Please find enclosed a PCN application from the North Carolina Department of Transportation for s a Nationwide 18 permit from the Army Corps of Engineers for the secondary road improvement project on SR 1318 A (Mintz Cemetary Rd.) in Brunswick County. The scope of the project will be to grade, drain, base and pave the 0.47 mile of existing unpaved road to current NCDOT secondary road standards of 20 ft of pavement and 6 ft of earthen shoulders to improve roadway safety and stability. IMPACTS TO WATERS OF THE UNITED STATES This project is located in the Lumber River Basin within USGS hydrologic unit 03040207 (subbasin 030759). Total impacts for this proposed project will consist of 20 linear feet (6.5 cubic yds. below normal water level) of perennial stream. These impacts, located at Sta. 17+82, are in conjunction with the replacement and extension of the existing 42' x 40 ft CMP to 60 ft. The additional 20-ft of length is required for the construction of the shoulders and to adjust the skew of the pipe with the inlet and outlet channels. This perennial stream, located at 33.9559630 N 78.4714612 W, is an unnamed tributary to Cool Run that is designated as CSw waters by the Division of Water Quality (DWQ). There are no wetland impacts associated with this project. You conducted a jurisdictional determination site visit on this project on December 8, 2004. Ken Averitte (DWQ) conducted a site visit on January 19, 2005. COMPENSATORY MITIGATION The Department has avoided and minimized impacts to jurisdictional resources to the greatest extent possible. As discussed at the 12/8/04-field meeting, no mitigation will be required for the remaining, unavoidable impacts to 20 linear feet of stream. 124 Division Drive, Wilmington, NC 28401 PHONE: (910)251-5724 FAX: (910) 251-5727 NATURAL AND HISTORIC RESOURCES FEDERALLY PROTECTED SPECIES Species with the federal classification of Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of 1973 as amended (16 U.S.C. 1531 et seq.). The United States Fish and Wildlife Service lists fifteen federally protected species for Brunswick County which include American alligator (Alligator mississippiensis), Red-cockaded woodpecker (Picoides borealis), Cooley's meadowrue (Thalictrum cooleyi) and Rough-leaved loosestrife (Lysimachia asperulaefolia). A G1S and field review has been conducted for these species and their habitat for this project and a determination of "No Effect" for the listed species is recommended. HISTORICAL RESOURCES Pursuant to Section 106 of the National Historic Preservation Act and the Advisory Council on Historic Preservations Regulations for Compliance with Section 106 codified at 296 CFR Part 800, this project has been reviewed and cleared for effects on historical and archeological resources (see attachment). REGULATORY APPROVAL Section 404 Permit: The Department of Transportation is requesting to proceed under Nationwide 18 as authorized by a Nationwide Permit (67 FR 2020; January 15, 2002). Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. Existing; roadbed is 24 ft shoulder point to shoulder point and will be built to standard secondary road typical of 20 ft of pavement and 6 ft earthen shoulders within the. acquired 50/60 ft of ROW. 11. Explain the purpose of the proposed work: To improve the existing secondary road by bringing it up to NCDOT standards' providing a better and safer road for residents, commuters and school buses that utilzed this facility. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. To minmize impacts shoulders slopes will be reduced to 3:1 at iurisdictional crossing. All wetlands or surface waters not affected by this project will be protected from unnecessary encroachment. Strict enforcement of sedimentation and and erosion control Bws will be enforced. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation. may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/stnngide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. The DM@rtment has avoided and minimized impacts to jurisdictional resources to the greatest extent possible as described above. SECRETARY In response to your request, based on the recommendations of the North Carolina State Historic Preservation Office (HPO), I surveyed the following secondary road projects in Brunswick County for historic architectural resources on March 3, 2004: SR 1318A - Mintz Cemetery Road, SR 1929 - Beachway Trail, and SR 1934 - Schyler Road. Neither the federal permit areas, nor the entire project areas contain any properties listed on or eligible for the National Register of Historic Places and, specifically, no properties built prior to 1955. The three projects thus are in compliance with North Carolina General' Statute 121-12(a) and Section 106 of the National Historic Preservation Act for historic architecture. The attached table summarizes architectural review for the above projects and eleven other secondary road projects you have submitted to the HPO during the. second half of 2004.
