Director Division of Water Quality December 21, 2006 DWQ# 06-1896 Iredell County APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Holder: You have our approval, in accordance with the attached conditions and those listed below, to permanently impact 75 linear feet (If) for riprap bank and pier protection and to temporarily impact 75 If (for temporary cofferdams) of the South Yadkin River under Bridge #327 as described in your application received by the Division of Water Quality (DWQ) on December 13, 2006. The location of the project is State Road 2156 (Church Lake Road) in Iredell County. After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3495. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. This approval is valid solely for the purpose and design that you described in your application (unless modified below) and will expire with the associated USACE 404 permit unless otherwise specified in the Water Quality Certification. Should your project change, you must notify the DWQ in writing and you may be required to submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h)(6) and (7). For this approval to remain valid, you must adhere to the conditions in the attached Certification and those listed below: 1. Riprap must not interfere with thalweg performance and aquatic life passage during low flow conditions. Riprap placed for bank stabilization should be limited to the stream bank below the high water mark and vegetation should be used for stabilization above the high water mark. 2. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 3. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic conditions can be provided. 4. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened. 5. The dimension, pattern and profile of the stream above and below the crossing should not be modified. Disturbed floodplains and streams should be restored to natural geomorphic conditions. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 7. All work shall be performed during low or normal flow conditions. 8. Discharging hydroseeding mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is strictly prohibited. 9. Erosion and sedimentation control measures, structures, and devices shall be planned, designed and constructed to provide protection from the runoff of the 25 year storm which produces the maximum peak rate of runoff as calculated according to procedures in the United States Department of Agricultural Soil Conservations Service's "National Engineering Field Manual for Conservation Practices" or according to procedures adopted by any other agency of this state or the United States or any generally recognized organization or association. 10. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within 30 days after the Division of Land Resources has released the project. 11. The North Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not excavate, fill or perform mechanized land clearing at any time in the construction or maintenance of this project within waters and/or wetlands, except as authorized by this Certification, or any modification to this Certification (e.g., no work shall occur outside of the footprint of the plans provided). In addition, there shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this Certification without appropriate modification. If this occurs, compensatory mitigation may be required since it is a .direct impact from road construction activities. 12. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please include photographs upstream and downstream of the structure to document correct installation. 13. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state water quality standard [including any requirements for compliance with section 303(d) of the Clean Water Act] and any other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify NCDOT and the USACE, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to NCDOT in writing, shall be provided to the USACE for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. The scope of the work will permanently impact 75 linear feet (<I cubic yard/running foot) of the jurisdictional waters associated with the South Yadkin River, which is classified as a WS-V Watershed by the Division of Water Quality. A reference cross-section was surveyed at a point -185 feet upstream of the bridge in order to determine the "normal" channel dimensions. The average stream width was determined to be -30-35 feet. The embankment under the bridge has scoured around the timber bridge piers; therefore, the placement of rock in the scoured areas at the bridge piers will provide stability and minimize future scour problems under the bridge. The rock stabilization will be placed along the embankment in such a way as to maintain average stream width. This office has conducted a GIS and field survey for this project and is recommending a finding of "no effect" for T &E species and historical structures. The proposed project is not located within 1/2 mile of the critical watershed area, nor is SR 2156 a rural or urban arterial; therefore, hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist. Impact Justification (Avoidance and Minimization) Expected pond surface area: Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The integrity of the bridge must be maintained for the safety of the travelling public. Rock stabilization is needed on the embankment under the bridge and around the bridge piers to provide stability and to minimize future scour problems. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in detennining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of Page 9 of 12 aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://ii2o.enr.state.nc.us/ncwetiands/strmgide.litml. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction.
