GOVERNOR November 9. 2010 Ms. Lori Beckwith, NCDOT Regulatory Project Manager U.S. Army Corps of Engineers 151 Patton Avenue, Room 208 Asheville, NC 28801-2714 Subject: Nationwide 14 Permit Application SECRETARY 1Go SR 1323 Slope Street Swain County TIP No. R-5118 State Project No.: 42550.1.1 (DWQ Minor Permit Fee $240) Dear Ms. Beckwith: The North Carolina Department of Transportation (NCDOT) is proposing to widen SR 1323, Slope Street/Franklin Grove Church Road, in Swain County from 17.5 feet to 20 feet. The project includes the addition of curb and gutter and improved drainage to facilitate construction of a sidewalk. In order to accomplish this work, it will be necessary to extend one double-barrel metal culvert in Bryson Branch (Class C) on the inlet end of the existing pipe. The proposed improvement has been identified as a necessary maintenance and safety improvement. Funds have been allocated for this project with the project scheduled for letting in January of 2011. I am sending plans for the pipe culvert replacement as well as a marked county map, USGS quad map and photographs. We propose to install the new culvert slightly below the existing streambed elevation where bedrock is not encountered to minimize impacts to aquatic habitats and allow the existing stream gradient to remain as unchanged as physically possible. The North Carolina Natural Heritage Database was checked for records of threatened and endangered species. There are no records of threatened or endangered species for Bryson Branch. Bryson Branch is small, approximately 3 feet in width, and does not have sufficient flow to support mussels and fish habitat is limited. There are records for the Appalachian elktoe (Alasmidonta raveneliana) in the Tuckasegee River, approximately 3600 feet downstream of the culvert site. The impacts from the culvert extension should be minimal. The overall project is limited in scope and consists of widening the road by 2.5 feet and installing curb and gutter and improving drainage to facilitate the installation of a sidewalk. Best management practices will reduce the potential for impact from sedimentation. Due to the proximity of the Appalachian elktoe to the project, we believe the project "may effect but is not likely to adversely effect" this species. The old headwall will be removed and the trench prepared so pipe extensions and new headwall can be installed. The dike and flow diversion will be removed to restore flow through the extended culverts. The road surface will be widened 2.5 feet and curb and gutter and a sidewalk will be installed.
