Dear Mr. Thomas:
The NC Department of Transportation has partially completed the previously permitted activity
on SR 1529B (Blackberry Road) in Watauga County. However, a permit modification is needed
to construct the previously proposed new alignment section near station 103+00 on the
Watauga/Caldwell county he. Although the roadway will be shifted at this location, the existing
curve will remain unchanged to facilitate driveway access to a few houses in the area (See
attached diagram).
The original application requested authorizatio dd 80'x 60" C with a concrete
headwall at station 103+00 on the auga/Ca ell county a nment
shift. Due to constructability issue the roposed pipe si as ch ed to 100'x 72". tal new
impacts not previously permitted will c al 20 linear feet.
Due to the rain events over the past several months, we ll also need to dewater this area during
construction. We are proposing a fabric lined 130-foot long diversion channel with a few large
rocks on top to help hold it on place. The diversion will be filled in by the roadway construction
after the new pipe is installed.
Construction of this project will require impacts to waters of the United States in the Yadkin
River Basin. The wet cross line at station 103+00 carries an unnamed tributary to the Yadkin

River (Class: C, Trout). This project was inspected for the presence of threatened and
endangered species on April 4, 2002 and June 12, 2003. The subject project will have no effect
on any federally listed endangered plant or animal species. The NCDOT Historical Architecture
Section has reviewed this project and determined that there are no NR/SL/DOE properties along
this roadway that will be impacted by the proposed project.
The modifications proposed in this application should not remove or degrade existing water
quality uses. Any widening of the existing roadway will be directed away from any adjacent creek
whenever possible with minimum fill placed in any buffer area. The proposed pipe size is the
minimum necessary to create a safe roadway. By utilizing the erosion control measures outlined
in the attachments to this application, downstream water quality standards will be protected.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control
measures, a marked county map, a marked topography map and photographs.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with
the North Carolina Wildlife Resources Commission comment directly to you concerning the 404
Nationwide Permit application with a copy sent to me.
By copy of this letter, I am forwarding seven (7) copies of this application package to Cynthia
Van Der Wiele, NCDENR, Division of Water Quality,-401/Wetland Unit, for her review. It is
requested that any comments related to the 401 certification be forwarded directly to me with a
copy sent to the US Army Corps of Engineers.

111. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;

IV. Prior Project History

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Since this is an existing road the maintenance impacts are unavoidable. Realigning the road and
adding the wet cross line at station 103+00 will increase public safety. The remaining project
impacts are minor in nature and should not remove or degrade existing water quality uses. Pine
sizes used will be the minimum necessary to create a safe roadway. All appropriate BMPs will
be used during construction

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide. html.

Size and Location of project (waterway, road name/number, town, etc.): SR 1529B, from
the existing pavement south to the county line, east of Blowing Rock, North Carolina. The
project is located adjacent to, and below the headwaters of, the Yadkin River and four of its
unnamed tributaries.
Description of Activity
Mechanized landclearing, excavation and the discharge of fill material associated with the
replacement of a 40-foot long 60" corrugated metal pipe (CMP) at Station 23+50 with one line of
a 50' long 72" CMP, the replacement of one line of 40-foot long 24" CMP at station 32+00 with
one line of 50' long 36" CMP, the replacement of one line of 30-foot long 24" CMP at Station
39+00 with one line of 50' long 36" CMP, the replacement of one line of 40' long 72" CMP at
Station 54+75 with one line of 60' long 95" X 67" corrugated steel pipe arch (CSPA) with a
concrete headwall, the replacement of a 8740' long 18" CMP at Station 79+70 with a 60' long
18" CMP, the replacement of a 40' long 120" X 72" CSPA at Station 97+40 with a 60' long
128" X 83" CSPA with a concrete headwall and the addition of an 80' long 60" CMP with a
concrete leadwall at Station 103+00. Gabion baskets will be installed from Station 96+62 to
96+87 for streambank stabilization, impacting 25 linear feet of streambank. The project will
impact 158 linear feet of previously unimpacted stream channel for culvert installation and will
involve the placement of riprap along 100 linear feet of stream bank for bank stabilization at
eight separate crossings. CONDITION: All recommendations in the attached letter, from the
North Carolina Wildlife Resources Commission dated April 15, 2002, are hereby incorporated as
special conditions of this permit.

Dear Mr. Slaughter:
You have our approval, in accordance with the attached conditions and those listed below, to impact
258 linear feet of Yadkin River and its unnamed tributaries in order to improve SR 1529B
(Blackberry Road) in Watauga County. The project must be constructed in accordance with your
application dated April 15, 2002 (received April 23, 2002). After reviewing your application, we
have decided that this fill is covered by General Water Quality Certification No. 3375, corresponding
to the U.S. Army Corps of Engineers Nationwide Permit Number 14. In addition, you must acquire
any other federal, state or local permits before you proceed with your project including (but not
limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations.
This approval will expire with the accompanying 404 permit unless otherwise specified in the Water
Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ in writing and submit a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills
for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the
future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. NCDOT shall use Best Management Practices for the Protection of Surface Waters (NCDOT
March 1997) and Sedimentation and Erosion Control Guidelines for Sensitive Watersheds (15A
NCAC 413 .0024) must be implemented prior to any ground-disturbing activities to minimize
impacts to downstream aquatic resources. Temporary or permanent herbaceous vegetation shall
be planted on all bare soil within 15 days of ground-disturbing activities to provide long term
erosion control.
2.1n-stream work and land disturbance within the 25-foot wide buffer zone are prohibited during the
trout spawning season of October 15 through April 15, or other conditions as determined by the
North Carolina Wildlife Resources Commission, to protect the egg and fry stages of trout from
sedimentation during construction. NCDWQ recognizes the trout buffer zone encroachment (if
allowed by NCWRC) at the following locations:

of the growing season following completion of construction.
4. NCDOT is encouraged to use existing on-site vegetation and materials for stream bank
stabilization and to minimize the use of rip rap.
5. The pipes shall be designed and constructed so that it can be installed one foot below streambed
grade to enable waters to transport sediment and ensure passage of all aquatic life. The
dimension, pattern, and profile of the stream and floodplain above and below the structure shall
not be modified by widening the stream channel or reducing the depth of the stream.
6. All work shall be performed during low flow conditions.
7. Heavy equipment must be operated from the banks rather than in the stream channel in order to
minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
8. All mechanized equipment operated near surface waters must be regularly inspected and
maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or
other toxic materials.
9. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certificate
of Completion" form to notify NCDWQ when all work included in the §401 Certification has
been completed. The responsible party shall complete the attached form and return it to the
401/Wetlands Unit of the NC Division of Water Quality upon completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.

Dear Mrs. Manuele:
The NC Department of Transportatioa is scheduled to grade, drain, base, and pave primarily along the
existing roadway of SR 1529B (Blackberry Road) in Watauga County. A short section of the existing
roadway will be placed on a ne?v alignment near station 103+00 on the Watauga/C a] dwell county line in
order to eliminate a sharp curve. Although the roadway will be shifted at this location, the existing curve
will remain unchanged to facilitate driveway access to a few houses in the area (See attached diagram).
Tile total project length is approximately 2 miles. This project will require the replacement of six (6) wet
cross lines as well as the addition of one (1) other wet cross line as shown below:
1) Replace existing 40' x 60" CMP at station 23+50 with a 50' x 72" CMP.
2) Replace existing 40' x 24" CMP at station 32+00 with a 50' x 36" CMP.
3) Replace existing 30'x 24" CMP at station 39+00 with a 50' x 36" CMP.
4) Replace existing 40' x 72" CMP at station 54+75 with a 60'x 95"x 67" CSPA with a concrete
headwall.
5) Replace existing 87'x 18" CMP at station 79+70 with a 60'x 18" CMP.
6) Replace existing 40'x 120"x 72" CSPA at station 97+40 with a 60'x 128"x 83" CSPA with a
concrete licadwall.
7) Add an 80'x 60" CNIP with a concrete headwall at station 103+00 on the Watauga/Caldwell
county line to accommodate the alignment shift at tile same location.

Miscellaneous rip-rap impacts will total 100 linear feet or less.

Construction of the project will necessitate impacts to waters of the United States in the Yadkin River
Basin. The wet cross lines at stations 23+50, 54+75 and 97+40 carry the Yadkin River. The remaining
wet cross lines carry different unnamed tributaries to the Yadkin River (Class: C, Trout).
The Division I I Environmental Officer inspected this project for the presence of threatened and endangered
species on April 4, 2002. The subject project has been determined to have no effect on any federally listed
endangered plant or animal species.
According to the NCDOT web site, the NCDOT Historical Architecture Section has reviewed this project
and determined that there are no NR/SL/DOE properties along this roadway that will be impacted by the
proposed project (see attaclunent).
Since this is an existing roadway, the modifications proposed in this application should not remove or
degrade existing water quality uses. Any widening of the existing roadway will be directed away from any
adjacent creek whenever possible with minimum fill placed in any buffer area. Pipe sizes used will be the
minimum necessary to create a safe roadway. By utilizing the erosion control measures outlined in the
attachments to this application, downstream water quality standards will be protected.
Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control measures, a
marked county map, a marked topography map and photographs.
By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with the North
Carolina Wildlife Resources Commission comment directly to you concerning the 404 Nationwide Permit
application with a copy sent to me. Please note that a trout buffer zone encroachment variance will be
requested from stations 23+50 - 28+00, 39+00 - 41+50 and 96+50 - 98+50.
By copy of this letter, I am forwarding seven (7) copies of this application package to Cynthia Van Der

Attach a vicinity map clearly showing the location of the property with respect to local landmarks such

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Since this is an existini road, the maintenance impacts are unavoidable. Realigning the road and
adding the wet cross line at station 103+00 will increase public safety. The remaining project
impacts are minor in nature and should not remove or degrade existing water quality uses. Pipe
sizes used will be the minimum necessary to create a safe roadway. By utilizing the erosion
control measures outlined in the attachments to this application, downstream water quality
standards will be protected. All appropriate BMPs will be used during construction.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available, at
http://l12o.enr.state nc.us/ncwetlands/strnigide.litml.

GENERAL NOTES ON EROSION CONTROL
Silt Basin Type B's will be constructed to the dimension of six feet by three
feet by three feet unless otherwise noted on the plans.
Where slope protection treatment is required, Section 868 and Section 1042 of
the 1990 Standard Specifications for Roads and Structures will be followed.
Any material obtained from the project must be clean before being placed.
Generally, the order of installation of the erosion control measures will be as
follows:
Temporary Silt Basins shall be installed before clearing and
grubbing begins.
Silt Fences and Temporary Silt Ditches shall be installed after
clearing and before grading.
Temporary Stone Ditch Checks shall be installed as soon as
ditchline is established.
Pipe Outlet and Inlet, Protection will be done as soon as the pipe
is installed.
Seeding and other permanent erosion control measures are to be
implemented as soon as practical.
PIPE INSTALLATION
1. Install erosion control devices. In streams, where necessary, rock silt
screens will be used and installed prior to pipe replacement or any
work being done to channel.
2. Remove material and existing pipe while limiting, as much as
possible, material and sediment from entering a stream and/or
escaping from project.
3. Prepare pipe foundation while again taking care to limit, as much as
possible, material and sediment from entering a stream and/or
escaping from project. Where possible, new grade will be below
existing stream bed. If needed, bedding material will be clean stone.
4. Place the new pipe and compact backfill.
5. Install slope protection on outlet and inlet ends of pipe. Also
complete installation of erosion control measures and perform
maintenance as needed on existing measure.
6. Establish permanent vegetation as soon as possible.
7. Remove rock silt screens as soon as possible after vegetation is
established. Prior to removal of rock silt screens any accumulated silt
must be removed.

SUBJECT: North Carolina Department of Transportation (NCDOT), NCSR1529B,
Yadkin River and Unnamed Tributaries Yadkin River, Watauga County
NCDOT proposes to grade, drain, base, and pave primarily along the existing roadway of
Blackberry Road. Biologists with the North Carolina Wildlife Resources Commission
are familiar with habitat values in the area. These comments are provided in accordance
with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended;
16 U.S.C. 661-667d) and the North Carolina Environmental Policy Act (G.S. 113A-1
through 113A-10; NCAC 25).
NCDOT proposes to replace and upsize several existing culverts while completing the
project. Headwalls will be added at two locations where CSPAs will be installed.
Miscellaneous riprap impacts are indicated to be 100 linear feet. Total new stream
impacts will be 258 linear feet. Gabions will be used from Station 96+62 to 96+87 to
provide streambank stabilization.
These Yadkin headwaters support populations of brook trout. Based on our review of the
submittal and our knowledge of trout in the area, we will not object to the project
provided the following conditions are implemented:
1. Instream work and land disturbance within the 25-foot wide buffer zone are
prohibited during the brown and brook trout spawning season of October 15
through April 15 to protect the egg and fry stages of trout from off-site
sedimentation during construction.

2. The use of riprap and gabions in channel should be avoided to the extent
practicable. Neither material should interfere with aquatic life passage
during low flow conditions.
3. Culverts 48" or larger should be buried approximately F into the streambed.
Culverts less than 48 inches in diameter should be buried to a depth equal to
or greater than 20% their size to allow for aquatic life passage. The
dimension, pattern, and profile of the streams should not be modified by
widening the stream channel or reducing the depth of the stream. Previously
disturbed floodplains and streams should be restored to natural geomorphic
conditions whenever practicable.
2. If any concrete will be used, work must be accomplished so that wet concrete
does not contact stream water. This will lessen the chance of altering the
stream's water chemistry and causing a fish kill.
3. Heavy equipment should be operated from the bank rather than in the stream
channel in order to minimize sedimentation and reduce the likelihood of
introducing other pollutants into the stream.
4. Stringent erosion control measures should be installed where soil is disturbed
and maintained until project completion.
5. Temporary or permanent herbaceous vegetation should be planted on all bare
soil within 5 days of ground disturbing activities to provide long-term erosion
control. We encourage NCDOT to utilize onsite vegetation and materials for
streambank stabilization when practicable.
