Dear Mrs. Karoly,
We recently received your "APPROVAL of 401 Water Quality Certification with
Additional Conditions, Wetland Restoration. Program", dated September 17, 2003. The
Owner has elected to mitigate for proposed stream and wetland impacts through payment
to WRP. Additional condition number 3 states that "you have one month from the date
of this Certification to make this payment." As we discussed earlier today, we have yet
to receive written Nationwide Permit Verification from the US Army Corps of Engineers
for this project, verifying their acceptance of this method of mitigation. As such, the
Owner requests that the deadline for payment of mitigation fees to WRP be extended
until March 11, 2003. This date corresponds with the expiration date of WRP's offer to
accept payment for proposed impacts associated with this project. Additionally, we are
aware that payment must be received and cleared by WRP before the proposed impacts
can be implemented.
