L? 0 Improvements Project at the Bridgewater Development OCT 2 6 mo Request for Certification Rescindment DWQ Project #: 20080915, Version 2 DENR • WATER QUALITY WETLANDS AND STORkMATER BRANCH Dear Ms. Sullins: Duke Energy Carolinas, LLC's, (Duke Energy) is submitting this request to rescind the North Carolina Division of Water Quality 401 Water Quality Certification (DWQ Project #: 20080915, Version 2), dated October 12, 2010. This request to rescind the 401 Certification is due to the inadvertent combining of two separate Duke Energy projects associated with the Bridgewater Development under one project number. The projects in question are the Linville Dam Embankment Seismic Stability (ESSI) Project and the Catawba-Wateree Hydroelectric Project (relicensing of hydroelectric dams). The two projects are both in the Federal Energy Regulatory Commission (FERC) Catawba-Wateree Hydroelectric Project #2232 but are completely separate projects. The Linville Dam ESSI Project is being constructed as part of a nationwide effort to increase the safety of dams during potentially catastrophic earthquake events as mandated by the FERC. The Catawba-Wateree Hydroelectric Project (DWQ Project #: 20080915) is associated with the relicensing of hydroelectric dams at the Bridgewater, Rhodhiss, Oxford, Lookout Shoals, Cowans Ford, Mountain Island, and Wylie Developments. To avoid any potential confusion, Duke Energy respectfully requests that the Division of Water Quality (DWQ) create a new project number for the Linville Dam ESSI Project and provide its re-approval of the 401 Water Quality Certification. www.duke-energy.com In addition, Duke Energy also requests that the 401 Certification issued on November 14, 2008, (DWQ Project #: 20080915) for the Catawba-Wateree Hydroelectric Project remain valid as stated in the November 14, 2008, approval.
