Box 1150 Fayetteville, North Carolina 28302 Dear Mr. Gibson: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 18 linear feet of intermittent stream for the purpose of upgrading an existing culvert on SR 1610 in Cumberland County. The specifically approved impacts are identified in the project application and are as follows: Location Lenuth and Type of Impact Crossing #1 18' - Replace one 24"x 32 ft. RCP w/one 42"x 50 ft. RCP This project shall be constructed in accordance with your application dated January 24, 2005, (received February 1, 2005). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3404. This certification corresponds to the Nationwide Permit 14 issued by the U.S. Army Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit, unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If total wetland fills for this project (nov the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear ft compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). Fol approval to remain valid, you must adhere to the conditions listed in the attached certification. 1) Upon completion of the project, the NCDOT shall complete and return the enclosed "Certif] of Completion Form to notify DWQ when all work included in the 401 Certification has bf completed. Also, we ask that you advise Mr. Ken Averitte of the Fayetteville Regional Off] when this work is completed. 2) NCDOT shall conduct its activities in a manner consistent with State water quality standar< (including any requirements resulting from compliance with section 303(d) of the Clean Wi Act) and any other appropriate requirements of State law and federal law. If DWQ determir such standards or laws are not being met (including the failure to sustain a designated or act use) or that State or federal law is being violated, or that further conditions are necessary to compliance, DWQ may reevaluate and modify this certification to include conditions appro to assure compliance with such standards and requirements in accordance with 15A NCAC 2H.0507(d). Before modifying the certification, DWQ shall notify NCDOT and the US Arn Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503 and pro' opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revise conditions shall be provided to NCDOT in writing, shall be provided to the US Army Corp; Engineers for reference in any permit issued pursuant to Section 404 of the Clean Water Ac shall also become conditions of the 404 Permit for the project. 3) Given the history of disturbance at this site and the elevation of this particular culvert relates to the adjacent wetland, extreme care must be taken to prevent a head-cut fror, forming upstream of the culvert. Total project length is 4,625$. The roadway will be widened from 16 feet to 20 feet and stabilized grass shoulders (6 foot) will be provided. This project will require the replacement of one (1) wet cross line as shown below: Crossing Roadwa Station Existing Culvert Proposed Culvert Crossing #1 Sta. 07+81.00 32LF 24" RCP 50LF 42" RCP New stream impacts = 8 linear feet Construction of this project will require impacts to waters of the United States in the Cape Fear River Basin. Crossing #1 will convey to UT to the Carvers Falls Creek. (Class WS-IV). Culvert #1 conveys drainage collected from a forested wetland area, which is situated just upstream. A consultant identified the wetland for the development that is ongoing in the southwest quadrant of the intersection of SR 1610 and US 401 (Ramsey St.) The wetland boundary was verified by NCDOT. Sidecast spoil material bordered the wetland. As part of this proposal, the existing 32 LF 24" RCP will be removed and a 50 LF 42" CMP will be installed. The 42" CMP will be buried 9 inches to accommodate aquatic life movements. The existing 24" RCP has signs of joint failure, necessitating replacement. In addition to the work described, the sidecast spoil material will be removed at the upstream/downstream end of the culvert. Removal of the side cast material will open up available flow area along the channel, reducing the P. O. RESOURCE STATUS In general, there will be minor impacts proposed as a result of replacing the culvert along SR- 1610 (McClousky Rd.) in Cumberland County. (18) Linear feet of stream impacts are expected. Jurisdictional Wetlands were not observed within the NCDOT right-of-way. The 42" RCP will be installed nine (9) inches below the invert of the stream to facilitate aquatic life movements. A Nationwide Permit # 14/ NCDENR 401 WQC 3404 is required for the project. During the review of this project, written notification to the Corps of Engineers is not required. Endangered Species: Plants and animals with Federal classification of Endangered (E) or Threatened (T) are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of 1973, as amended. These species are not biologically endangered or threatened and Are not subject to Section 7 consultation. A biological conclusion of "No Effect" was reached for all species during the November 3, 2003 survey for protected species. Protected species were not identified, nor, was the general habitat for each species identified within the 60-foot right-of-way. REGULATORY APPROVALS Application is hereby made for a Department of the Army Nationwide Permit # 14/ NCDENR 401 WQC 3404 as required by the above-described activities. After consultation with Richard Spencer, written notification is not required. The National Register was reviewed in addition to conducting a field view of the project for significant historic features. The project impacts are minor in nature and should not remove or degrade existing water quality uses. Pipe size proposed is the minimum necessary to create a safe highway while accommodating the 25-year design storm. There is no record within the NCDOT District 2 Office (Cumberland County) that the road experiences floods overtopping. By utilizing the erosion control measures, downstream water quality standards will be protected. All appropriate BMP's will be utilized during construction. Attached is a Preconstruction Notification Form, plan sheets, marked county road map, quad location map and photographs. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. DWQ prefers full-size construction drawings rather than a sequential sheet version of the full-size plans. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable Page 9 of 12 mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/stnngide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Mitigation is not required for this nroiect 2.
