Box 250 North Wilkesboro, NC 28659 Dear Mr. Slaughter: UZ You have our approval, in accordance with the attached conditions and those listed below, to impact 60 linear feet of Sawyer Creek and one of its. unnamed tributaries. in order to improve SR 1305 (Odes Wilson Road) in Watauga County. The project must be constructed in accordance with your application dated July 18, 2002 (,received July 23, 2002). After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Nos. 3366 and 3375, corresponding to the U.S. Army Corps of Engineers Nationwide Permit Numbers 33 and 14. In addition, you must acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 2. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 5. Riparian vegetation must be reestablished within the construction limits of the project by the end of the growing season following completion of construction. 6. Stormwater should be directed to vegetated buffer areas, grass lined ditches or other means appropriate to the site for the purpose of pre-treating.stormwater runoff, and must not be routed directly into. streams...Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for stormwater sheet flow. 7. Where practicable, culverts that are less than 48-inch in diameter should be buried to a depth equal to or greater than 20% of their size to allow for aquatic life passage. Culverts that are 48-inch in diameter or larger should be buried at least 12 inches below the stream bottom to allow natural stream bottom material to become established in the culvert following installation and to provide aquatic life passage during periods of low flow. These measurements must be based on natural thalweg depths. This may require increasing the size of the culvert to meet flow conveyance requirements. If any of the existing pipes are perched, they shall be removed and replaced, and re-installed correctly, unless demonstrated that this is topographically unfeasible. All Waters must flow through without freefalling or damming on either end of the culverts during low flow conditions, to maintain aquatic life and/or fish passage. 8. The dimension, pattern and profile of the stream above and below the crossing should not be modified by widening the stream channel or reducing the depth of the stream. 9. Disturbed floodplains and streams should be restored to natural geomorphic conditions. 10. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted -when practical. If rip-rap is necessary, it must be limited to the stream bank below the high water mark, and vegetation must be used for stabilization above high water. Any rip-rap used must not interfere with aquatic life passage during low flow conditions. 11. If concrete is used, work must be accomplished so the wet concrete does not contact the stream water. Heavy equipment must be operated from the banks rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 13. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 14. The presence of equipment in the channels must be minimized. Under no circumstances must rock, sand or other materials be dredged from the wetted stream channel under authorization of this permit, except in the immediate vicinity of the culverts. 15. Temporary dewatering sites must be restored to preexisting conditions unless more natural geomorphic conditions can be provided. 16. All work shall be performed during low flow conditions. 17. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality upon completion of the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. Total project length is approximately 1.1 miles. The roadway will be widened from 16 feet to 18 feet. Impervious surface area will increase by 0.27 acres or 4%. A Nationwide Permit #14 and #33 were requested for this project in July of 2002. This permit authorized 60 linear feet of stream impacts and 0.007 acres of temporary dewatering impacts. We have recently determined that constructing the project will also require relocating a ditch line approximately 10 feet to the south from approximate station numbers 14+00 -16+65. This ditch carries a 6-inch to 1-foot wide intermittent unnamed tributary to Sawyer Creek (Class: C). We have already reduced right-of-way through this section to avoid a wood retaining wall on the north side of the roadway. This was a condition of the right-of-way agreement. As a result, relocating the wet ditch appears to be the only alternative. To that end, we are proposing to excavate a 1-foot wide ditch/channel adjacent to the existing ditch line with 2:1 side slopes on the roadway side and 3:1 side slopes on the southern bank. The banks will be shaped, seeded and matted. Water will then be turned into the new channel. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. The NCDOT proposes to grade, drain, base and pave the referenced road. The bridges at stations 34+82 and 71+31 will remain unchanged. The project will widen the existing roadway from 16' to 18' and require impacts at two (2) locations. The impacts will occur at stations 21+21 and 28+16. A 40' x 71 "x42" CSPA will be replaced with a 60'x66"x51" CSPA with concrete headwall. A 40'x24" CMP will be extended 10 feet. Miscellaneous riprap and tempos -&` vatering will be necessary. Instream work and land disturbance within the 25-foot wide buffer zone are prohibited during the brown and brook trout spawning season of October 15 through April 15 to protect the egg and fry stages of trout from off-site sedimentation during construction. 2. Culverts 48" or larger should be buried approximately 1' into the streambed. Culverts less than 48 inches in diameter should be buried to a depth equal to or greater than 20% their size to allow for aquatic life passage. These measurements must be based on natural thalweg depths. The Division 11 Environmental Officer reviewed this project for the presence of threatened and endangered species on July 12, 2002. This project will have no effect on any federally listed endangered plant or animal species. According to the NCDOT web site, the NCDOT Historical Architecture Section has reviewed this project and determined that there are no NR/SL/DOE properties along this roadway that will be impacted by the proposed project (see attachment). Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for -Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Page 8 of 12 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that you would like to pay into the NCWRP. Please note that payment into the NCWRP must be reviewed and approved before it can be used to satisfy mitigation requirements. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option. Where possible, new grade will be below existing stream bed. If needed, bedding material will be clean stone. 4. Place the new pipe and compact back-fill. 5. Install slope protection on outlet and inlet ends of pipe. Also complete installation of erosion control measures and perform maintenance as needed on existing measure. 6. Establish permanent vegetation as soon as possible. 7. Remove rock silt screens as soon as possible after vegetation is established. Prior to removal of rock silt screens any accumulated silt must be removed. The NCDOT proposes to grade, drain, base and pave the referenced road. The bridges at stations 34+82 and 71+31 will remain unchanged. The project will widen the existing roadway from 16' to 18' and require impacts at two (2) locations. The impacts will occur at stations 21+21 and 28+16. A 40' x 71"x42" CSPA will be replaced with a 60'x66"x51" CSPA with concrete headwall. A 40'x24" CUT will be extended 10 feet. Miscellaneous riprap and temporary dewatering will be necessary. Total additional impacts associated with the two impacts will be 60 linear feet. An excellent brown trout fishery is known to be in associated drainages. We will not object to the project provided the following conditions are implemented: 1. Instream work and land disturbance within the 25-foot wide buffer zone are prohibited during the brown and brook trout spawning season of October 15 through April 15 to protect the egg and fry stages of trout from off-site sedimentation during construction. 2. Culverts 48" or larger should be buried approximately 1' into the streambed. Culverts less than 48 inches in diameter should be buried to a depth equal to or greater than 20% their size to allow for aquatic life passage. These measurements must be based on natural thalweg depths. The pipes should be large enough so SR1305, Odes Wilson Road 2 July 22, 2002 that waters-can flow through without freefalling or damming on either end during low flow conditions to maintain aquatic life passage. The dimension, pattern, and profile of the stream above and below the pipes should not be modified by widening the stream channel or reducing the depth of the stream. Previously disturbed floodplains and streams should be restored to natural geomorphic conditions whenever practicable. 3. If concrete will be used, work must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 4. Heavy equipment should be operated from the bank rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of g e utants into the stream. 5. r trig'ttero 0 o rol measures should be installed where soil is disturbed and maintained unti pro ct completion. 6. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 10 days of ground disturbing activities to provide long-term erosion control. We encourage NCDOT to utilize onsite vegetation and materials for streambank stabilization when practicable.
