Dear Ms. Hair: The North Carolina Department of Transportation (NCDOT) proposes to replace Bridge 9358 and two pipes in conjunction with a secondary road paving project on SR 2107 (Tom Lauren Road) in fredell County. NCDOT requests authorization to replace at Site I an existing timber bridge with a 60-foot long, 112' x 75' CMPA, at Site 2 a 36-foot long, 60 CMP with a 95" x 67^ CMPA, and at Site 3 a 30-foot, 24^ CMP with an 36-foot long, 36" RCP. Ten feet of riprap will be used at each site for inlet and outlet structure stabilization. At Site 2, the proposed pipe will be placed upon -5% slope: therefore it is proposed to place the pipe at existing streambed elevation to prevent upstream destabilization. The existing pipe is perched and a scourhole has formed at the outlet. The outlet invert of the new pipe will be placed at the streambed elevation past the existing scourhole: however, the new pipe will remain slightly perched; therefore, a.short rock ladder will be constructed to connect the pipe invert %%ith the downstream bed elevation. Additionally, the existing outlet scourhole will be armored with riprap for energy dissipation. At Site 3, the stream is an intermittent channel, the point of jurisdiction appears to be located immediately upstream of the existing pipe; however, there is a steep drainage upslope of the pipe. Therefore, new pipe will be placed at the existing streambed elevation to prevent upstream headcutting. Due to these site conditions at Site 2 and Site 3, NCDOT requests a waiver from the Regional Conditions 2(b) (e) permit depth specifications. A temporary cofferdam pumping system will be used to divert the stream around the construction sites as needed. Any areas affected by temporary cofferdam system will be graded and restored back to pre-project conditions. The scope of the work will permanently impact 70 linear feet of DOtc11111ans Creek (Site 1), 25 linear feet of an unnamed tributary to DUtchmans Creek (Site 2), and 16 linear feet to a second unnamed tributary to Dutchmans Creek (Site 3), which is classified as Class B Waters by the Division of Water Quality. No wetland or high quality waters will be impacted by the project. No sites listed on the National Register of Historic Places are located in the vicinity of the project nor did there appear to be any eligible structures. The State Historic Preservation Office has reviewed the project area and provided a finding of "No Historic Properties Affected" (2/4/08. ER Number 08-0076). The federally listed species for Iredell County (USFWS list dated 9/22/10) include the bog turtle (Clenmys muhlenbergii) Threatened due to Similarity of Appearance (f S/A). and the dwarf-Flowered heartleaf (Hernslrlis nanioiw)- Threatened. National Ieritage Program records document the nearest bog turtle location approximately 10.5 miles southwest of the proposed project area. Bog turtles are usually found in bogs„marshes. and wet pastures. There is no suitable habitat located within the project area and,-no,, species were observed. T/SA species are not subject to Section 7 consultation; however, no impact on this species is anticipated. National Heritage Program records document the nearest Dwarf-Flowered heartleaf location approximately 33 miles southwest of the proposed project area in Catawba County. The heartleaf is usually found on dry to moist ravine slopes (usually north facing and of the oak-hickory-pine forest type) and in boggy areas near springheads. There is little suitable habitat within the proposed project area and no species were observed. The project area is not located within 'L mile of any critical watershed area, nor is SR 2107 a rural or urban arterial; therefore, hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist. I have enclosed a pre-construction notification for a NW914, sketches of planned activities and location maps. relative to the project. Explain the purpose of the proposed project: The purpose of the proposed work is to replace deteriorating pipes and bridge and to bring the road section u road standards for the safety of the travelling public p to paved . 3e. Describe the overall project in detail, including the type of equipment to be used: NCDOT proposes to replace a deteriorating bridge with a 60-ft, 112" x 75" CMPA at site 1. Ten feet of riprap will be used at the pipe inlet and outlet for structure stabilization. At site 2, a 36-ft, 60" CMP will be replaced with a 50-ft, 95' X 67' CMPA. Ten feet of riprap will be used at the inlet and outlet for structure stabilization. Due to the proposed slope of the new pipe (-5%), the pipe will not be buried and will be placed at the existing streambed elevation (outlet elevation based upon streambed past an existing outlet scourhole). Additionally, a short rock ladder will be constructed to connect the invert elevation and the bed elevation and the scourhole will be armored with rock for energy dissipation. At site 3, a 30- ft, 24" CMP will be replaced with a 36-ft, 36" RCP. The stream is an intermittent channel where the point of jurisdiction appears to be located immediately upstream of the existing pipe, however, there is a steep drainage upslope of the pipe.
