Box 1150 Fayetteville, North Carolina 28302 Dear Mr. Gibson: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.10 acre of wetland for the purpose of constructing a new roadway, SR 2260, to connect SR 1814 to US 421 just east of Dunn in Harnett County. This project is part of improvements to the north bound off ramp at the I-95 and US 421 intersection. These improvements will eliminate two-way traffic on the ramp and necessitate an alternative access. This project shall be constructed in accordance with your application dated November 30, 2005. December 20, 2005 Page 2 In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification and the following additional conditions: 1. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality. Also, we ask that you notify the Fayetteville Regional Office upon completion of this work. 2. NCDOT shall conduct its activities in a manner consistent with State water quality standards (including any requirements resulting from compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of State law and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may re- evaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15A NCAC 2H.0507(d). Before modifying the certification, DWQ shall notify NCDOT and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to NCDOT in writing, shall be provided to the US Army Corps of Engineers for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. 3. This Water Quality Certification will expire with the accompanying 404 permit issued by the U.S. Army Corps of Engineers. This condition supercedes Condition #19 of General Certification #3404 issued on March 28, 2003. 4. The proposed 18" RCP equalizer pipe shall be installed at a depth sufficient to provide continued water passage through the fill section. However, measures must be taken to prevent channel formation on either end of this pipe. Also, grading of the site must not create a drainage effect or alteration of hydrology within the remaining wetland. Mr. Terry R. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. LYNDO TIPISIT?.; SECRETARY `o5zis4 ATTN: Mr. Richard Spencer NCDOT Coordinator Dear Sir: Subject: Notification for Nationwide Permit 14 (Minor Road Crossing) Minor Road Crossing- SR 2260-Harnett County Division 6 Division Design Project TIP No. R-4736 The North Carolina Department of Transportation (NCDOT) proposes to improve the southeast exit ramp along I-95 at Exit 73 (Dunn) to conform with current safety standards. The present exit ramp along I-95 requires the reduction of speed down to 35 MPH from 65 MPH immediately upon entering the ramp. The reduction of speed is not conducive to efficient departure from the highway. The ramp is also a two-way road at its intersection with US 421. SR 1833 shares the intersection, thus creating the hazard of a vehicle entering I-95 in the wrong direction. In addition to smoothing out the exit ramps curve to provide a safer exit, SR 1833 will be cul-de- sac'd to eliminate the two-way intersection. A new intersection will be created between SR 1814 and US 421. The new proposed roadway, SR 2260 will provide ingress/egress for residential and commercial traffic to US 421. Currently, NCDOT does not possess sufficient right-of-way in the location of the intersection of SR 1814 and US 421. A car dealership is situated along both sides of SR 1814. With the presence of the car dealership at the intersection, there is no possibility to improve the intersection to current safety standards. Construction of this project will require impacts to waters of the United States in the Cape Fear River Basin. Crossing #1 conveys hydrology to an Unnamed tributary to Mingo Swamp (Class SwQ. The UT is within the 0303006 Hydrologic Unit. RESOURCE STATUS In general, there will be a minor impact as the result of the new location 3-lane roadway (includes left and right turn lanes) with an 80-foot Right-of-Way. The general area within the roadway corridor consists of a depressional wetland that is surrounded by roadway along two sides (US 421 and SR 1833) and an Automobile Dealership downstream of the proposed roadway. Extensive grading has occurred at the Automobile Dealership, and, it is suspected that the proper drainage design was not incorporated into the development. Hydrology was viewed to pond throughout the depressional wetland to a depth of 4"-6" until such time that it gets deep enough to flow into a drop inlet and is conveyed to an UT to Mingo Swamp which runs under US 421. Prior to conducting a field delineation of the site, a review of the Harnett County Soil Survey, and the National Wetland Inventory Map (Dunn, NC Quad) was completed. No jurisdictional areas were identified from the mapping. Lynchburg soils were mapped within the entire area. Lynchburg series consist of somewhat poorly drained, moderately permeable soils formed in loamy marine sediments. These soils are in shallow depressions, at the head of drainageways, and on broad divides. Due to the prolonged inundation, the soils lacked the typical Lynchburg characteristics. Several soil-sampling pits were excavated and the soil reviewed. A hue, value and chroma of l0YR 6/1 was observed with mottles. The soils were reduced with oxidation, thus hydric. Panicgrass, sedge, rush and smartweed dominated the vegetation with scattered cattails within the deeper water areas (+/- 8"). Black willow was dominant at the edge. With the vegetation being dominated by hydrophytes, hydric soils identified, and, wetland hydrology observed, the area was identified as a wetland (PEMIE). The Corps of Engineers (Richard Spencer) confirmed the wetland / upland boundaries in the field October 6, 2004. Endangered Species: Plants and animals with Federal classification of Endangered (E) or Threatened (T) are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of 1973, as amended. As of January 29, 2004, the U.S. Fish and Wildlife Service lists four federally protected species for Harnett County. A biological conclusion of "No Effect" was reached for all species during the July 9, 2004 survey for protected species. Protected species were not identified, nor, was the general habitat for each species identified. REGULATORY APPROVALS Application is hereby made for a Department of the Army Nationwide Permit 14 / NCDENR 401 WQC 3404 as required by the above-described activities. 0.10 acres of Non-Riverine Wetlands will be impacted as the result of the project. The project impacts are minor in nature and should not remove or degrade existing water quality uses. Pipe sizes proposed are the minimum necessary to create a safe highway while accommodating the 25-year design storm. By utilizing the erosion control measures, downstream water quality standards will be protected. All appropriate BMP's will be utilized during construction. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted Page 5 of 8 aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http:%11'u.c 1i stag,nc,us/t1c??ct.lan(lslst_nvgg1dc. fit III]. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreagellinear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Wetland mitigation will be obtained via the EEP.
