practices(e g vegetated conveyances constructed wetlands detent�on ponds etc)prior to dischargmg to surface waters 5 The NCDOT D�v�s�on Environmental Officer or Environmental Ass�stant w�ll conduct a pre construct�on meetmg with all appropr�ate staffto ensure that the pro�ect supervisor and essential staff understand the potential issues w�th siream and pipe ahgnment at the perm�tted s�te NCDWQ staff shall be�nvrted to the pre construction meetmg General Cond�t�ons 6 Unless otherwise approved�n this certificat�on placement of culverts and other structures m open waters and streams shall be placed below the elevat�on of the streambed by one foot for all culverts with a diameter greater than 48 mches and 20 percent of the culvert d►ameter for culverts havmg a d�ameter less than 48 mches to allow low flow passage of water and aquatic l�fe Design and placement of culverts and other structures mcludmg temparary erosion control measures shall not be conducted m a manner that may result m dis equilibr�um of wetlands or sh-eambeds or banks ad�acent to ar upstream and down stream of the above structures The applicant is requ�red to provide evidence that the equihbnum�s be�ng mamtamed if requested m wntmg by NCDWQ If th�s condrtion is unable to be met due to bedrock or other l�m�tmg features encountered durmg construct�on please contact NCDWQ for guidance on how to proceed and to determine whether or not a permrt modificarion w�ll be reqmred 7 If concrete�s used during construction a dry work area shall be mamtamed to prevent d�rect contact between curing concrete and stream water Water that madvertently contacts uncured concrete shall not be d�scharged to surface waters due to the potential for elevated pH and poss�ble aquatic life and fish k�lls 8 Durmg the constructton of the pro�ect no stagmg of equ�pment of any kmd�s perm�tted m waters of the U S or protected riparian buffers 9 The d�mens�on pattern and profile of the stream above and below the crossmg shall not be mod�fied D�sturbed floodplams and streams shall be restored to natural geomorph�c cond�t�ons 10 1he use of rip rap above the Normal H�gh Water Mark shall be mmim�zed Any rip rap placed for stream stab�lizat�on shall be placed m stream channels �n such a manner that rt does not impede aquat►c Lfe passage 11 The Permittee sha11 ensure that the tmal des�gn drawings adhere to the permrt and to the permit drawmgs subm�tted for approval 12 All work m or ad�acent to stream waters shall be conducted m a dry work area Approved BMP measures from the most current vers�on of NCDOT Construct�on and Mamtenance Act�v�t�es manual such as sandbags rock berms cofferdams and other diversion structures shall be used to prevent excavat�on m flowmg water , I � ]3 Heavy equipment shall be operated from the banks rather than m the stream channel m order to m�mm�ze , sed�mentation and reduce the mtroduction of other pollutants mto the stream 14 All mechamzed equipment operated near surface waters must be regularly �nspected and mamtamed to prevent contammation of stream waters from fuels lubricants hydraul�c fluids or other tox�c mater�als 15 No rock sand or other mater�als shall be dredged from the stream channel except where authorized by th�s certificat�on 16 D�scharging hydroseed mixtures and washmg out hydroseeders and other equipment m or ad�acent to surface waters�s proh�bited 17 The permrttee and its authorized agents shall conduct tts activrt�es m a manner consistent w�th State water quahty standards(mcludmg any requ�rements resultmg from comphance wrth§303(d)of the Clean Water Act)and any other appropnate reqwrements of State and Federal law If NCDWQ determmes that such standards or laws are not be�ng met(mcludmg the fa�lure to sustam a des�gnated or achieved use)or that State or federal law is bemg violated or that further condrtions are necessary to assure compl�ance NCDWQ may reevaluate and mod�fy this cert�fication 18 All fill slopes located m�unsdict�onal wetlands shall be placed at stopes no flatter than 3 I unless otherwise author�zed by this cert�ficat�on 19 A copy of this Water Qual�ty Cert�fication shall be mamtamed on the construction srte at all t�mes In addrtion the Water Qual�ty Certificat�on and all subsequent modifications �f any shall be mamtamed with the Division Engmeer and the on srte pro�ect manager 20 The outside buffer wetland ar water boundary located wrthm the construct�on corridor approved by th�s author�zat�on shall be clearly marked by h�ghly v�s�ble fencmg prior to any land disturbmg activ�ties Impacts to areas w�thm the fencmg are prohib�ted unless otherwise autharized by th�s cert�fication 21 The issuance of th�s certification does not exempt the Permittee from complymg wrth any and all statutes rules regulations or ordmances that may be imposed by other government agenc�es(i e local state and federal)havmg�ur�sdict�on mcludmg but not l�mited to appl�cable buffer rules stormwater management rules soil eros�on and sedimentation control requ�rements etc 22 The Permittee shall report any vlolations of th�s certification to the Div�s�on of Water Quality w�thm 24 hours of d�scovery 23 Upon complet�on of the pro�ect(mcluding any impacts at associated borrow or waste sytes) the NCDOT D�v�sion Engmeer shal)complete and return the enclosed Certificat�on of Completion Form to notify NCDWQ when all wark mcluded m the 401 Cert�fication has been completed 24 Natrve ripanan vegetation must be reestablished withm the construct�on limits of the pro�ect by the end of the growmg season followmg completion of construct on 25 There shall be no excavation from or waste disposal mto Jurisdict�onal wetlands or waters associated with this perm�t w�thout apnropr�ate mod�fication Should waste or borrow site� or access roads to waste or borrow sltes be located m wetlands or streams compensatory mrt�gation will be reqwred smce that is a direct impact from road construction activrttes 26 Eros�on and sed�ment control practices must be m full compl�ance w�th all specifications governmg the proper des�gn mstallation and operation and mamtenance of such Best Management Pract�ces �n order to protect surface waters standards a The erosion and sediment control measures for the pro�ect must be des�gned instalied operated and mamtamed m accordance with the most recent vers�on of the North Carolrna Sedtment specifted m the most recent vers�on of the North Carolrna Sed�ment and Erosron Control Manual The dev�ces shall be mamtamed on all __ construct�on s�tes borrow s�tes and waste pile (spoil) pro�ects includmg contractor owned or leased borrow p�ts associated w�th the pro�ect c For borrow p�t s�tes the eros�on and sed�ment control measures must be designed �nstalled operated and mamtamed m accordance with the most recent version of the North Carolina Surface Mrnrng Manual d The reclamation measures and implementat�on must comply w�th the reclamat�on m accordance w�th the requ�rements of the Sed�mentation Pollut�on Controi Act 26 Sed�ment and erosion control measures shall not be placed m wetlands or waters unless otherwise approved by th�s Cert�ficat�on If you w�sh to contest any
