Dear Ms. Waddell:
Reference the Department of the Army permit issued on February 17, 2010 and the written
request submitted by Ron Ferrell of PBS&J on your behalf. The issued permit authorized you to
impact 9.1 acres of jurisdictional wetlands and 394 linear feet of stream associated with
construction of a 5.66 mile long railroad spur in and adjacent to the existing North Carolina Global
TransPark located north of US Highway 70 and west of NC Highway 58 adjacent to Stonyton
Creek and Briery Run north and west of Kinston in Lenoir, North Carolina. On October 20, 2009
we conducted an onsite analysis of an area within the GTP boundary that was identified as
wetland. As a result of this analysis, we determined that 2.29 acres that were called wetland are not
jurisdictional wetlands. The reduction in jurisdictional area was not reflected in the issued permit.
Therefore, the permit has been modified to authorize impacts to 6.81 acres of jurisdictional
wetlands.
In addition, on July 29, 2010, Mr. Ferrell submitted a request for permit modification to
authorize additional impacts associated with the installation and relocation of utility lines
associated with the construction of the permitted Rail Access Spur to Global TransPark. As
proposed, utility line relocation would require impacts to an additional 4,960 square feet of
jurisdictional waters and wetlands. Review of the enclosed drawings and discussion at on-site
meetings indicates that the proposed impacts are unavoidable. Therefore, the permit has been
modified to allow relocation and installation of utility lines within and outside of the existing
permitted right-of-way for the rail spur, as shown on the plats titled, NCGTP Rail Access Stream
and Wetland Impacts Site 3 &3B, Site 7B and 7C, Site 12, Sites 14A, 14B, &14C, and Site 15, dated
July 30, 2010. Any change in alignment or increase in impact amount will require further
modification of this permit. It is understood that all conditions of the original permit remain
applicable and that the expiration date is unchanged.
