Box 1006 Charlotte, NC 28201-1006 Dear Ms. Styer: RE: Division of Water Quality approval of Duke Energy application for Non-Capacity License Amendment Catawba-Wateree Project, FERC No. 2232, DWQ # 2008-0915 Dee Freeman Secretary On February 16, 2011 the Division of Water Quality received your letter dated February 15, 2011 concerning your request for DWQ's opinion on Duke Energy's application to FERC for a Non-Capacity License Amendment. The planned and ongoing work to the Bridgewater Powerhouse is needed in order to meet the requirements of the Relicensing Settlement Agreement for this project as well as the 401 Certification issued on November 14, 2008. Our understanding is that it now appears that the powerhouse construction will be completed before the new FERC license is issued.
