Sullins Dee Freeman Governor Director Secretary July 1, 2009 Steve Mitchell 1813 Lancaster Drive Garner, NC 27529 RE: 3504 Rock Creek Drive NBRRO 09-070 Dear Steve: During a site inspection performed on April 7, 2009, Lauren Witherspoon with the NC Division of Water Quality (DWQ) determined that "Feature A" (see attached map) is subject to the Neuse River Riparian Buffer Rules. During the site visit we discussed the applicability of the Neuse River Riparian Buffer Rules as it currently pertains to this property. More specifically we I stated the following: • If your client plans to construct a new residence or add on to his/her existing residence then he/she can do so without DWQ approval if the new structure is within the footprint of the existing impervious area, including, the patio, covered deck and foundation of the brick residence. • No additional impervious surface is permitted within the riparian buffer. If you wish to add impervious surface to the buffer you may apply for a Variance to seek approval. • If the yard has been maintained/manicured prior to the Effective date of the buffer rule (July 22, 1997), then your client and/or any future owner may continue to do so within the same footprint that it was manicured prior to the rule. You cannot remove any mature vegetation that may exist within the maintained yard. Attached is the survey map that you have provided me depicting the impervious areas as I had identified within the buffer.
