Director Division of Water Quality August 10, 2005 DWQ# 05-1203 Alexander County APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Holder: You have our approval, in accordance with the attached conditions and those listed below, to permanently 'impact 'l9 linear feet (If)-(4 If for-culvert extension, 5 If for a riprap energy dissipator, and 10 If for inlet/outlet stabilization using riprap) and temporarily impact 1.5 If (temporary cofferdam installation) of an unnamed tributary* to Middle Little River. The impacts are proposed in order to replace a deteriorating culvert as described in your application received by the Division of Water Quality (DWQ) on July 7, 2005. The location of the project is Highway 127 in Alexander County. After reviewing your application, we have determined that this project is covered by Water` Quality General Certification Numbers 3404 and 3366. 'these certifications correspond to 'Nationwide Permits 14-and 33 issued .by the'U.S. Army Corps of Engineers (USACE). Please note that you should get any otherfederal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and :Erosion Control, "Non-.Discharge, and Water Supply Watershed regulations. This approval will expire with the associated 404 permit unless otherwise specified in the Water Quality Certification. This approval 'is valid solely for the purpose and design that you described in your application (unless modified 'below). -Should your project change, you -must notify the'DWQ in writing and you may be required to submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A "NCAC 2H.0506 (h)(6) and (7). for this approval to remain valid, you must adhere to the conditions listed in the attached certification and those listed below: 1. Due to the steep grade at this location, DWQ will not require the burial of the culvert. in the streambed at the outlet end of the pipe. However„ the Tiprap energy dissipator ;proposed for the outlet end of the pipe shall be constructed as depicted in the application. The inlet end of the pipe must be placed below the elevation of the streambed by onefoot to allowfor lowflow;passage of water and aquatic life. All,structures:shall'be installed in such a manner that the original stream profiles are not altered (i.e., the depth of the channel must not be reduced by a widening of the •streambed). Design and placement of culverts and other structures including temporary erosion control measures shall be installed in such a mannerthat the original stream profiles :are not altered ;(i.e., the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (including pattern and profile) are to be maintained above and below locations of each culvert. The applicant maybe required to provide evidence that the equilibrium `has been maintained, if requested in writing by the DWQ. *No stream determination performed. Riprap must not interfere with thalweg performance and aquatic life passage during low flow conditions. 3. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full compliance with all specifications goveming the proper design, installation, and operation and maintenance of such BMP in order to protect surface water standards: a. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices :shall be :maintained on all construction sites, borrow pit sites, and waste pile (spoil) projects, including contractor-owned or leased :borrow pits associated with the project. b. For borrow pit sites, the erosion and sediment control ;measures ;must be designed,'installed, operated, -and maintained in accordance with -the most recent version of the :North Carolina Surface Mining Manual. c. The reclamation measures-and implementation of these measures must be in accordance with the requirements of the Sedimentation Pollution Control Act. 4. Heavyequipment:must be operated from the banks rather than in the stream channel, when possible, in order`to:minimize sedimentation and reduce he likelihood of introducing other pollutants into#he-stream. 6. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic conditions can:beprovided. 6. `No live-orfreshconcrete shall <come:intocontact with waters of the state until the concrete has hardened. -7. The'North,Carolina'Department of Transportation (NCDOT) and its contractors and/or agents shall not excavate, fill or perform mechanized land clearing at any time in the construction or-maintenance of this project within waters and/or wetlands, except as authorized by this Certification, or any modification to this Certification `(e.g., no work shall occur outside of the footprint of the plans provided). In addition, there shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this Certification without appropriate modification. If this occurs, compensatory mitigation may be required since it is a direct impact from road construction activities. s Page 3 13. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please include photographs upstream and downstream of the structure to document correct installation. 14. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state water quality standard (including any requirements for compliance with section 303(d) of the Clean Water Act] and any other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated .or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d)..Before codifying the certification, DWQ shall notify NCDOT and the USACE, provide public notice.in accordance with 15A NCAC 2H.0503, and provide opportunity for;.public ,hearing in-accordance with 15A NCAC 2H.0504. Any new or revised :conditions shall be wovided to NCDOT`in writing, shall be provided to the USACE for reference in any ,permit issued pursuant to'Section 404 of the Clean WaterAct, and shall also `become conditions of the 404 Permit forthe project. If you do :not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days .of the :date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. C. 28801-5006 SUBJECT: Pipe replacement, Highway 127, Alexander County Dear Mr. Lund: The North Carolina Department of Transportation proposes to replace a deteriorating pipe on Highway 127 in Alexander County. The existing pipe is beginning to collapse. Due to the pipe's location on a major highway with an ADT (Average Daily Traffic) of 4000, this pipe replacement is considered an emergency project and construction is to commence immediately. The existing 76- foot long, 30" CMP will be replaced with an 80-foot long, 48" CMP with inlet concrete headwall. A total of ten feet of riprap will be utilized at the pipe inlet and outlet for structure stabilization. The existing pipe is perched approximately 4 feet and the pipe is on an -3.5% slope. To completely hydraulically reconnect the upstream and downstream elevation would result in an extreme pipe slope (91/o); therefore, the pipe inlet will be buried one foot below streambed elevation and the pipe outlet will be placed on streambed grade. Due to the existing conditions, NCDOT requests a waiver from the Regional Condition 2(b)(e), permit depth specification, for the construction of this project. The pipe will still be at a 7% slope; therefore, a rock energy dissipater will be embedded into the streambed at the pipe outlet to prevent stream destabilization. The placement of rock in the streambed will not interfere with aquatic life passage. Temporary cofferdams and bypass piping will be used for stream management during construction. Upon project completion, the area impacted by the temporary cofferdams will be restored to pre-construction conditions. The scope of the work will result in a 9 feet of permanent fill impacts, 10 feet of riprap impacts from structure stabilization, and 15 feet of temporary impacts to the unnamed tributary to Middle Little River, which is classified as Class C waters by the Division of Water Quality. Highway 127 is considered a rural arterial; however, the proposed project is not located within /2 mile of any critical watershed area. Hazardous spill basins are not required. Enclosed is the NCDOT hazardous spill basin checklist. This office has conducted a GIS and field survey for this project and is recommending a finding of "no effect" for T &E species and historical structures. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north- arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. This will result in a -7% pipe slope Due to this slope, NCDOT feels it is necessM to provide riprW energy dissipation at the pipe outlet. VIII, Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of Page 5 of 9 aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. MITIGATION NOT ANTICIPATED 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP).
