In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification as well as those listed below. Conditions of Certification: 1. All stormwater runoff shall be directed as sheetflow through stream buffers at nonerosive velocities, unless otherwise approved by this certification. 2. All riparian buffers impacted by the placement of temporary fill or clearing activities shall be restored to the preconstruction contours and revegated. Maintained buffers shall be permanently revegetated with non-woody species by the end of the growing season following completion of construction. For the purpose of this condition, maintained buffer areas are defined as areas within the transportation corridor that will be subject to regular DOT maintenance activities including mowing. The area with non-maintained buffers shall be permanently revegetated, with native woody species before the next growing season following completion of construction. 3. Pursuant to NCAC15A 2B.0233(6), sediment and erosion control devices shall not be placed in Zone 1 of any Neuse Buffer without prior approval by the NCDWQ. At this time, the NCDWQ has approved no sediment and erosion control devices in Zone 1, outside of the approved project impacts, anywhere on this project. Moreover, sediment and erosion control devices shall be allowed in Zone 2 of the buffers provided that Zone 1 is not compromised and that discharge is released as diffuse flow. 4. As stated in your application, the placement of the culvert in the stream shall be placed below the elevation of the streambed at the inlet to allow low flow passage of water and aquatic life. The outlet of the culvert will be placed as low as the topography will allow, and be stabilized. Design and placement of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium is being maintained if requested in writing by DWQ. 5. If multiple pipes or barrels are required, they should be designed to mimic natural stream cross section as closely as possible including pipes or barrels at flood plain elevation and/or sills where appropriate. Widening the stream channel should be avoided. Stream channel widening at the inlet or outlet end of structures typically decreases water velocity causing sediment deposition that requires increased maintenance and disrupts aquatic life passage. 6. Riprap should not be placed in the active thalweg channel or placed in the streambed in a manner that precludes aquatic life passage. Bioengineering boulders or structures should be properly designed, sized and installed. 7. If concrete is used during construction, a dry work area should be maintained to prevent direct contact between curing concrete and stream water. Water that inadvertently contacts uncured concrete should not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and fish kills. 8. During the construction of the project, no staging of equipment of any kind is permitted in waters of the U.S., or protected riparian buffers. 9. The dimension, pattern and profile of the stream above and below the crossing should not be modified. Disturbed floodplains and streams should be restored to natural geomorphic conditions. The use of rip-rap above the Normal High Water Mark shall be minimized. Any rip-rap placed for stream stabilization shall be placed in stream channels in such a manner that it does not impede aquatic life passage. 11. All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP measures from the most current version of NCDOT Construction and Maintenance Activities manual such as sandbags, rock berms, cofferdams and other diversion structures shall be used to prevent excavation in flowing water. 12. Heavy equipment shall be operated from the banks rather than in the stream channel in order to minimize sedimentation and reduce the introduction of other pollutants into the stream. 13. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 14. No rock, sand or other materials shall be dredged from the stream channel except where authorized by this certification. 15. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is prohibited. 16. The perniittee and its authorized agents shall conduct its activities in a manner consistent with State water quality standards (including any requirements resulting from compliance with §303(d) of the Clean Water Act) and any other appropriate requirements of State and Federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification. 17. A copy of this Water Quality Certification shall be posted on the construction site at all times. In addition, the Water Quality Certification and all subsequent modifications, if any, shall be maintained with the Division Engineer and the on-site project manager. 18. The outside buffer, wetland or water boundary located within the construction corridor approved by this authorization shall be clearly marked by highly visible fencing prior to any land disturbing activities. Impacts to areas within the fencing are prohibited unless otherwise authorized by this certification. 19. Upon completion of the project, the NCDOT Division Engineer shall complete and return the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. 20. Native riparian vegetation must be reestablished within the construction limits of the project by the end of the growing season following completion of construction. 21. There shall be no excavation from, or waste disposal into, jurisdictional wetlands or waters associated with this permit without appropriate modification. Should waste or borrow sites be located in wetlands or streams, compensatory mitigation will be required since that is a direct impact from road construction activities. 22. Sediment and erosion control measures shall not be placed in wetlands or waters unless otherwise approved by this Certification. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored upon completion of the project. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Heavy rains associated with Tropical Storm Alberto on June 14, 2006 (and repeat heavy rains on 07/05106) have resulted in damage to an existing structure conveying an unnamed tributary to Bear Swamp Creek on SR 1235 (Dyking Road) in Franklin County. The existing pipe is undersized and has separated. Joint separation has caused the roadway surface to collapse and shoulder failure above the outlet. The North Carolina Department of Transportation (NCDOT) proposes to replace this structure and to repair the associated roadway shoulder (Figures 1 - 3). Impacts to Waters of the United States The project crosses an intermittent stream, UT to Bear Swamp Creek, [NCDENR-DWQ Index No. 28-23, Best Usage Classification WS-IV NSW; HUC 03020101] in the Tar- Pamlico River Basin. The existing structure that conveys the creek is a 48-inch reinforced concrete pipe that is 52 feet long (see Photographs 1-2). This existing structure is undersized and has disconnected. Please note that the topographic characteristics at this site resemble those of a mountain stream crossing. There is an approximate munty feet difference in elevation from the stream bed above the inlet to a point forty two feet downstream of the pipe outlet where the streant bed becomes evident again at the woods lute. Benveen the pipe outlet and the woodsline the strearn finds it's tivav downhill amongst large holders and existing rip rap. The NCDorproposes replace this pipe at the existing grade (buried on the inlet), but it is not possible to have this pipe buried on the outlet end. Additionally, all stone within the `stream channel' downstream of the pipe outlet will be left in place to maintain stability of this stream segment. The NCDOT proposes to. replace the existing structure with a larger pipe to be sized by our Hydraulics Unit. The replacement pipe will be 60 feet long. During the construction of the project, the NCDOT proposes to temporarily dewater the work zone for approximately 1 week. This will involve the temporary placement of an impervious dike 17 feet upstream and 42 feet downstream of construction. The distance to the impervious dike downstream is required, as there is no spot prior to this at which to could capture the Division 5,2612 N. To maintain water flow during construction, water upstream of construction will be temporarily pumped out by a hose and conveyed downstream of the construction activity where it will be allowed to filter through vegetation before flowing into the stream. Any effluent from the work area will be pumped into a prefabricated silt bag allowing water to slowly filter out of the bag in a dispersed matter and the sediment to be captured in the bas. Once the stream has been dewatered, the pipe will be replaced. The materials used for dewatering will be removed after construction Permanent impacts at the site associated with the replacement of the structure involve a total of 8 feet of surface water fill and 20 feet of rip rap placed along the streambanl: to protect the structure. Temporary concurrent impacts will include the dewatering of 28 feet of stream, plus an additional 31 feet dewatering due to circumstances listed above. Riparian Buffer The maintenance at this site involves a road crossing of a stream that is subject to the Tar-Pamlico River Buffer Rules. This intermittent tributary to Bear Swamp Creek is depicted on the most recent version of the Ingleside (USGS 1979) topographic quadrangle (Figure 1) and the Soil Survey of Franklin County (USDA-SCS, 2001) (Figure 2). Construction impacts at this site total 1,671 f Z in Zone 1 and 1,128 ft` in Gone 2 (totaling 28 lfl of riparian buffer impacts). The placement of the impervious dike forty- two feet downstream of the pipe will not result in additional disturbance within the riparian buffer zones. Based on the impacts to the riparian buffer at this site, this crossing is EXEMPT. Waters of the U.S. Mitigation Avoidance: All wetlands and surface waters not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Minimization: The side slopes have been steepened to the extent possible at jurisdictional sites. Strict enforcement of sedimentation and erosion control Best Management Practices for the protection of wetlands and surface waters will be enforced during project construction. Continued coordination will occur with maintenance forces and the Environmental Officer during construction to minimize impacts to these sites. Compensatory Miti ate All compensatory mitigation requirements will be left to the discretion of the regulatory review agencies. Protected Species plants and animals with federal classifications of Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the ESA. As of July 2006, there are three federally protected species listed for Franklin County. They include dwarf wedgemussel (Alasmidonta heterodon), Tar spinyinussel (Elliptio steinstansana), and Michaux's sumac (Rhus michautxii). The roadway shoulders along Dyking Road are heavily maintained, eliminating the possibility for Michaux's sumac to exist in this area. Additionally, a review of the Natural Heritage Program database (last updated April 2006) revealed no occurrences of protected species within the project area. Therefore, based on lack of suitable habitat observed during the 07/11/06 site visit and the NHP database review, biological conclusions of No Effect have been rendered for each species. Summary The NCDOT proposes to replace the existing structure with larger sized pipe. Permanent impacts at the site associated with the replacement of the structure involve a total of 8 feet of surface water fill and 20 feet of rip rap placed along the streambanks to protect the structure. The work zone will be dewatered for approximately 1 week. Temporary concurrent impacts will include the dewatering of 28 feet of stream, plus an additional 31 feet dewatering due to site conditions described previously. The materials used for dewatering will be removed after construction. Based on the impacts to the riparian buffer at this site, this crossing is EXEMPT for requiring a written buffer authorization. Application is hereby made for a Department of the Army Section 404 Nationwide Permit (NWP) 3, NWP 33, and NCDENR-DWQ Section 401 Water Quality Certification (WQC) No. 3494 and WQC No. 3366 for above-described activities. Explain the purpose of the proposed work: Heavy rains associated with Tro ical Storm Alberto on June 14, 2006 caused heavy rains in the area of this cross line resulting in a disconnected nine and failed roadway shoulder. This site was not identified until after repeat heavy rains last Wednesday (07/05/06) and pavement above the pipe is collapsing.
