SECRETARY 10 9 SUBJECT: Pipe Replacement on SR 1637 (Smith Farm Road), Alexander County Dear Mr. Wrenn: The North Carolina Department of Transportation requests authorization for the replacement of a 50-foot long, 36" CMP with a 70-foot long, 60 " CNW with inlet headwall on SR 1637 (Smith Farm Road) in Alexander County. The new pipe will be placed on a different skew to create a better stream/pipe alignment. Additionally, minor stream relocations will be done upstream and downstream of the new pipe to provide better stream/pipe alignment and to prevent continuing bank erosion in the vicinity of the road crossing. The upstream stream relocation will result in 18.3 feet of stream loss, while the downstream stream relocation results in 13 feet of stream loss; with an additional 10 feet of stream loss due to pipe fill. Five feet of riprap was used at the pipe inlet and outlet for structure stabilization. Additionally -20 feet of rock will be used as bank stabilization along the edge of the relocated upstream channel. Rock impacts is contained within the channel relocation impacts. The scope of the work resulted in 41.3 feet of permanent impacts to an unnamed tributary to Third Creek, which is classified as Class C waters by the Division of Water Quality. The project area is not located within %, mile of any critical watershed area nor is SR 1637 a rural or urban arterial; therefore, hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist. This office has conducted a GIS and field survey for the project for historical sites and threatened/endangered species sites. No sites listed on the National Register of Historic Places are located in the vicinity of the project nor did there appear to be any eligible structures. The federally listed species for Alexander County (USFWS listed date September 22, 2010) include dwarf flowered heartleaf (Hexastylis nani/lora) and the bog turtle (Glyptemmys muhlenbergii)- (T/SA- Threatened due to similarity of appearance). National Heritage Program records document the nearest dwarf-flowered heartleaf location -10 miles south of the proposed project area in Catawba County. The heartleaf is usually found on dry to moist ravine slopes (usually Post Office Box 47 Shelby, North Carolina 28151-0047 SR 1637, Smith Farm Road Page 2 November 9, 2010 north facing and of the oak-hickory-pine forest type) and in boggy areas near springheads. There is no suitable habitat within the proposed project area and no species were observed. Natural Heritage Program records document the nearest bog turtle location -1 northwest of the proposed project area along the main drainage of Third Creek. Bog turtles are typically found in bogs, marshes, and wet pastures. T/SA species are not subject to Section 7 consultation; however, there is no suitable habitat located within the project area and no impact on this species is anticipated. I have enclosed a pre-construction notification for a NW#14, sketches of planned activities, erosion control plans, and location maps relative to the project. Temporary cofferdam/bypass pumping will be used to divert the stream flow around the construction site, as needed.
