The existing bridge is structurally deficient. The new single span bridge will be built using an off-site detour. There is a nice floodplain on the western side of the bridge. We are proposing to minimize the amount of fill on the floodplain by armor plating the fill on a 1.5:1 instead of using just soil on a 2:1. Most of this roadway fill armoring will be well away from the stream but the very bottom portion is probably within the 2-year high water mark at the outer edge of the floodplain so we are permitting it as an impact. All impacts associated with this bridge replacement are due to bank armoring. This project is almost identical to the recently permitted Bridge #37 in Watauga County. The existing bridge crosses Little Beaverdam Creek (Class: C, Trout). This project was reviewed for the presence of threatened and endangered species in April of 2011. The P. O. Box 250, N. Historic compliance work will be scheduled and concurrence with the State Historic Preservation Office will be obtained if required. The project impacts are not significant in nature and should not alter the best usage for this stream. All appropriate BMPs will be used during construction. Attached is a Preconstruction Notification Form, plan sheets, photographs, a marked county map and a marked topography map. By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with the North Carolina Wildlife Resources Commission comment directly to you concerning the 404 Nationwide Permit application with a copy sent to me. We will be requesting a trout buffer variance from stations 14+15 - 19+00. We would like to begin construction as soon as possible. If further information is required, please let me know. Biologists with the North Carolina Wildlife Resources Commission are familiar with habitat values in the area. These comments are provided in accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). The NCDOT project will span the creek without major fill in waters; however, riprap impacts to streambanks will constitute 180 linear feet. Rainbow trout are present throughout this stream basin. Based on our review of the submittal and our knowledge of area habitats, we will not object to the project as proposed providing stringent erosion control measures for sensitive watersheds are used. We will waive the trout moratorium for land disturbance within the 25-foot wide buffer zone during the rainbow trout spawning season of January 1 through April 15 if NCDOT implements stringent erosion control measures and avoids doing the work outside the growing season so that vegetation can be established. To the extent practicable, work done in the water should be avoided from January I through April 15.
