Dear Messrs Campau & Carpenter:

On November 17, 2010, the Division of Water Quality (DWQ) received your CAMA application
to install four "jet-dock" floating platforms within the existing slips of the community docking
facility. On January 7, 2011, the DWQ received additional information in the form of a letter
from Mr. Campau. However, the DWQ has not received any information that would address the
concerns listed in out December 17, 2010 request for additional information. Additionally, it
does not appear that the concerns mentioned by the Division of Marine Fisheries (DMF) or the
Wildlife Resources Commission (WRC) have been resolved either (see attached letters).
Given the fact that the concerns of the DMF, the WRC, and the DWQ have not been addressed,
the DWQ has determined that the project as proposed would have the potential to cause a
significant adverse impact to the surrounding PNA and would violate Tidal Salt Water Quality
Standards for Class SA Waters (15A NCAC 02B .0221 (2)), "Conditions Related to Best
Usage: waters shall meet the current sanitary and bacteriological standards as adopted by the
Commission for Health Services and shall be suitable for shellfish culture. Any source of water
pollution which precludes any of these uses, including their functioning as PNAs, on either a
short-term or long-term basis shall be considered to be violating a water quality standard."
Therefore unless modifications of the proposal are made to alleviate the concerns of the DWQ,
the DMF, and the WRC, we will recommend moving towards denial of your application as
required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we
receive this additional information. Please revise the proposal to alleviate the concerns
mentioned by the DMF, and the WRC.
Please respond within thirty days of the date of this letter by sending this information to me in

longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your
