Joshua's Landing Property Owners Association Page 2 9.PROJECT DESCRIPTION The project area is located on Hewlett's Creek, off Greenville Loop Road and Leeward Lane, in Wilmington, New Hanover County. The applicant is the Property Owners Association of the subdivision called Joshua's Landing. The highground consists of the grassed yard area with scattered Live Oaks throughout the subdivision. A paved access road has been constructed which terminates in a cul-de-sac approximately 300 feet from the creek. There is a common easement between the two waterfront lots to allow water access for the inland property owners. The subdivision has approximately 240 feet of shoreline frontage. Along the shoreline there is a border of Smooth Cordgrass (Spartina alterniflora) approximately 80-120 feet wide. As this inter-tidal marsh transitions to uplands, other coastal wetland species include: Black Needle-rush (Juncus roemarianus), Salt Meadow Grass S artina patens), and Sawgrass (Cladium jamaicense). Marsh-Elder and Wax Myrtle shrubs complete the transition to upland plant species. Waterward of the vegetated coastal wetland border, there are extensive mud flats, marsh islands, and oyster rock. In 1997 the subdivision developer Charles Runyon, proposed to construct three (3) piers to provide water/boating access to the new subdivision's property owners. A water access easement was established between the two waterfront lots (Lot 4 and Lot 5) and along the highground adjacent to the shoreline of Hewlett's Creek. Three small piers were proposed to try and maintain the single-family residential character of the area. The applicant received CAMA Major Permit #167-97 on December 31, 1997 authorizing three (3) piers extending from the common water access easement between Lots 4 and 5 and along the shoreline. The three piers were constructed in accordance with State Permit #167-97. The owners of Lot 4 and Lot 5 purchased the easement area located between their properties and the shoreline of Hewlett's Creek from the Joshua's Landing POA while maintaining the easement between the lots to the central docking facility. The piers located adjacent to Lot 4 and Lot 5 were also purchased from the POA and the property owners were given exclusive rights to the piers located on their properties (see submitted property deeds). The center pier remains a 4-slip community dock and provides dockage for the remaining inland property owners within the subdivision. The property owner of Lot 4 (Neblett) received a CAMA General permit (#36927) on February 17, 2004 to reconfigure the existing facility and construct additional fixed platform area. The property owner of Lot 5 (Cowper) received a CAMA General permit (#42857) on August 21, 2005 to reconfigure the existing docking facility and construct additional platform area. The Joshua's Landing POA received a CAMA General permit (#42886) to construct additional platform area at the existing docking facility. The property owners of Lot 5 (Cowper) allocated to the Property Owners Association the use of 52.495 feet of shoreline of Lot 5R for the purposes of the additional platform construction (see 'Bill of Sale Release of Access Easement and Restrictions for Lot 5 Pier Rights Joshua's Landing"). The existing community pier extends from an 11 foot wide common access easement on the highground over the marsh and open water for a distance of approximately 135 feet and measures 6 feet in width. The access pier terminates at a 14 feet wide by 20 feet long fixed platform which is connected via ramp to a 5 feet wide by 45 feet long floating dock oriented parallel to the shoreline. Five (5) mooring piles are located approximately 20 waterward of the floating dock and define the slips. Joshua's Landing Owners Association Page 3 The Hewlett's Creek tidal basin is approximately 900 feet wide in the project area. The channel on the project's side of the creek is approximately 80 - 90 feet wide, and is located approximately 200 feet waterward of Mean High Water (MHW). Existing water depths in the location of the existing community pier range from approximately -15 inches on the near shore side to approximately -20 inches at Normal Low Water (NLW) on the offshore side. The NC Division of Water Quality's water classification for Hewlett's Creek is SA. This part of Hewlett's Creek is closed to shellfish harvesting. Hewlett's Creek is a designated primary nursery area (PNA), by the NC Division of Marine Fisheries. 10. PROPOSED PROJECT The applicants propose to install four (4) "Jet-Dock" floating platforms within the existing slips of the community docking facility. Each of the proposed "jet dock" floating platforms would measure approximately 12 feet in width and 20 feet in length and are constructed of hollow polyethylene cubes rafted together. The applicant states the "jet-dock" placement would increase the ability to access the slips at any tide. No other changes or modifications to the existing structures are proposed. 11. ANTICIPATED IMPACTS The proposed installation of the floating "jet-docks" would incorporate an additional 960 square feet of public trust area and estuarine waters. Potential impacts to the shallow bottom of the Primary Nursery Area can be anticipated due to the limited water depths, -15 to -20 inches at NLW, in the location of the existing slips. The floating design of the "jet-dock" platform combined with the weight of a vessel resting atop the platform, would potentially cause the "jet-dock" not to float during all tides due to limited water depths. One could anticipate that the "jet-docks" would rest on the bottom during periods of low water, resulting in the potential of 960 square feet of shallow bottom impacts.. Submitted by: H.A. Snider Date: 11/12/10 Office: Wilmington Joshua's Landing CAMA Major Development Permit Application Wilmington, New Hanover County, North Carolina ECS Project 22-15653 July 10, 2010 1.0 PROJECT NARRATIVE 1.1 Development History and Use The site is located off Joshua's Landing Lane, off Leeward Lane and Greenville Loop Road, in Wilmington, New Hanover County, North Carolina. The site is also adjacent to Hewlett's Creek in Greenville Sound (Figures 1 and 2). The site is the existing Joshua's Landing subdivision that consists of ten residential single-family lots. An access easement is located at the cul-de-sac in between the only two waterfront lots (Lot 4 and Lot 5) of the subdivision that leads to an existing four-slip community docking facility. The facility is accessed by an elevated fixed pier that extends from an existing access easement out towards Hewlett's Creek distance of approximately 140 feet in length by 5 feet in width. The pier spans over an area of coastal marsh that measure approximately 90 feet in width. The pier terminates over open water into 22 feet in width by 14.75 feet in length uncovered platform. An access ramp leads onto a floating dock measuring approximately 48 feet in length by 5 feet in width, which runs parallel to the shoreline and channel. Five mooring pilings are located waterward of the floating dock that are spaced approximately 12 feet apart to accommodate the existing four slips (Appendix). Vegetation on the upland area adjacent to the common area and the community dock consists of live oak and maintained grass. Waterward towards Hewlett's Creek the vegetation consists of coastal wetlands and 404 type wetlands located along the property boundary. The 404 type wetlands area is vegetated primarily with southern wax myrtle (Myrica cerifera) and grounsel bush (Iva frutescens). Existing coastal wetlands is vegetated primarily with smooth cordgrass (Spartina a/terniflora) and black needlerush (Juncus roemerianus). ECS did not observe the presence of SAVs in the project location. Joshua's Landing Owners Association obtained a CAMA Major Development Permit No. 167-97 on December 31, 1997 for the construction of three community docks that accommodated up to ten slips combined that included an access easement and common area for the residents. The facilities were constructed in accordance with State Permit No. 167-97. The owners of Lot 4 and Lot 5 purchased the easement area located between their properties and the shoreline from the Joshua's Landing POA while maintaining the easement to the central docking facility. This enabled the owners of Lot 4 and Lot 5 the riparian rights. The owner of Lot 4 obtained a CAMA General Permit No. 36927 on February 17, 2004 to reconfigure the existing docking facility within its existing footprint with a new access pier, platform, floating dock and boatlift. The owner of Lot 5 obtained a CAMA General Permit No. 42857 on August 21, 2005 to also reconfigure the existing docking facility within its existing footprint with a new platform, floating dock and boatlift. Joshua's Landing POA obtained CAMA General Permit No. 42886 on August 21, 2005 to construct additional platform area to their existing docking facility. According to the document "Bill of Sale, Release of Access Easements and Pier Rights and Release Restrictions" produced by Mr. David C. Barefoot, Attorney at Law, the Joshua's Landing HOA was granted the use of 54.495 feet of shoreline measured from the southern most point of Lot 5R in a northwesterly. This allows the Joshua's Landing HOA to allocate a total of 80 feet of shoreline to enable the HOA to construct and maintain an addition to its existing pier. 1.2 Water and Land Use Classification Hewlett's Creek/Greenville Sound in this location is classified as SC waters by the N.C. Environmental Management Commission, and indicates the waters are closed to the harvest of shellfish. The project area is designated as primary nursery (PNA) by the N.C. Marine Fisheries Commission. The City of Wilmington CAMA Land Use Plan classifies this area as Conservation. 3 Joshua's Landing CAMA Major Development Permit Application Wilmington, New Hanover County, North Carolina ECS Project 22-15653 July 10, 2010 1.3 Proposed Development Joshua's Landing proposes to install four "Jet-Dock" platforms within the existing slips of the community docking facility. Each platform measures 20 feet in length by 11 feet 9 inches in width. The proposed platforms will be entirely within the existing footprint of the docking facility, just landward of the tie pilings that currently accommodate the existing slips and located in approximately -1.5 feet at NLW. Further, the proposed platforms would not encroach into the established channel of Hewlett's Creek (Figure 3 and Sheet 1). There is approximately 80 feet of shoreline, thus, there is a 640 sq. ft. size restriction on t-heads, platforms, finger piers, and decks for this particular project. The existing structures (platform, 246 sq. ft. and floating dock, 240 sq. ft.) have a combined area of 486 sq. ft. The proposed platform area will incorporate an additional approximately 940 sq. ft. of Estuarine Waters and Public Trust Area, exceeding the 640 sq. ft area. However, the proposed platforms will essentially usurp an area of Estuarine Waters and Public Trust Area that has continuously been utilized since the marina facility was constructed in the late 1990's. The proposed platforms would also be located within the existing footprint of the facility. 2.0 CONCLUSIONS The Joshua's Landing HOA understands the proposed jet docks exceed the maximum allowable square footage for the docking facility. At low-tide, access to and from the floating platform can be difficult. Since the site is located in a PNA, dredging around the existing boat basin is not an option. Placement of the jet docks will increase the ability to access the slips at any tide. Unlike most jet docks purchased and installed, the Joshua's Landing HOA intends to notify the State of its intent to place the said jet docks at the existing facility. Based on the potential to enhance the existing facilities of Joshua's Landing, it is the opinion of ECS that the site is eligible for the CAMA Major Development Permit for the installation of the proposed platforms of the community docking facility. the It is the opinion of ECS that the proposal is consistent with rule 15A NCAC 07.1.0211 Non- Conforming Development: (1) the structure will not be enlarged beyond its original dimensions; Placement of the jet docks will be within the existing footprint of current docking facility. (2) the structure will serve the same or similar use, The same boats currently moored at the dock, will continue to use the same slips with the aid of the jet docks. (3) There are not practical alternatives for replacing the structure to provide the same or similar benefits in compliance with current rules; The alternative to jet docks would involve the placement of hydraulic boat lifts. The hydraulic boat lift option is exceeds the current budget allotted to this project. (4) the structure will be rebuilt so as to comply with current rules to the maximum extent possible.
