Also, the project was issued prior to the Jordan Buffer Rules .... and in my view, this minor change will not trigger them to be in effect here. NCDENR-DWQ Project No.: 20081326 Eric and Rob, A construction issue has come up on this project that requires your attention. The plans indicate the following near 41+20 to 42+20 Lt: 1. Installation of a small rip rap pad at the outlet of a 24 inch pipe structure 2. Construction of a shallow lateral base ditch at the pipe outlet at a 90 degree angle. This is clearly indicated on the attached plan sheet. However, note that the limits of the pond/stream edge are not accurately depicted on the plan sheet. Discussions with the RE and ARE indicate that there will be a very high potential for the back slope of the ditch failing over time due to the high amount of runoff that is moved through the pipe system. There is no real way to turn the runoff from the pipe at a 90 degree angle and provide adequate stability to the back slope of the ditch directly adjacent to the pond/stream edge. The RE suggests to stabilize the area by open cutting the ground at the pipe outlet and then outlet directly to the pond/stream edge. Note that Class II rip rap would be installed countersunk in the flow line of the pipe at the pond/stream edge and a small amount of rip rap would be installed on the adjacent pond/stream edge for stability. This is approximately depicted on the two attachments. This proposed action will result in approximately 30 linear feet of new permanent fill impacts to the pond/stream edge. Note that this project is located in the Cape Fear River Basin/Jordan Lake Watershed. However, the project was never designed to comply with the new Cape Fear buffer rules due to the age of the design. We have discussed this issue for several months, to come up with some type of alternative that would avoid impacts to the pond/stream edge. Unfortunately, we can not come up with another option, primarily due to the location of the pond/stream at the pipe outlet.
