The NC Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the aforementioned project. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: • NCDOT shall be listed as the co-applicant on the PCN (letter A nos. 3 and 4). A separate name, address, and phone number needs to be listed for NCDOT, under both owner and applicant. • The crossing is subject to the Jordan Buffer Rules. Please include impacts in the PCN (letter C no. 6). Also, please discuss the diffuse flow plan (letter E, no. 1). • The US Army Corps of Engineers has determined that this project and the Arrowhead Subdivision project (Action Identification Number: SAW-2007-0270) are a single and complete project. Given this information, impacts from both projects total 161. Please reduce the impacts below 150 feet or provide mitigation for 161 linear feet of impacts. • Provide a restoration plan for stream that will be daylighted. If this restoration plan is to provide on- site mitigation for the 17.9 feet, then natural channel design will be required. Therefore, pursuant to 15A NCAC 2H.0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. You have 30 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 30 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
