The purpose of this letter is to request formal verification of the jurisdiction of the Neuse River
Basin: Nutrient Sensitive Waters Management Strategy: Protection and Maintenance of Existing
Riparian Buffers Rule (15A NCAC 02B .0233) for the Shotwell Landfill (Site). The Site is
located on Smithfield Road in eastern Wake County, just north of the Johnston County line
(Figure 1). It lies within the Marks Creek watershed in the Neuse River Basin. The attachments
provided include location and site maps, as well as NC Division of Water Quality Stream
Identification forms for stream channels on the Site.
Based on the results of our field meeting on September 8, 2006 and a previous field visit by
Cyndi Karoly in October 2005, there are three stream channels (one perennial and two
intermittent/perennial tributaries) on the site that fall under the jurisdiction of these rules (Figure
2). Additional stream channels mapped on the US Geological Survey Clayton NC Quad Map
and Wake County Soil Survey (Sheet 72) were not present in the field as noted on the attached
maps. NCDWQ stream forms for the channels present on site are attached. Forms for the
existing streams SA through SD are also provided for the locations shown in Figure 2. Forms
N 1 through N4 are provided for the locations shown in Figure 3.
