The North Carolina Department of Transportation (NCDOT) proposes to replace Bridge No. 8 over Indiantown Creek at the Camden and Currituck County boundary (Figures 1 and 2). During construction, traffic will be detoured off-site using existing secondary roads. The existing structure was built in 1937, has a sufficiency rating of 45.3, and is structurally deficient. The superstructure is composed of a reinforced concrete deck on continuous I-beams. End bents and interior bents are timber caps on timber piles. The existing structure is 69.3 feet long and has a clear roadway width of 23.8 feet. The existing bridge will be removed in accordance with the NCDOT Best Management Practices for Bridge Demolition and Removal (BMP-BDR). The timber and steel components will be removed without dropping any components into Waters of the U.S. The recommended replacement structure is a three span bridge 110 feet in length with a clear roadway width of 30 feet. The approach roadway will hold the existing horizontal alignment and will be approximately the same elevation as the existing roadway. Deck and roadway drainage will be maintained by utilizing a minimum grade of 0.3 percent and a minimum cross-slope of 2.0 percent for the proposed structure and roadway approaches. Edenton, NC 27932 Page 2 November 19, 2004 Mr. Bill Biddlecombe, USACE Indiantown Creek is located within the Pasquotank River drainage, subbasin 03-01-54, and hydrologic unit 03010205. The North Carolina Division of Water Quality (NCDWQ) has designated a best usage classification for Indiantown Creek of "C; Sw" from its source to the North River confluence nearly three miles downstream of Bridge No. 8. There are currently no 303(d) impaired waters, high quality waters (HQW), outstanding resource waters (ORW), or drinking water supply waters (WS-1 and WS-II) within a one mile radius of the project study area. The proposed bridge replacement is a Case 2 demolition project as described by the NCDOT BXIP-BDR. The North Carolina Wildlife Resource Commission (NCWRC) states that anadromous species are found in this portion of Indiantown Creels, including alewife and blueback herring. A significant fishery for sunfish also exists at this site. NCDOT will follow all stream crossing guidelines for anadromous fish passage, including moratoriums on in-water work between February 15 and June 30. Permanent impacts to Waters of the U. S. include 115 square feet (0.003 acre) of fill in wetlands from the approach roadways being widened to conform to current design standards. Mechanized clearing adjacent to the roadway will not include grubbing or maintenance mowing, therefore any impacts from mechanized clearing will be temporary. Existing wood pilings will either be pulled out of the channel or cut flush with the substrate. Construction equipment will be operated from the existing road surface and/or upland areas and will not enter wetland areas. Measures will be taken to ensure that sediment releases from this activity will be contained to the immediate location of the pile removal operation. Jurisdictional wetlands are located immediately adjacent to the existing bridge (Figure 3). The United States Fish and Wildlife Service (USFWS) has identified one Endangered (E species (red-cockaded woodpecker), one Threatened due to Similarity of Appearance [T(S/A)] species (American alligator), and one Federal Species of Concern (FSC) as occurring in Camden County. In addition, the USFWS has identified three Endangered species (leatherback sea turtle, red-cockaded woodpecker, and West Indian manatee), three Threatened species (loggerhead sea turtle, piping plover, and seabeach amaranth), one Threatened (proposed for de-listing) (bald eagle), and three FSC as occurring in Currituck County. Suitable habitat for these listed species does not exist in the project study area. Therefore, it is reasonable to conclude that project construction will have No Effect on these protected species. We are proceeding with the understanding that the proposed actions are authorized under provisions of Nationwide Permit No. 3. We anticipate that 401 General Water Quality Certification No. 3376 will be authorized by the NCDWQ. The NCDOT will comply with all conditions of the 401 Water Quality Certification. Since this project lies within the jurisdiction of the Coastal Area Management Act (CAMA) due to the presence of public trust waters, which is an Area of Environmental Concern, we are concurrently applying for a CAMA General Permit. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. Describe the overall project in detail, including the type of equipment to be used: The existing structure is a 3-span 69.3 foot long bridge constructed of reinforced concrete deck on continuous I-beams End bents and interior bents are timber caps on timber piles. The existing bents and piles will be removed and new endbents will be poured on site. The recommended structure is a three-span. 1 l0-feet long cored slab bridge with concrete end bents and interior bents Traffic will be maintained using existing local roads for an off- site detour. Equipment to be used includes standard bridge construction equipment. See Plan View sheet 5 of 6 (attached) 11. Explain the purpose of the proposed work:_ The existing bridge has been given a sufficiency rating of 45.3 and is structurally deficient. The project will remove Bridge No. 8 over Indiantown Creek and replace with a new bridge structure on the existing location. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Expmples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://li2o.enr.state.nc.us/ncwetlands/strmcfide.litml. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Stormwater (required by DWQ) Describe impervious acreage (both existing and proposed) versus total acreage on the site. Discuss stormwater controls proposed in order to protect surface waters and wetlands downstream from the property. Existing impervious acreage totals approximately 0.20 acre and proposed impervious acreage totals approximately 0.25 acre of the total 1.4 acres on the site. The increase in impervious acreage is due to the longer bridge structure and wider roadway approach at the bridge site. There will be no deck drains funnel drains or drainage structures on this project. XII. Sewage Disposal (required by DWQ) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. XIII. Violations (required by DWQ) Is this site in violation of DWQ Wetland Rules (15A NCAC 2H .0500) or any Buffer Rules? Yes ? No Is this an after-the-fact permit application? Yes ? No XIV. Other Circumstances (Optional): It is the applicant's responsibility to submit the application sufficiently in advance of desired construction dates to allow processing time for these permits. However, an applicant may choose to list constraints associated with construction or sequencing that may impose limits on work schedules (e.g., draw-down schedules for lakes, dates associated with Endangered and Threatened Species, accessibility problems, or other issues outside of the applicant's control). The North Carolina Wildlife Resource Commission (NCWRC) states that anadromous species are found in this portion of Indiantown Creek including alewife and blueback herring. The site is also a significant fishery for sunfish striped bass white perch, yellow perch, and catfish. NCDOT must follow all stream crossing guidelines for anadromous fish passage, includinf, moratoriums on in-water work between February 15 to June 30. EASLEY GONTRINOR November 19, 2004 North Carolina Division of Coastal Management Elizabeth City Field Office 1367 US 17 South Elizabeth City, North Carolina 27909 ATTENTION: Ms. Lynn Mathis NCDOT Regulatory Project Manager LYNDO TIPPETT SECRETARY Subject: Application for CAMA General Permit for the proposed replacement of Bridge No. 8 on SR 1107 over Indiantowm Creek, Camden County, NCMA 1001, WBS Element No. 37474 Please accept this letter as a request for a Coastal Area Management Act (CAMA) General Permit for the above referenced project. The North Carolina Department of Transportation (NCDOT) proposes to replace Bridge No. 8 over Indianto"vn Creek at the Camden and Currituck County boundary (Figures 1 and 2). During construction, traffic will be detoured off-site using existing secondary roads. The existing structure, which was built in 1937 and has a sufficiency rating of 45.3, is structurally deficient. The superstructure is composed of a reinforced concrete deck on continuous I-beams. End bents and interior bents are timber caps on timber piles. The existing structure is 69.3 feet long and has a clear roadway width of 23.8 feet. The existing bridge will be removed in accordance with the NCDOT Best Management Practices for Bridge Demolition and Removal (BAIP-BDR). The timber and steel components will be removed without dropping any components into Waters of the U.S. -wt& Ito The recommended replacement structure is af?re?_span bridge 16 0 feet in length with a clear roadway width of 30 feet. The approach roadway will hold the existing horizontal alignment and roadway width. It will also be at approximately the same elevation as the existing roadway. Deck and roadway drainage will be maintained by utilizing a minimum grade of 0.3 percent and a minimum cross-slope of 2.0 percent for the proposed structure and roadway approaches. No deck drains, funnel drains, or drainage structures are included in the project. US Edenton, NC 27932 Page 2 November 19, 2004 Lynn Mathis, NCDCM Indiantown Creek is located within the Pasquotank River drainage, subbasin 03-01-54, and hydrologic unit 03010205. The North Carolina Division of Water Quality (NCDWQ) has designated a best usage classification for Indiantown Creek of "C; Sw" from its source to the North River confluence nearly three miles downstream of Bridge No. 8. There are currently no 303(d) impaired waters, high quality waters (HQW), outstanding resource waters (ORW), or drinking water supply waters (WS-I and WS-II) within a one mile radius of the project study area. The proposed bridge replacement is a Case 2 demolition project as described by the NCDOT BMP-BDR. The North Carolina Wildlife Resource Commission (NCWRC) states that anadromous species are found in this portion of Indiantown Creek, including alewife and blueback herring. A significant fishery for sunfish also exists at this site. NCDOT will follow all stream crossing guidelines for anadromous fish passage, including moratoriums on in-water work between February 15 and June 30. Permanent impacts to Waters of the U. S. include 115 square feet (0.003 acre) of fill in wetlands from the approach roadways being widened to conform to current design standards. Existing wood pilings will either be pulled out of the channel or cut flush with the substrate. Construction equipment will be operated from the existing road surface and/or upland areas and will not enter wetland areas. Measures will be taken to ensure that sediment releases from this activity will be contained to the immediate location of the pile removal operation. Jurisdictional wetlands are located immediately adjacent to the existing bridge (Figure 3). The United States Fish and Wildlife Service (USFWS) has identified one Endangered (E) species (red-cockaded woodpecker), one Threatened due to Similarity of Appearance [T(S/A)] species (American alligator), and one Federal Species of Concern (FSC) as occurring in Camden County. In addition, the USFWS has identified three Endangered species (leatherback sea turtle, red-cockaded woodpecker, and West Indian manatee), three Threatened species (loggerhead sea turtle, piping plover, and seabeach amaranth), one Threatened (proposed for de-listing) (bald eagle), and three FSC as occurring in Currituck County. Suitable habitat for these listed species does not exist in the project study area. Therefore, it is reasonable to conclude that project construction will have No Effect on these protected species. We are requesting that the proposed work be authorized under a CAMA General Permit. By copy of this letter we are also requesting issuance of a US Army Corps of Engineers Nationwide Permit 3. We also anticipate a 401 General Certification number 3371 will apply to this project; in compliance with Condition 1 of this certification we request written concurrence from the NC Division of Water Quality. ti ,. .
