Subject: SR 1311 (Cook Rd) Widening and Extension from SR 1909 (Westbrook Ave ) to SR 1503
(Manning Ave) on NC 100 in Alamance County, Federal Aid Project No. STP-0701(7), State
Project No.WBS34901.1.1, TIP U-311OB.
Dear Dr. Thorpe:
The NC Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for
the aforementioned project. Review of your application revealed it lacking necessary information
required for making an informed permit decision. The permit application was deficient in the following
areas:
The project lacks inclusion of the Jordan Lake Riparian Buffer Rules. It is within the Jordan
Lake Basin. Riparian buffer impacts shall be included in the permit application, and avoided
and minimized to the greatest extent possible pursuant to 15A NCAC .0267.
Also pursuant to 15A NCAC .0267, all stormwater runoff shall be directed as sheetflow
through stream buffers at nonerosive velocities. The current application does not satisfy this
requirement. Please modify your current treatment design, or explain why sheetflow is not
achievable, prior to discharge into the riparian buffer.
Therefore, pursuant to 15A NCAC 2H .6507(a)(5), we will have to place the permit application on hold
until we are supplied the necessary information. You have 21 days to respond in writing with the
requested information or notification to this office that the information is forthcoming. If, at the end of
the 21 days, this office has not received this information in writing, we will assume you are withdrawing
your application and it will be returned. Furthermore, until the information is received by the NC
Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place
the permit application on hold.
