Smail The LPA Group Incorporated 4401 Belle Oaks Drive, Suite 105 North Charleston, SC 29405 SUBJECT: CD09-031 - Consistency Certification for Proposed Impacts to Approximately 0.81 Acres of Wetlands to Facilitate the Extension of the Runway 22 Safety Area, Coastal Carolina Regional Airport, Craven County (DCM#20080149) Dear Mr. Smail: We received the consistency certification of The LPA Group Incorporated (LPA) on behalf of the Coastal Carolina Regional Airport. ("Applicanf) on November 3, 2008 for proposed impacts to 0.81 acres of wetlands to facilitate the extension of the Runway 22 safety area in Craven County, North Carolina: This work also includes the placement of 0.58 acres of fill and the clearing and grubbing of an additional 0.23 acres. The proposed work will extended the runway clearance area by 290 feet and clearing the entire area between the runway and NCSR 1167. The deadline for completing the consistency review process was extended, by mutual consent, to June 12, 2009. Additionally, the Federal Aviation Administration (FAA) will be providing Federal Assistance to the Coastal Carolina Regional Airport. The release of Federal assistance is also subject to consistency review. To expedite the consistency review process, this consistency review by DCM concurs with both the release of the Federal Assistance and the authorization to initiate construction under the State's coastal management program. To solicit public comments, DCM circulated a description of the proposed project to State agencies that would have a regulatory interest in the proposed development. No comments were received asserting that the proposed project would be inconsistent with the State's coastal program. Copies of the comments received have been attached. The Division of Coastal Management (DCM) has reviewed the consistency submission pursuant to the management objectives and enforceable policies of Subchapters 7H and 7M of Chapter 7 of Title 15A of North Carolina's Administrative Code which are a part of the State's certified coastal management program and concurs, as conditioned below, that the proposed project is consistent with the enforceable policies of North Carolina's coastal management program. The Applicant, prior to initiating any land disturbing activities, shall obtain (if required) the approval of the NC Division of Land Resources of an erosion and sediment control plan. The Applicant shall comply with the requirements of the approved sediment and erosion control plan. A copy of the plan approval shall be forwarded to DCM. The Applicant shall adhere to their mitigation commitment to purchase 0.81 riparian wetland mitigation credits from the North Carolina Ecosystem Enhancement Program. The North Carolina Ecosystem Enhancement Program has accepted this proposal through a letter dated October 23, 2008. Should the project be modified, a revised consistency certification could be necessary. This might take the form of either a supplemental consistency certification pursuant to 15 CFR 930.66, or a new consistency certification pursuant to 15 CFR 930.57. Likewise, if further project assessments reveal environmental impacts not previously considered by the proposed development, a supplemental consistency certification might be required.
