Re: Individual Section 401 Permit for Improvements to US 17 from South of SR 1127 (Possum Track Road) to
North of SR 1418 (Roberson Road). Beaufort County. DWQ No. 050785, TIP No. R-2510.
Dear Dr. Thorpe:
The Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project. Review of your application revealed it lacking necessary information required for making
an informed permit decision. The permit application was deficient in the following areas:
• No mitigation plan was provided for impacts to streams, wetlands, or buffers. The EEP letter dated April 29,
2005 states, "The EEP will agree to accept the stream and wetland mitigation responsibilities for this project
provided by the 404, 401, and/or CAMA permits are not issued prior to July 23, 2006." Because the permit
application was received on May 05, 2005, the permit for this project would be issued prior to July 23,
2006.Therfore, no viable mitigation plan was submitted with your application.
Pursuant to 15A NCAC 2H .0507(a)(5), we are returning your permit application. When you have developed an
appropriate mitigation plan, please reapply and we will process your application as expeditiously as possible.
