
surface waters�s proh�b�ted

15 The permittee and �ts authorized agents shall conduct�ts activ�ties�n a manner consistent with State water
quality standards(includmg any requirements resultmg from compl�ance wtth §303(d)of the Clean Water
Act)and any other appropriate requirements of State and Federal law If NCDWQ deteim�nes that such
standards or laws are not being met(�ncludmg the fa�lure to sustam a designated or ach�eved use)or that
State or federal law is be�ng violated oi that furthei condrt�ons are necessary to assure compLance
NCDWQ may reevaluate and modify this certification
16 All fill slopes located m�urisdict�onal wetlands shall be placed at slopes no flatter than 3 1 unless
otherwise authonzed by this cert�fication
17 A copy of th�s Water Quality Cert�fication shal]be maintamed on the construct�on site at all times In
addrtion the Water Quality Cert�ficat�on and all subsequent mod�fications �f any shall be mamtamed wrth
the Div�s�on Engmeer and the on srte pro�ect manager
18 The outside buffer wetland or wate� boundary located with�n the construction corr�dor approved by th�s
authorizat�on shall be clearty marked by tughly vis�ble fencmg pr�or to any land d�sturbmg actrvrt�es
Impacts to areas w�thm the fencmg are p�ohibrted unless otherwise author�zed by this certificatton
19 The issuance of this certification does not exempt the Permittee from complying w�th any and all statutes
rules regulations or ordmances that may be imposed by other government agenc�es(i e local state and
federal)having�urisdiction mcludmg but not I�mited to appl�cable buffer rules stormwater management
rules so�l eros�on and sed�mentat�on control requ�rements etc
20 The Permittee shall report any v�olat�ous of th�s certificat�on to the Drvision of Water Qualrty wrth�n 24
hours of d�scovery
21 Upon complet�on of the pro�ect(mcludmg any impacts at associated boriow or waste sites) the NCDOT
Divis�on Engineer shall complete and return the enclosed Certificat�on of Completion Foim to not�fy
NCDWQ when all work�ncluded m the 401 Certification has been completed
22 Nat�ve ripar�an vegetat�on must be reestabl�shed w�thm the construction l�mits of the pro�ect by the end of
the grow�ng season followmg complerion of construction
23 There shall be no excavat�on from or waste d�sposal mto �ur�sdict�onal wetlands or waters assoc�ated w�th
this permrt wrthout appropriate modificat�on Should waste or borrow srtes or access roads to waste or
boirow srtes be located m wetlands or streams compensatory mrt�gation w�ll be required smce that�s a
direct�mpact from road construchon act�vrties
24 Erosion and sed�ment control pract�ces must be m full compliance wrth all specifications governtng the
proper des�gn mstallat�on and operation and ma�ntenance of such Best Management Practices m order to
protect surface waters standards
a The erosion and sed�ment control measures for the pro�ect must be des�gned mstalled operated and
mainta�ned m accordance w�th the most recent vers�on of the North Carolrna Sediment and Eroston
Contf ol Planncng and Design Manual
b The des�gn mstallat�on operation and mamtenance of the sed�ment and eroston control measures
must be such that they equal or exceed the requ�rements specified in the most recent version of the
North Carolina Sedtment and Erosron Control Manual The dev�ces shall be mamta�ned on all
construct�on srtes borrow sites and waste pile (spo�l) pro�ects mcludmg contractor owned or leased
borrow pits assoc�ated with the pro�ect
c For borrow prt srtes the eros�on and sediment control measures must be designed mstalled operated
and mamtamed m accordance wrth the most recent vers�on of the North Carolina Surface Mrnmg
Manual
d The reclamat�on measures and implementat�on must comply w�th the reclamat�on m accordance w�th
the requ�rements of the Sedimentation Pollution Control Act
24 Sediment and erosion control measures shall not be placed m wetlands or waters unless otherwise approved
by this Cert�ficat�on
