Hamilton, Executive Director TO: Steve Lund, USACOE Asheville Field Office FROM: Ron Linville, Regional Coordinator ZW Y 2 6 2006 MA Habitat Conservation Program DENR - WATER QUALITY DATE: May 19, 2006 WETLANDS 00 ST61,$M10-ER BRANCH SUBJECT: North Carolina Department of Transportation (NCDOT), SRI 369, Nelda Road, Unnamed Tributary Long Creek, Gaston County NCDOT proposes to replace an existing culvert with a new culvert. Biologists with the North Carolina Wildlife Resources Commission are familiar with habitat values in the area. These comments are provided in accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the North Carolina Environmental Policy Act (G.S. 113A-1 through 113A-10; NCAC 25). Removal of the existing bridge will not impact waters. The project will replace a deteriorating 50-foot, 60" CMP with a new 60-foot, 95" x 67" CMPA. The existing pipe is perched approximately three (3) feet. The "normal" stream channel is indicated to be approximately four (4) feet wide and perennial. NCDOT proposes to install the CMPA with inlet headwall and associated riprap for stabilization and maintain the perched condition while providing a five (5) foot rock ladder to facilitate some aquatic passage due to an indicated pipe slope of about six (6) percent. Temporary pumping or bypass piping will facilitate working in the dry. Waters in the general area support warm water fish species and other aquatic species. Based on our review of the project submittal, we will not object to the project providing the following conditions are implemented to the extent practicable: Culverts 48 inches diameter or larger should be buried a foot into the streambed. Culverts less than 48 inches diameter should be buried to a depth equal to or greater than 20% their size to allow for aquatic life passage. These measurements must be based on natural thalweg depths. If fish are present in this perennial stream and substantial stream habitats are present upstream of the culvert, NCDOT should provide stream connectivity and aquatic passage suitable for warm water fishes. Should slopes be too steep, baffles should be provided within the culvert to prevent sluicing upstream and to prevent scouring downstream. If fish are not present in the area, the proposed rock ladder will be acceptable providing it maintains stream dimensions useful for aquatic life passage. Mailing Address: Division of Inland Fisheries - 1721 Mail Service Center - Raleigh, NC 27699-1721 Telephone: (919) 707-0220 - Fax: (919) 707-0028 'A SRI 369, Nelda Road -Page 2 - May 19, 2006 3. The dimension, pattern, and profile of the stream above and below the crossing should not be modified by widening the stream channel or reducing the depth of the stream. 4. Any riprap used must not interfere with aquatic life passage during low flow conditions. 5. If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. 6. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 7. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. 8. Temporary or permanent herbaceous vegetation should be planted on all bare soil within fifteen (15) days of ground disturbing activities to provide long-term erosion control. We encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization when practicable. Thank you for the opportunity to review and comment on this project during the early planning stages. If you have any questions regarding these comments, please contact me at 336/769-9453. May 31, 2006 DWQ# 06-0821 Gaston County APPROVAUMODIFICATION of 401 Water Quality Certification with Additional Conditions Dear Mr. Holder: You have our approval, in accordance with the attached conditions and those listed below, to permanently impact 20 linear feet (If) (for culvert extension and installation of a rock ladder) and to temporarily impact 15 If (for a temporary cofferdam) of an unnamed tributary to Long Creek` to replace an existing, deteriorating culvert as described in your application received by the Division of Water Quality (DWQ) on May 18, 2006. The location of the project is State Road 1369 (Nelda Road) in Gaston County. After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3404. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. This approval is valid solely for the purpose and design that you described in your application (unless modified below) and will expire with the associated USACE 404 permit unless otherwise specified in the Water Quality Certification. Should your project change, you must notify the DWQ in writing and you may be required to submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h)(6) and (7). For this approval to remain valid, you must adhere to the conditions in the attached certification and those listed below: The rock ladder at the outlet of the culvert shall be constructed as depicted in the application and shall be installed in such a manner that the original stream profiles are not altered. DWQ will require the presence of the NCDOT Division Environmental Officer or Environmental Specialist during the construction of the rock ladder. The structure shall be designed and installed to allow for wildlife movement as well as prevent headcutting of the stream. The inlet end of the pipe must be placed below the elevation of the streambed by one foot to allow for low flow passage of water and aquatic life. All structures shall be installed in such a manner that the original stream profiles are not altered (i.e., the depth of the channel must not be reduced by a widening of the streambed). Design and placement of culverts and other structures including temporary erosion control measures shall be installed in such a manner that the original stream profiles are not altered (i.e., the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (including pattern and profile) are to be maintained above and below locations of each culvert. The applicant may be required to provide evidence that the equilibrium has been maintained, if requested in writing by the DWQ. Riprap must not interfere with thalweg performance and aquatic life passage during low flow conditions. Riprap placed for bank stabilization should be limited to the stream bank below the high water mark and vegetation should be used for stabilization above the high water mark. 3. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 4. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic conditions can be provided. 5. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened. 6. The dimension, pattern and profile of the stream above and below the crossing should not be modified. Disturbed floodplains and streams should be restored to natural geomorphic conditions. 7. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 8. All work shall be performed during low or normal flow conditions. 9. Discharging hydroseeding mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is strictly prohibited. 10. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full compliance with all specifications governing the proper design, installation, and operation and maintenance of such BMP in order to protect surface water standards: a. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow pit sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. b. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. c. The reclamation measures and implementation of these measures must be in accordance with the requirements of the Sedimentation Pollution Control Act. 11. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within 30 days after the Division of Land Resources has released the project. 12. The North Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not excavate, fill or perform mechanized land clearing at any time in the construction or maintenance of this project within waters and/or wetlands, except as authorized by this Certification, or any modification to this Certification (e.g., no work shall occur outside of the footprint of the plans provided). In addition, there shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this Certification without appropriate modification. If this occurs, compensatory mitigation may be required since it is a direct impact from road construction activities. 13. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please include photographs upstream and downstream of the structure to document correct installation. r Page 3 14. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state water quality standard [including any requirements for compliance with section 303(d) of the Clean Water Act] and any other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify NCDOT and the USACE, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to NCDOT in writing, shall be provided to the USACE for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone Polly Lespinasse in the Mooresville Regional Office at 704-663- 1699. Sincerely, for Alan W. Klimek, P. E. EASLEY DIVISION OF HIGHWAYS GOVERNOR May 15, 2006 Mr. Steve Lund US Army Corp of Engineers Asheville Regulatory Field Office 151 Patton Avenue, Room 208 Asheville, N. C. 28801-5006 SUBJECT: Dear Mr. Lund: LYNDO TIPPETT SECRETARY 060821 Pipe replacement on SR 1369 (Nelda Road), Gaston County The North Carolina Department of Transportation proposes to replace a deteriorating pipe on SR 1369 in Gaston County. An existing 50-foot, 60" CMP will be replaced with a 60-foot, 95" x 67" CMPA with inlet headwall and associated riprap for structure stabilization. The "normal" stream channel dimensions are approximately 4 feet; therefore, the riprap will also be utilized to maintain the normal stream dimensions at the inlet. The existing pipe is perched -3 feet at the outlet. Reconnecting the upstream and downstream elevations would result in a pipe slope of -6%; therefore, the proposed pipe inlet will be buried one foot below the streambed elevation and the pipe outlet will remain perched. A 5-foot rock ladder will be constructed at the outlet to facilitate some aquatic passage. Due to the existing site conditions, NCDOT requests a waiver from the Regional Condition 2(b)(e) permit depth specification, for the construction of this project. Temporary cofferdams and/or bypass piping will be utilized for stream management during the pipe replacement. Upon project completion, the area impacted by the temporary cofferdam will be restored to pre-project conditions. The total scope of the work will result in a 20 feet of permanent impacts and 15 feet of temporary impacts to an unnamed tributary to Long Creek, which is classified as Class C waters by the Division of Water Quality. Please note that a recent disturbance has occurred at the existing pipe inlet, which appears to be a utility line crossing. The project is not located within '/z mile of any critical watershed area nor is SR 1369 a rural or urban arterial; therefore, hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist. This office has conducted a GIS and field survey for the project and is recommending a finding of "no effect" for T&E species and historical structures. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. There is minimal increase in pipe length to provide adequate road shoulder width. Burying the pipe outlet below streambed elevation would result in apipe slope of -6%, which could result in stream headcutting upstream or scourhole formation downstream. Due to the existing perched pipe condition site the new pipe will remain perched at outlet to prevent destabilization and a rock ladder will be constructed to facilitate some aquatic passage. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration Page 5 of 8 in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. MITIGATION NOT ANTICIPATED. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. For additional information regarding the application process for the NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htm.
