Sullins Dee Freeman Governor Director Secretary December 17, 2010 Joshua's Landing POA Mr. Frederick Campau Mr. Larry Carpenter 6021 Joshua's Landing Lane Wilmington NC 28409 Subject Property: Joshua's Landing POA REQUEST FOR MORE INFORMATION Dear Messrs Campau & Carpenter: DWQ Project # 97-0947v2 New Hanover County On November 17, 2010, the Division of Water Quality (DWQ) received your CAMA application to install four "jet-dock" floating platforms within the existing slips of the community docking facility. The proposed project is located within an area that has been designated by the Division of Marine Fisheries (DMF) as a Primary Nursery Area (PNA) and has very shallow water depths at mean low water. Given this fact and after reviewing the comments provided from the DMF and the Wildlife Resources Commission (WRC), the DWQ has determined that the project as proposed would have the potential to cause a significant adverse impact to the surrounding PNA and would violate Tidal Salt Water Quality Standards for Class SA Waters (15A NCAC 02B .0221 (2)), "Conditions Related to Best Usage: waters shall meet the current sanitary and bacteriological standards as adopted by the Commission for Health Services and shall be suitable for shellfish culture. Any source of water pollution which precludes any of these uses, including their functioning as PNAs, on either a short-term or long-term basis shall be considered to be violating a water quality standard." Therefore unless modifications of the proposal are made to alleviate the concerns of the DWQ, the DMF, and the WRC, we will recommend moving towards denial of your application as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional information. Please revise the proposal to alleviate the concerns mentioned by the NCDMF, and the North Carolina Wildlife Resources Commission (NCWRC). Please respond within thirty days of the date of this letter by sending this information to me in writing and Ian McMillan of the 401 Oversight/Express Review Permitting Unit.
