If you dispute the Director's determination you may file a petition for an administrative hearing. You must file the
petition with the Office of Administrative Hearings within sixty (60) days of the receipt of this notice of decision. A
petition is considered filed when it is received in the Office of Administrative Hearings during normal office hours.
The Office of Administrative Hearings accepts filings Monday through Friday between the hours of 8:00 am and 5:00
pm, except for official state holidays. To request a hearing, send the original and one (1) copy of the petition to the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. The petition may also be
faxed to the attention of the Office of Administrative Hearings at [phone], provided the original and one (1)
copy of the document is received by the Office of Administrative Hearings within five (5) days following the date of

.0233)-EXPRESS REVIEW PROGRAM
Dear Mr. Ammons:
On August 30, 2006, at the request of Scott Mitchell of Mitchell Environmental, P.A., Lia Myott conducted an
on-site determination to review five stream features and one pond feature located on the subject property for
applicability to the Neuse Buffer Rules (15A NCAC 213 .0233). The features are labeled as "A", "B", "C", "D",
"E", and "F" on the attached map initialed by Lia Myott and Amy Chapman on September 6, 2006. The Division
of Water Quality (DWQ) has determined that the features labeled as "A, B, C, and E" on the attached map
are not subject to the Neuse Buffer Rules. The feature labeled as "D" on the attached map is subject to the
Neuse Buffer Rules downstream from the flag labeled "D1 Eph/Int" hung in the field by Lia Myott. The pond
feature labeled as "F" on the attached map is not subject to the Neuse Buffer rules since it is downstream of
an ephemeral channel and will likely not form an intermittent or perennial channel its dam is removed. This on-
site determination shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ that a surface water exists and that
it is subject to the buffer rule may request a determination by the Director. A request for a determination by the
Director shall be referred to the Director in writing c/o Cyndi Karoly, DWQ 401 Oversight/Express Review
Permitting Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. You must act within 60 days of the date that you
receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the
affected party (including downstream and adjacent landowners) is notified of this decision. This determination is
final and binding unless you ask for a hearing within 60 days.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers.
Nor does this letter approve any activity within Waters of the United States or Waters of the State. If you have
