SECRETARY 100399 Clay County State Project No. 41428.1 (DWQ Minor Permit Fee $240) Dear Mr. Baker: The North Carolina Department of Transportation (NCDOT) is proposing to widen the road to install 4-foot shoulders, construct two turn lanes and rehabilitate the pavement on a section of US 64 in Clay County. The project begins west of the intersection of US 64 and SR-1305 and terminates east of the intersection of US 64 and SR-1126. NCDOT would like to perform these activities beginning in the summer of 2010. The project will require the extension of a single cell box culvert (8.0' x 7.6') at one site and the construction of a junction box and the extension of a 24-inch corrugated metal pipe (CMP) at a second site. The extension of the box culvert is at the outlet end. The width of the box culvert extension is slightly larger than the existing box culvert. The extension of the corrugated metal culvert is on the inlet end. I have enclosed a pipe installation detail, photographs, a marked county map and USGS topographic map. The North Carolina Natural Heritage Database was checked for records of federally threatened and endangered species. There are no records within the project area. There are no records listed upstream for the headwaters of Sweetwater Creek or downstream of the project to Hiwassee River. The project is limited in scope and consists of extending a box culvert and a CMP. The impacts from the culvert extensions should be minimal. For these reasons, we believe there will be "no effect" on threatened and endangered species. Impacts to historic and cultural resources are not anticipated because the project will occur mostly within the existing disturbed road right of way of US 64. However, the project has been submitted to the North Carolina Department of Transportation's Human Environment Unit for review of archaeological and historical resources. No construction activities will proceed until the project is in compliance with the State Historical Preservation Office. The best management practices will be used to minimize and control sedimentation and erosion at this site. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion is being controlled effectively. If the planned devices are not functioning as intended, they will be replaced immediately with better devices. The rock silt screens and other erosion control devices will be in place prior to pipe culvert construction and will remain in place until the project is stabilized. Impacts to Waters of the United States Sweetwater Creek (DWQ Class WS-IV) is shown as a perennial stream on the USGS topographic map. The stream is 5-foot wide with a well-defined channel and a substrate of gravel, sand and silt. The unnamed tributary of Sweetwater Creek is not shown on the USGS topographic map. The unnamed tributary is perennial and has a well-defined channel with a substrate of sand, gravel and silt. Both channels lack vegetation. Sweetwater Creek flows approximately 2.6 miles downstream to Hiwassee River. The Hiwassee River meets the definition of a Traditional Navigable Water. For these reasons, we believe that Sweetwater Creek and the unnamed tributary are Relatively Permanent Water and are under the jurisdiction of the U.S. Army Corps of Engineers. In order to complete improvements to US 64, it will be necessary to impact waters of the United States in the Hiwassee River Basin. Specifically, NCDOT is requesting to extend two culverts within the Hiwassee River Basin. The proposed impacts are listed in the table below.
