This project is part of a statewide initiative to upgrade the transportation infrastructure in rural areas. The primary elements included in this project will be to widen the road to meet current engineering and safety standards, bring the road to a uniform finished grade, and pave. The only impacts to jurisdictional areas will occur at crossings associated with two (2) separate unnamed tributaries of Yellow Marsh Branch. These features are shown as intermittent streams on the Wayne County Soil Survey. Widening the road and replacing the existing crossline pipes will result in 389.46 square feet of buffer impacts at Site 1. Similarly, there will be 4000 square feet of buffer impacts and 17 linear feet of permanent stream impacts at Site 2. These impacts are depicted in inserts attached to the permit drawings that accompany this application. NCDOT anticipates that this project will be authorized under a NWP 14. This application is also intended as a request for written authorization from the NC Division of Water Quality to proceed with a pipe replacement under General Water Quality Certificate # 3704 . The drainage features are approximated on the attached soil survey map as drainage features A and B. The Division of Water Quality (DWQ) concurs with the referenced documents regarding the following stream calls: Feature A: Ephemeral, Not subject to NBR. (*Within DOT right of way only---feature becomes intermittent approximately 44 feet south of SR 1128.) • Feature B, from SR 1128, southwards: Intermittent, Subject to NBR. • Feature B, from SR 1128, northwards: Ephemeral, Not subject to NBR. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffer, Waters of the United States, or Waters of the State. Any impacts to wetlands, streams and buffers must comply with the Neuse Buffer Rules, 404/401 regulations, water supply regulations (15A NCAC 2B .0216), and any other required federal, state and local regulations.
